Warren, City Attorney Re: Water Line Break on Renton Municipal Airport Dear Louie: You forwarded to me various documents concerning the water line break on the Municipal Airport. I was not able to determine the exact party upon whom I believe liability would fall. I do not believe I have complete information at this time. However, a cursory review of the documentation would point to the installer of the pipe as being the responsible party. If they were supposed to use one type of pipe and instead used another, and that change contributed to the water ne break, then the installer is clearly liable. The City ::may still sue the developer, or make claim agairs. him even though a substantial period of time has run, if the improperly used material could not be discove-ed through reasonable care by the City. Clearly, if the pipe was buried, the only chance the City would have to discover would be through inspection. The law is clear that the City does not have a dLty that is owed to a oevelorer or contractor in inspections, but owes the duty to the general public to see that the installation was done correctly. Therefore. I would suggest that if the break was caused by the use of improper material -, that we file a claim and if necessary a lawsuit, against the installer of the pipe. If the break is for other reasons, then the City should determine the exact cause and reason for the break and thereafter assess possibilities of placing liability on some other party. Lawrence J. Box 964 Renton, WA 98055 Attention: Mr. Sigi Ullrich Dear Sigi: An analysis of the City of Renton'a water system has been performed for the purpose of determining the water ripply available for fighting a fire midway between S. Fifth Street and S. Sixth Street on Smithers Avenge S. In accordance with Insurance gervices Office criteria, the analysis simulates the water system experiencing n maximum day water demand with the single largest source of supply (Well 8) out of service. Additionally, Wells 1, 2, d, the Windsor Hills and Mt. Olivet pump stations are operating. The altitude valve at the Mt. Olivet reservoir is closed. Finally, interties with the Cities of Kent and Tukwila are not included in the analysis. Knowing that the fire flow requirement for your proposed buildings is approximately 2000 Spin, it was immediately recognised that the existing 4 inch pipe on Fmithers Avenue S. from S. Fifth Street to S. Sixth Street had insufficient capacity to meet the fire flow requirement. en 8 inch diameter pipe was used in the comput, r model to replace the 4 inch diameter pipe on Smithers Avenue between Fifth and Sixth. Further, the north ;art of the 4 inch diameter pipe on Williams Avenue S. between Sixth and Seventh was replaced with an 8 inch diameter pipe so that t1:e 8 inch diameter pipe near the 28 unit apartment buildings on Williams Avenue was extended to the intersection of Sixth and Willi me. Results or the analysis with these improvements indicate that approximaGly 2420 gallons per minute (gps) are available while maintaining a residual pressure of 20 pounds per square inch (psi) in the water mains. This flow rate has been calculated midway between Fifth and Sixth and not at the present hydrant locations. Since hydrants (in the area) are older style two port hydrants, the City Fire Department will require placement of two new hvdrants supplied by a 6 inch or larger pipeline to obtain the required tin flow. The Fire Department should be consulted to determine an acceptable location for the hydrants.
