SNINPOCH September 14, 1982 MAYOR TO: y ichard C. Houghton, Public Works Director FROM: Ronald L. nlsen, Utility Engineer SUBJECT: King County Shops and Court House Items that still have not been com^ieted since 1977 on W-458 is the granting of . 1. Utility easement for the watermain in the county shops area. 2. Bill-of-Sale for the watermaln in the county shops area. This in also part of the requirement of the Latecomers Agreement that was granted in 9-12-77. It should be rote: that a photo mylar was submitted of the original as-built that was not acceptable. It appears that this is all we are goinq to get from them, so it will have to do. One item that has been requested for the new county court house is an easement for the proposed watermain on the southerly portion of that project. The City wrote the legal description, prepared the original document and prepared the exhibit to be attached to said document, for this prof-ct. It was delivered to King County for execution in the month of June 1982 and we have still not received and executed copy of said easaaent. They were also told that the City did not want to proceed with bidding the project until the necessary easements were executed and returned to the City. According to our recorls, under Water Project No. 458, the Systems Development Fee was paid on a portion of the King County Shop Site at tht rate of $0.01 per sq. ft. for 20 acres in the amount of $8,717.00 for water and "nitary scwsr on September 13, 1977. A copy of Receipt No. 2218 Is attached hereto, together with a letter of transmittal from 0. J. Salterelli. In plotting the legal description for the office trailer, we found the area of the site to fall within the 20-acre parcel that had previously Paid towards a Systems Development Fee. Therefore, King County does not owe $0.04 per sq. ft. under our current ordinance for a Special Utility Connection Charge. Administration Bldg. 500 Fourth Avenue Seattle, WA 98104 Attn: Mr. 0. J. Saltarelli Dear Mr. Saltarelli: In the matter of compacting the backfill over the 16-inch cement lined ductile iron water pipe, it is true that a pipe of this size has to be dealt with carefully. It is also true that water settling of the backfill, particularly in pavement areas, will not produce reliable results. The backfill has to be mechanically compacted to 95%. In order to not jar off any of the cement lining, it is recommended that small equipment be used, such as a manually controlled vibrating steel plate compactor. A tamper powered by an air compressor would also be satisfactory, but may be too slow. A 3-ton roller may give satisfactory results, but this would have to be observed. In order to lessen chances of damage to the water pipe, it would be wise to water settle those areas that are not under paved areas, such as planting beds, etc. You would have to expect to level off areas that settle with the passage of time. Right of Way of Monroe Street Dear Mr. Horsy: On March 11, 1977. we Wrote to you on behalf of our client, Greenwood Memorial Park, concerning the above references matter. I have received no reply to that correspondence. I have just been advised by my client that construction has commenced for the placement of Utilities upon said 30 foot strip. Our contention concerning the ownership of the strip has not changed. We would ask that the construction be stopped immediately. In your correspondence dated March 9, 1977, to Green- wood Memorial Park you named to rely heavily on the fact that the Ring County Assessor's office has never taxed the property owner for the roads on the four sides of the cemetery. I enclose herein a copy of correspondence dated October 30, 1974, from Marley Hoppe s Office which shows that in fact the 39.330 acres of the 40 acre tract have been included on their tax statements. The only portion not included is the roadway to the North which is a little less than 1 acre in size, Mr. Don R. Harty, P. a. Page 2 July 1, 1977 1 personally examined the King County Assessor's Records and had a lengthy conversation relating to them with Mr. Glen Schelling, Commercial Appraiser. His telephone number is 341-3977. Ths17 records would confirm that my client has paid the property taxes on the 30 foot strip of property to the South, Bast and west of the plat. Assuming no other intervening action by the City, the Jediation in the Plat would be controlling pursuant to Which the west 30 feet of the Greenwood Cemetery Plat would constitute public right of way. We also assume that Greenwood Cemetery was the proper owner of said right of way at the time of Platting and that no vacation or other change has taken place. You may undoubtedly wish to check this out with the Title Company to determine why they would arrive at a different conclusion, assuming that to be true according to Mr. Wyman Dobson's letter of March 11th. As yc,u know, the issue of adverse possession would not be available to the abutting property owner as to these right of ways, even though unimproved. It is our opinion that the westerly 30 feet of the plat of Greenwood Cemetert was dedicated for road purposes by the filing of the plat of Greenwood Cemetery. '[his is affirmed by the Assessor's map which indicates that the records date back to 1938, and neither the cemetery nor the other property owners in the subdivision have been assessed for the road area. On the :Assessor's map this has oeen designated 124th .Avenue SE. If you concur, it is our intention to proceed and issue the County a permit to install utilities within the subject right-of-way and ultimately to improve the roadway for access to their shop facilities wh;ch will soon he under construction. All the information we have in our possession shows that there has never been a dedication of or grant to the county of the 30 feet that your department contends comprises the East 30 feet of Monroe Street. We have checked with the title company and they confirm this. ` le Should the county desire to sit down and discus, the possibility of purchasing the strip in question our clients will be happy to do so. In the interim we would hope that the county will respect our client's ownership of the strip in question. Very truly yours, DOBSON, HOUSER i DOBSON Wyman R. DELAURENTi , MAYOR December 13, 1976 King County Department of Public Works Solid Waste Division 853 King County Administration Building aEi.E IV to Seattle, WA 99104 DEC 111975 Attention: Mr. Southworth Subject: Renton. Transfer Station - Your Letter of December 10 Gentlemen: Our records indicate that the City of Renton does not own the 2-inch water line which serves the County Health Department, the Traffic Division, and the Transfer Station. There are also no casements granted to the City of Rcnto. for this lii.e. It appears the meters were set by the City ❑s a matter of convenience to King County to separate the water billings ammig the various County agencies. therefore, your request for the City of Renton to lower the main cannot be accepted. Since this is a private line, it will be the County's responsibility to make whatever adiustments they feel are necessary. If the County desires that the City accept the facility, it would be necessary to install a proper size main and provide the necessary rights-of-way and hills-of-sale granting the water line to the City. If you desire to do this, we would be pleased to work with you on that accomplishment. As a matter of convenience to the County, the City is willing to continue to have the meters set as they now are to serve the various County users, and our meter readers will continue to segregate this use for billing purposes . .As an alternative, the City could remove the miters and set one meter in the laity right-of-way on NE 4th and give one master billing to the County. A portion of the water line located between the water Alain and the water meter servicing our facility will be exposed by this construction. 2. A backflow prevention device has been proposed by your office (October 6, 1976 letter) to be incorporated into the transfer station water system. This office is willing to purchase and install a 2 inch backflow prevention device. This could be included in the proposed construction. The lowering of the waterline is felt be the Water Utility's responsibility as it concerns a portion of the water Ystribution system. The road construction is scheduled to commence in early February, 1977. Lowering of the waterline from Sta. 1+25 Lt. to Sta. 4r50 Lt. by your office prior to this time would be required. Please respond to the above in writing by December 10. 1976, as thi- project is to be advertised on Dtcember 16, 1976. If you have any questions, please contact Dave Nyblom (344-3840) of this office.
