Subject: Requested for L.I.D. for Water Mains in Superior Fast Freight
and Garfield Auto Freight Properties
Dear Mr. Knopp:
The question was posed to the City Attorney, Larry Warren, as to whether
an L.I.D. could be formed after construction of the proposed utilities
by private contract had already been completed.
He stated that the state laws regarding L.I.D.'s did not directly add-
ress this question but went on to say that he had determined that it
would not meet other state laws with regards to city work, and therefore
would not be considered as a viable L.I.D. that could legally be sup-
ported.
The problem areas that he referred to were .i , follows:
1. When the cost of a utility project is greater than $15,000, a
contract can not be issued without going through a public bid
process to determine the cost of this project.
2. The L.I.D. process was designed to have projects financed and
then constructed. The forming of an L.I.D. after the fact
would put the City in the position of being a lender of finances
which of course would be unconstitutional.

The following are the requirements, per our meeting of tebruary 13,
1979, for the installation of the fire protection service for the
aforementioned development.
The watermain shall be installed i^ such a manner that it can be
intertied and/or extended as an integral part of the water utility
system. Saseeents for the watermain shall be granted the City for
maintenance of said watermain.
Attached herewith is a copy of the "Regulations and Standards for
Construction of Extensions to the City Water and Sanitary Sewer
Systems" as previously distributed to you, These regulations spell
out the drawing or plan requirements, such as drawing size 22" x 34"
and drawing scales, which will be required for plan approval.

We are most happy to approve of the Service Paper
fire main system to be connected to the system out-
lined above.
Our Cuntractor, the Koji Company, is preparing a copy
of their portion of the costs involved in our fire
system to the West. We will send you a total cost
figure when the total cost has been developed. It is
our understanding the City granted our Late Comers
Agreement on May 12, 1980, and we will be reimbursed
for the proportional cost outlay through the City.

on April 16. 1979. On February 28, 1980, you requested a Latecomers Agree-
ment on the same water line for part reimbursement of your costs for its
installation. It was assumed at that point that you no longer wanted the
L.i.D.
On March 3, 1980, the City Counc I referred your request to the Utilities
Committee and on May 12, 1980, the City Council granted your Latecomers
Agreement. At this time to complete this Latecomers Agreement, the following
information is required.

As we discussed in our meeting on July 2, 1979, Metro w_11
accept the industrial wastes from the truck washing operation
based upon the following conditionst
1. A mobil washing enterprise can wash all the trucks
and trailers, .stimated rver 230 units, where they
are parked within the yare-
2. The effluent from the washing operation shall be
discharged to the sanitary sewer system by
activating a special pump in the final yard catch
basin (type II) ;
3. An employee will be responsible for engaging the
pump prior to any washing operation. Immediately
after the washing activity naa been completed or
during periods of no washin7, the pump shall be in
the storm drain position;
C. A visible light shall indicate when the pump is on
and in the sewer position;
5. The pump switch shall be visible and positioned for
easy access;
6. All truck washing effluent shall. pass through the
pump, which shall meet Metro's discharge require-
ment of 100 ppm oil;
7. No truck washing effluent shall be discharged into
the storm drain system;
B. No rain water or storm water shall ba discharged
into the sanitary sewer system.

Freight to the sewer systam does not in any way guarantee
that the equipment will function in the manner dtacribed
by its constructor or manufacturers, nor shall it relieve
Superior Past Freight of the responsibility of enlarging
or otherwise modifying the equipment to meet the discharge
requirements.

