DESCRIPTION OF WORK The work to be performed under this Contract consists �E furnishing materials, equipment, tools, labxr, and other work or items incidental thereto (excepting any materials, equipment, utilities, or servile, if any, specified herein to be furnished by the City or others) and performing all work as required by the Contract in accordance with plans and specifications. 2. LOCATION • The location of the ' ork is shown on the Vicinity Map included with Part 4, PLANS, of these Contract Documents. 3. STANDARD SPECIFICATIONS Standard Specifications for Municipal Public Works Con- struction prepared by the Washington State Chapter, American Public Works Association, 1977, are hereinafter referred to as the Standard Specifications. Said spec- ifications are hereby included in these specifications as though quoted in their entirety and the applicable portions shall apply except as amended or modified by • these "Special Provisions." 4. GENERAL Wherever the words 'Performance Bond" are used, delete • the words and substitute "Performance and Payment Bond." 5. DISCREPANCIES AND OMISSIONS Any discrepancies or omissons found in the Contract Documents shall be reported to the Engineer immediately. The Engineer will clarify discrepancies or Omissions, • in writing, within a reasonable time. In resolving inconsistencies among two or more sections Of the Contract Documents, precedence shall be given in the following order: • Contract Special Provisions Plans Standard Specifications Figure dimensions on plans shall take precedence over • scale dimensions; detailed Plans shall take precedence Over general plans. SP-1 s b. BASIS OF AWARD The Owner will award the work to the Bidder which is in the best interest of the Owner. The award will tN> in accordanc, with bids submitted. 7. TIME (IF COMPLETION All work under this Contract shall be completed within ninety (90) calendar days after issuance of the notice to proceed. Further requirements regarding completion .ime and associated liquidated damages are indicated under Section 22 and Section 25. If the Contract is not completed within the above-fixed time or prior to a date to which the period of comple- tion may have been extended in writing, the owner will, in accordance with Section B-1.08 of the Standard Spec- ifications, deduct from amounts due to the Contractor liquidated damages in the amount of $150 per day. The above figures do not include costs for inspection, • supervision, legal expense, or court costs incurred beyond Contract completion date. The cost of additional inspection and supervision by City staff shall be an amount equal to actual salary cost plus one hundred (100) percent for overhead. The cost of consultant';; work shall be. as billed to the City. 8. HOURS OF WORK The working hours for the project will be limited to days during the period from 8:00 a.m, to 4:30 p.m. , unless otherwise approved by the owner. 9. O',ERTIME FIELD ENGINEERING When the Contractor performs construction work over the accepted eight (8) hours per day or forty (40) hour; per week, or on any City holiday, inspection, then the Contractorsha Lwork l reimburse requires City at the rate of $25.00 per hour. The Owner shall have the sole authority in determining the necessity of having the overtime inspection, and stall notify the Contractor of intent and said costs will be deducted for monies due the Contractor on ea.h monthly estimate. 10. SCHEDULING OF WORK Section: 8.01 of the Standard Specifications shall be deleted and the following inserted: SP-2 • Immediately aftej execution and delivery of the Contract and before the first partial payment is made, the Con- tractor :,hall deliver to the Engineer an estimated con- struction progress sche,j;ile in form satisfactory to the Engineer, showing the proposed dates of commencement and completion of each of the various items of work required under the Contract Documents and the anticipated amount of each monthly payment that will become due to the Contractor in accordance with the progress schedule. • The Contractor shall also furnish periodic itemized estimates of work done for the purpose of requesting partial payment thereon. The estimates furnished to the City will be used only for requesting partial pay- ments and will not be considered as fixing a basis for additions to or deductions from the Contract. • Should it become evidant at any time during construction that operations will or may fall behind the schedule of this first program, the Contractor shall, upon request, promptly submit revised schedules in the same form as previously accepted; setting out operations, methods, • and equipment, added labor forces or working shifts, night work, etc., by which time lost will be made up, and confer with the Engineer until an approved modifi- cation of the original schedule has been secured. Farther, if at any time any portion of the accepted schedule is found to conflict with the Contract provi- sions, it shall, upon request, be revised by the Con- tractor and the work shall be performed in compliance with the Contract provisions. Payments of any further estimates to the Contractor after such request is made and until an approved mod- ified schedule has been provided by the Centractor may be withheld. Execution of the work according to th< accepted schedule of construction, or approved modifi- cations thereof, is hereby made an obligation cf the Contract. • 11. WAGE SCHEDULE The prevailing rate of wages to be paid to all workmen, laborers, or mechanics employed in the performance of any part of this Contract shall he in accordance with the provisions of Chapter 3s1.12 RCW, as amended. The • rules and regulations of the Depart-ent. of Labor and Industries and the schedule of prevailing wage rates for the locality or localities where this Contract will be performed as determined by the Industrial Statistician of the Department of Labor and Industries are by reference made a past of this Contract as though fully set forth • herein. SP-3 s Y Inasmuch as the Contractor will be held responsible for paying the prevailing wages, it is imperative that all Contractors familiarize themselves with the r_urrent wage rates before submitting oids based in these specifications. The Contractor, on or before the date of commencement •of work, shall file a statement under oath with the Owner and with the Director of I r and Industries certifying the rate of sourly way. ,aid and to be paid each classification of laborers, workmen, or mechanics employed upon the work by the Contractor or subcontractor Y which shall be not less than the prevailing rate of wage. Such statement and any supplemental statements which may be necessary shall be filed ir; accordanco with the practices and Procedures by the Department of Labor and Industries. • Prior to commencing work, each Contractor and each and every subcontractor shall file a sworn Statement of Intent (SF 9882) with the Owner and with the Department of Labor and Industries as to the prevailing wage rate, including fringe benefits, for each joh classification to be utilized. DISPUTES AND LITiGAT ION a Any questions arising between the Engineer and the Con- tractor or his superintendent or foreman as to the mean- ing and intent of any part of the plans and Specifications or any Contract Document shall be immediately brought to the attention of the Public Works 0.rector cr his representative for interpretation and adjustment, if warranted. Failure on the part of the Public Works Director or his representative to discover and condemn cr reject improper, defective, or inferior work or materials shall not be construed as an acceptance of any such work or materials, or the part of the improvement in which the same may have been used. 'ro prevent disputes and litigation, it is further agreed , by the parties hereto that the Public Works Director or his representative shall determine the quantity and quality of the several kinds of work embraced in these improvements. He shall decide all questions relative to the execution of the work and the interpr- ation of the Pl-ns and Speci'ications. In the event the Contractor is of the opinion he will. be damaged by such interpretation, he shall , within three (3) days, notify the Engineer and the City Clerk In writing of the anticipated nature and amount of the damage or damages. Use a suitable chemical clean- • ing method to remove grease, oil, wax, and dirt from the surface. Scrape or wire brush carefully to rcmovc deteriorated or loosely adhering previous coatings. Rusted areas shall be prepared in accord- • ance with Steel Structures Painting Council Surface Preparation Specification SP-2 or SP-3, Nand or Power Tool Cleaning. Paint manufacturer 's represertative will determine the acceptability of the surface for his materials prior to application of primer in conjunction wit. `.he Office of the Engineer. APPLICATION OF PRIMER. The 'iniversal" Primer shall be applied to all SP-2 or SP-3 prepared areas, slightly overlapping the adjacent sound �xi.sting paint.
