Inc., was based upon the preliminary set of drawings for LID 302 furnished by the City of Renton. The storm system was designed to tie into LID 302 at a manhole located at the southwest corner of the intersection of 41st and Lind Avenue. _ The final drawings for LID 302 have relocated this manhole to the northwest corner of the intersection. Alternative A or B as shown on the attached Sheet SD-1 would be adequate to eliminate this conflict. Due to the delay in their construction temporary fire protection water was required. One alternative was the construction of interties between the cities of Kent and Tukwila to supp�y temporary fire protection until such time that Lind Avenue would supply the primary protection. Due to the time commitments Benaroya had with Boeing for delivery, it was decided that the interties were the best source of fire protection. Benaroya then requested the City to make agreements with the cities of Kent and Tukwila for the interties. It was understood that their inter- ties would be metered and be of a permanent nature and that they would require maintenance. Like any metered service these were to have been turned over to the City for maintenance. The City as a general rule does not charge for water used in fighting a fire or fire hydrant flushing and maintenance, but in fact the City has paid the cities of Kent and Tulwila for any water usage registered on said meters. Agreements for said interties were aquired from Kent and Tukwila. These agreements required that no Est would be assessed against either Kent or Tukwila and that the City of Renton would therefore own and maintain said facilities. Benaroya then requested that the costs for these interties be included in the L. I.D. 302 because they were of a general benefit to the entire industrial area. But the preliminary boundaries did include the Benaroya property. The agreement was that the City would participate financially in a like amount of the system development charge to be assessed on Division 01 of the development which was E59,179.73 based on the square footage of the platted Division 91. The Public Works Department also stated that they would support a latercomers agreement for that portion of main installed between the East Valley Highway and Lind Avenue S.W. in S.W. 19th Street. SYSTEM INTERTIE REIMBURSEMENT r Benaroyas development and fire flows for Buildings 01, N2, and k3 were originally designed to be supplied by the Lind Avenue water main extension. Due to the delay in their construction temporary fire protection water was required. One alternative was the construction of interties between the cities of Kent and Tukwila to supply temporary fire protection until such time that Lind Avenue would supply the primary protection. s ' Due to the time commitments Benaroya had with Boeing for delivery, it was decided that the interties were the best source of fire protection. Benaroya then requested the City to make agreements with the cities of Kent and Tukwila for the interties. It was understood that their interties would be metered and be of a permanent nature and that they would require maintenance. Like any metered service these were to have been turned over to the City for maintenance. The City as a general rule does not charge for water used in fighting + a fire or fire hydrant flushing and maintenance and in fact has paid fo*"nv water, registered on said meters. 40k;= Agreements for said interties were aquired from Kent and Tukwila. These agreements required that no cost would be assessed against either Kent or Tukwila and that the City of Renton woulA therefore own and maintain said facill0es. Benaroya then requested that the costs for these interties be included in the LID 302 because they were of a general benefit to the entire r , industrial area. The Public Works Department supported this request to the City Council, but the City coun,J i denied the request for inclusion in the L.I.D. It should also be noted tnat these interties were to be for emergency fire protection only and that the intertie agreements allowed the Cities to close and cancel said interties with 20 days notice. Therefore, in the calculations f fire flows in the industrial areas these interties were excluded from having any value. This theory of value of the interties +, somewhat substantiated by the value of the Kent intertie. In the winter, Kent in the past has had plenty of water available but in the summer months Renton his had to supply emergency water to them to keep water in their reservoirs. I.D. 302 and its' relationship to the City's system development charge, the City's position is as follows. SYSTEM DEVELOPMENT CREDITS There was a verbal agreement made with the develop. rs of the Orillia Industrial Park (Burlington Northern) and their representatives regarding the installation of the water main in S.W. 19th Street between the Talbot Hill Reservoir and Lind Avenue S.W. This installation did benefit the entire industrial area but vas basically required to supply the necessary fire flows required by their development of Division N1. The estimated cost for this installation was approximately $325,000. At the time the first discussions took place, the exact bo6ndlies of Division 01 had not been established. But the preliminary buundries did include the Benaroya property. The agreement was that the City would participate financially in a like amount of the system development charge to be assessed on Division kl of the development which was $59,179.73 based on the square footage of the plated Division 01. The Public Works Department also stated that they would support a latercomers agreement for that portion of main installed between the East Valley Highway and Lind Avenue S.M. in S.W. 19th Street. The above agreement was based on Burlington Northern paying the entire development cost for said installation. It was not understood by the Utility Engineering Officu that Benaroya had been assessed $23,316.89 for this water main. This assessment was in error and should be returned to you. It should also be noted that this assessment for the waterline in S.W. 19th Street was placed on property from S.W. 27th Street to S.W. 43rd Street which originally was Burlington Northerns property. SYSTEM DEVELOPM'NT CREDITS There was a verbal agreement made with the developers of the Ori'lia Industrial Park (Burlington Northern) and their representatives regarding the installation of the water main in S.W. 19th Street between the Talbot Hill Reservoir and Lind Avenue S.W. This installation did benefit the entire industrial area but was basically required to supply the necessary fire flows required by their development of Division All. The estimated cost fcr this installation was api^oximately $325,000. At the time the first discussions took place, the exact boundries of Division 01 had not been established. But the preliminary boundries did include the Benaroya property. The agreement was that the City would participate filiancially in a like arrount of the system development charge to be assessed on Division ill of the development which was $b9, ,;9.73 based on the square footage of the plated Division al. The Public Worzs Department also stated that they would support a latercomers agreement for that portion of main installed betwe^n the East Valley Highway and Lind Avenue S.W. in S.W. 19th Street.
