KNOW ALL MEN BY THESE PRESENTS, that for valuable consideration and
as a donation (as more fully detailed below), JACK A. BENAROYA COMPANY, a
Washington corporation ("Grantor"), does hereby grant, bargain, convey and

at 17200 West Valley Highway (Ralph Leber Company), such Easement being
designed to the City of Renton simultaneously herewith.
To have and to hold the same for said Grantee, its successors and
assigns, forevc,.
Grantor covenants that it is the lawful owner of said im,rovements,
free Of any liens, encumbrances or claims, that it has the right to sell the
ame, and that it will warrant and defend the same against the lawful claims
and demands of any person, and will udy any costs and reasonable attorney's
fees incurred by Grantee arising from such claim Or demand.
This Bill of Sale is given for the consideration of Five Thousand and
00/100 Dollars ($5,000.00) to be paid by Grantee to Grantor. Grantor and
Grantee acknowledge that the improvements and easement being transferred
to Grantee have a value of not less than $54,269.21, and the difference
between such value and grantee's payment ($49,269.21) is a donation by Grantor
to Grantee.

WHEREAS, Relco Investment Company, a co-partnership ("Grantor"),
granted an easement to Jack A. Ben,roya Company, a Washington corporation
("Grantee"), for public utilities over certain real pruperty, as described

WHEREAS, such Ea
sement provides that Grantee Shall have the right to
assign the Easement to the City of Renton ("Assignee";, provided Assignee
assumes the obligations of Grantee set forth in such Easement, and
WHEREAS, Grantee desires to assign to Assignee, and Assignee is willing
to accept, all rights and duties of Grantee under the Easement,
NOW, THEREFORE, as of this 28th day of December, 1981. Grantee does
hereby assign all of its rights and obligations under the Easement to
Assignee.

Grantor retains the right to fully use and enjoy the above des-
cribed pronerty, including the right to use the surface of said right-
of-way if such use does not interfere with maintenance of the utility
lines. Grantor shall not erect buildings or like structures over,
under or across the right-of-way during the existence of such utility,
except as provided in the next naragrauh.
In the event Grantor shall find it necessary to relocate any
utilities olaced within the easement right-of-.+ay, the cost of said
O relocation shall be shared equally between Grantor and Grantee, If,
uoon such relocation, any portion of the utilities are located out-
side of the above-described pronerty, then this easement shall expire,
and Grantor shall forthwith execute and deliver to Grantee or to its
assignee, a new easement in similar form hereto, describing the new
location of the water lines.

This easement is a covenant running with the land and shall be
binding on the Grantor, its successors and assigns. Grantor covenants
that it is the lawful owner of the above described oronerty and has
good and lawful right to execute this agreement.

between RELCO INVESTMENT COMPANY, a co-partnership, hereinafter called

Grantor for and in consideration of the sum of $10.00 paid by
Grantee, and other valuable consideration, hereby grants, bargains,
sells, conveys and warrants to Grantee, its successors and assigns,
an easement for public utilities (including water) with necessary
apnurtenances, through, across and upon the following described pro-
nerty in King county, Washington, more particularly described as follows:
Portion of Government Lot 7 in the southwest quarter of Section

Washington, described as follows:
Beginning on the north tine of said Government l,ot 7
at a point 30 feet, measured perpendicularly, from
the easterly margin of the West Valley Highway (SR 181) ;

connected thereto are located outside the above-described property,
then this easement shall exnire, and Grantor shall forthwith execute
and deliver to Grantee or to its assignee a new easement the similar
form hereto, describing the new location of the vault anj its connected
lines.

Cedar River Trail matter to the Ways and Means Committee for appropriate legislativ,
Natural Zone action. The report noted the IAC Committee has approved the City'
request for funding of property acquisition for extension of the
Cedar River Trail east of 405; IAC grant total is $192,'19; reports
to be submitted to Council for approval re negotiated price prior
to purchase. MOVED BY STREDICKE, SECOND CLYMER, CONCUR IN COMMITTEE
RECOMMENDATION AND AUTHORIZE INITIAL PURCHASING ACTION. CARRIED.
Planning and Planr, 3 and Development Committee Chairman Perry submitted report
De- volo ent recomm.nding that the City Council adopt an ordinance amenling Code
ommittee Report Section 4-3014 to provide extension of time for filing of the recom-
mendation or decision of the Land Use Hearing Examiner to extra-
ordinary cases for not more than thrity days after conclusion of
hearing if the Examiner requires the extension due to nature of

I represent the Ralph Leber Company. It is my understanding
that the City and Bruce Leber, of Ralph Leber Company, nave
agreed as follows;
The City may proceed to install an Intertie Vault on
an agreed location on the Ralph Leber Company property.
If, after completion of this project, Leber loses any
parking space, they will be compensated by payment of
the sum of $2,500.00. If no parking spaces are lost,
no compensation will be pain.
In the event that Leber finds it necessary to relocate

There is a benefit to Leber from this project. They will
now have an intertie for fire protection and the regular
water main between aonton and Tukwilo. This will be an
automatic procedure should one system fail for some
reason.
The City will prepare a formal easement encompassing
this agreement.
We understand that the City has an understanding with
the Benaroya Company to pay any compensation that
might be due pursuant to this agreement.

In order to provide the necessary water supply to our buildings now under
Construction and to enable our tenants to take occupancy by the agreed date,
we will du the following:
(a) install a 16" waterline on Glicier Park Company property within
the 15 feet east of and adjacent to the Lind Avenue right-of-way,
from S.W. 43rd to S.W. 41st Street, consisting of approximately
912 lineal feet.
This work, which is part of L.I.D. 4302. will have a value
determined at the same unit price as that included in your
contract 'o be awarded for L.I.D. 0302;
(b) install two meter/control vaults, one each for the Kent and
Tukwila intertiesfor emergency fire protection water supply,
as per plan prepared by Mortimer Thomas, P.E., of Gardner
Engineers, dated July 24, 1978, a copy of which was filed
with Mr. Ron Olson. This work is to become a pr't of L.I.D.

We will promptly submit to you evidence of our actual t:ptnses in accomplishing
item (b) above, for both items (a) and (b), we will be reinbursed either as
a contract to be included in the L.I.D. or, if you prefer, as a credit against
our assessment for L.I.C. #302.

expedite the installation of this work.

A Fire In The Vicinity of SW 43 Street and Lind
Avenue
This letter summarizes our analysis of the water supply
available for fighting a fire in the vicinity of SW 43 Street
and Lind Avenue.
The supply available can be evaluate3 while maintaining
two different residual pressures: 20 or 60 psi. Tp �rmer
is the criterion currently accepted by most water sy s,
fire department, and regulating agency authorities.
However, acceptance of the lower pressure criterion ignores
the situation that, when the pressure in the

• Wells 1 , 2, and 3 operating; as directed by
Insurance Services Office criteria, Well 8 is not
operating
• Windsor Hills and Mt. Olivet pump stations are
operating at 2,007 and 2,712 gpm, respectively,
while the Mt. Olivet reservoirk altitude valve is
closed
• Talbot Hill reservoir level at 3 feet below over-
flow level and Talbct Hill pump station operating
at .,500 gpm
• Springbrook Springs supplying 1,300 gpm to the
system