Dear Mr. Gonnason:
The purpose of this letter is to initiate an L.I.D. to cover
the cost of a 10" water line with four fire hydrants and a
12" water line with four fire hydrants.
:he 12" water line will be installed on the property of
GarfieV Transfer extending from S.N. 34th Street to S.W.
37th. Strs.at in a 20' easement on the hest side of Garfield's
property.
:'he 10" water line will be installed or. the rroperty of
S�Aperior Fast Freight extending from S.t.'. --h Street to S.N.
37th Street in a 201 easement on the Nest side of Superior's
property.
SJe feel that the installation ;:` these water lines provides
loops in the water system that will be of benefit to adjac-
ent property owners by improvin;, the fire `_ow requirements

To keep both of these prcjects on schedule we must install and

on Garfield Associates Ltd. property
Orillia Industrial Park
We have prepared plans for the subject water main on be-
half of Garfield. These plans have now been approved by
yo1r department. Within the next few days the 4ork
will be under contract. Superior Fast Freight 5 Garfield
presently intend to share in the cost of this main.
Bernard Armin, the Superior architect, tells me that
it would be possible to have this water main included
as a part of an L.I .D. covering a similar 10" line on
the Superior property. According to Carmin we would pro-
ceed as planned. However, after the 12" main is installed
the City w^uld reimburse the Garfield & Superior people
and then assess the cost back to theca and other benefitted
neighbors over a fifteen year term, interest would be
charged at 7.51. on the declining balance.
Assuming the above interpretation of the facts is correct
and that the 10 inch main on the Superior property isn't
going to add greatly to Garfields cost, I would say that
the L . I .D. approach would be of significant benefit to
Garfield. It would also seem a more equitable way to
divide the cost of the main si ,;:e neither Superior nor
Garfield need the 12 inch main to serve their needs . Rather,
it is needed to provide a better intertie for a more exten-
sive system.
1 have discussed the matter with the Garfield people. Their
present reaction is to support the L.I .D. proposal . How-

pier, they would like to be informed of the effect of the
10 inch main on the Superior property end any other items
which may be incladed before volctnq their final approval .

Dear Mr. Knopp:
This Is In response to your letter of February 22, 1979 requesting we out-
line the ordinances that require private water systems to be deeded over
to the City and provide you with the standards that Include on-site design.
We have attached herewith a copy of City of Renton Resolution No. 2164
which ba>ically spells out the requirements and phll-sophy for utility
extensions In Renton. Also attached Is a copy of the Rerton Subdivision
Ordinance which is used as a guideline and incivd-e the standards for
development In the City. Please note Section 9- 191 "Easements for
Utilities".
Reference is also made to the fire hydrant locations and fire flow
requirements required In the City of Renton by the Fire Code with which
Mr. Ron Combs Is Intimately fwIllar.
we have considered the water development plans for your Superior Fast
Freight development in Renton very carefully and feel that we have followed
the City of Renton ordinances and resolutions and policy In determining
our requirements. we feel that we have responded reasonably and the
acceptance of the water system and fire hydrant system by the City for con-
tlnued maintenance actually provides a benefit for the property owner.
in our discussion with Mr. Ron Combs and others on this date we suggested
that the financial Impact of these water line Installations could be
assisted In cash 'Iow requirements by the establishment of local Improve-
ment districts to finance and construct the water line Improvements. By
this means It would enable the costs to be shared by the bensfitting
properties and In this case properties still under tho ownership of
Burlington Northern to the west. TM suggested L.I.D. could spread the
capital cost over a 15-year period with interest rates at the rate of
approximately eS on the bonds. Our most recent I.I.D. bonds have gone
for as low as 7%. The suggested L.I.O. would Include the 12" line by the
Superior Fast Freights property and the Garfield property as well as the
10" line on the westerly side of Superior's property. This L.I.D. would
provide for an equitable cost sharing among the property owners and, as I
stated, spread the rep•.ment coats over up to 15 years.

The following are the requirements, per our meeting of February 13,
1979, for the installation of the fire protection service for the
aforementioned development.
The watermain shall be installed in sucb.. a manner that it can be
intertied and/or extended as an integral part of the Ovate: utility
system. Easements for the watermain shall he granted the City for
maintenance of said watermain.
Attached herewith is a copy of tht "Regulations and Standards for
Construction of Extensions to the City Water and Sanitary Sewer
Systems" as previously distributed t,i you. These regulations spell
out the drawing or plan requirements, such as drawing sire 22" x 34"
and drawing scales, which will be required for plan approval.
