(Our File 30419-U Dear Councilman Shane: This office represents Garfield Associates, Ltd., a Washington Limited Partnership, purchaser of property in the Burlington Northern Orillia Industrial Development. In the final development of the water system to serve the property, a water line will run in a nortlle-, ind southerly direction along the westerly line of the property, the property consisting of Tracts 4 and 9. When the plat was filet, there was way of knowing that the two tracts would no be developed as one tract, taus an easement was reserved for utilities across the southerly portion of Lot 9 and the northerly portion of Lot 4. Since the tracts were being developed as one tract, there is no need for the easement. Garfield Associates, Ltd., and a.-n Burlington Northern have made written requests to vacate the easement, and approval of the vacation has been approved by the Public Works Department. I understand that it has been sent to the Utilities Committee of which you are Chairman, for approval. While we understand that the spproval is essen*ially assured since the easements are clearly not necessary, yet it is of great importance that the vacation proceedings be completed so that a title report can be issued and construction financing obtained. Public Works Director Gonnason advises that the matter was not acted upon at the Utilities meeting held Monday night, March 12, 1979, and that there was no subsequent meetin;; of the Committee scheduled It would be greatly appreciated if we could get some idea of when the matter would be considered by the Utilities Committee, and also if such consideration could be .-xpedited. The project is a rather substantial one, totalling some $3,000,000.00 including all Land and building costs and will be of benefit to the City of Renton when completed.
