One of which is a I" water service line and the other a 1 1/210. The I" line services two houses at 4135 N.E. 15th St. off meter #115972 and 1536 N.E. 15th St. off meter #12779837. The residence addressed 4135 N.E. 15th St. belongs to P!r. G. C. Adams who originally wrote and complained of low water pressure. The property covered by the temporary service agreements includes 1560 and 1566 Vashon Ave. N.E. which are served by the 1 I/2" line together with two other houses. All four of these tomes have adequate quantity and water pressure. It has been determined that at the present time it is not necessary to install a new waterline ;n Northeast 15th St. Therefore, the City will take no action forcing installation of a new water line by the developer of the last house addressed 1566 Vashon Ave. N.E. At the time the agreement was entered into, the property was known as 10806 132nd Avenue S.E. I have reviewed the file on this matter with Mr. Gonnason, the Public Works Director, and find that the City's approach and activity on this problem have been appropriate and more than fair in view of the time that has passed since Mr, Adams brought this matter to the attention of the City. This was approximately two years ago, and the City has proceeded in a fair and deliberate fashion in an attempt to get you to carry out the agreement entered into in 1967. A copy of this letter is being sent to the City Attorney; however, iz is hoped that you can make the necessary arrancements for construction of this water main without requiring the City to resort to legal action or to discontinue your water service. Mr. Gonnason is willing to meet with you and/or Mr. Mattison to assist in any way he can to resolve the problems involved in the water main installation. Mr, Gonnason advised me that there is a possibility that this water main installation could be financed by a local improvement district if there are no other suitable financing mechanisms available. Renton, Washington 98655 Your Honor, The Mayor, Having been a City of Renton employee for 13 years in the Police Dept. , I am no longer working there, I am coming to you with a problem that we have been having with the Public Works Department, namely Mr. Gonnason and Ron Olson. In 1965 we built a house at 1560 Vashon Ave. N.E. A building permit was obtained with no problems regarding the water service into the area. We signed a piece Not All Res;de"CO3- of paper that stated when another lotlwe owned needed a larger main because of low pressure we would install one. This was not a contract and at the time did not feel we were making a lifetime commitment, it was only a piece of paper. At the time we built there were 3 existing hoses al -serviced by the same water line. We put in our own line, allowing for the additional line at the time that lot was built on. In ;short there would only be two people on our water line. Since then a Mr. Adams complained to the city he was losing water pressure. He felt that it was due to the new house being built. We h, sold the lot to our daughter and they were building on it. As my rough diagram shows, they did not hook their water meter up to the right line. At the time the meter was put in they were told it. was wrong, but they didn't see fit to change it. We asked several times they change this. The attorney handling the initial selling of this property was Roger Lewis, who cannot offer any advice as it would be conflict of interest, his being the Municipal Court, Judge. The man who had originally installed the water line, who is still working for the city, knows there are two separate mains. The city was at fault in several areas, No. 1 in not recording what they had originally installed, and not hooking up to the right meter when they were told it was wrong. Engineers we have hired have shown there are two existing lines. Mr. Gonnason has decided in his most exalted ruler of the public works department that nothing will suffice except our spending $4000 to correct this situation which is in fact, the city's error in the first place. Attached is letters written to us more or less threatening we do something. Ron Olson is also of the opinion that we are to take responsibility. Our only fault was not signing that note and putting a date on it, it would certainly not have meant a lifetime. In putting in a 4" water main to our meter will not help the other people as they are hooked up to another line. They needed to heok it up to 1560 Vashon Ave.NE. which the diagram shows. My ex-husband has tried to talk to the City regarding this, namely Ron Olson and Gonnason, and they feel like little Gods and there is no recourse other than for us to make this large expenditure which we feel was the city's error in the first place. THEY JUST WOULD NOT LISTEN TO US THEY WERE HOOKING UP TO THE WRONG LINE. My eA-I-nsband, Carl Mattison, also has just had surgery and will be unable to work for 2 months. This has placed a big burden, mentally and physically on him. Oui property is still pending with our divorce, so I am still very much concerned 'about this also, plus I do not want him stuck with this large bill . As per the last letter from Mr. Gonnason he has given us 10 days till legal action is taken. I do not feel this is the way for city tax payers to be challenged when they are not at fault. Your checking into this situation and informing us of your findings would be appreciated. I am sure though they will try to make this difficult for us, (they being Mr. Gonnason and Mr. Olson) . This is not the first dispute Mr. Gonnason has had with city residents. Our putting in a new line will Not help Mr. Adams, the only help he can get is it they rehook the line to ours, running to 1560 Vashon Ave. N.E. Mr. Adams does not want this to go further and would like the matter dropped. We feel fourteen weeks is adequate time to make arrangements to install a larger water main and/or to notify the City of your intent to do so. Since we have not heard from you concerning this matter, I regret I must exercise the City's right to deny you further water service. This letter is to serve as official notice that if we do not hear from }au in the next ten days in terms of positive action towards the replacement of the water line we will shut off the water to the two parcels of propert±* covered by the agreement. With regard to the two (2) water. IInes, City crews have been on the utility ease- ment site within NE 15th St. , looking for said 2nd line, and have not been able to find 4. Mattison Water Main Agreement Dear Mr. Gonnason: I refer to your letter dated June 5, 1979 to Mr. Carlyle E. Mattison, in which you indicate that in accordance with a Water Main Agreement dated February 3, 1967, you give Mr. Mattison official notice to begin installation of a 4" water main. Mr. Mattison has approached my office and indicated to me that apparently the reason for a demand of the 4" main has arisen is due to the fact that there have been some complaints by water users, namely, Jerry Adams, that pressure is not sufficient on that line that runs along northeast 15th Street. Please be advised that Mr. Adams is not even on the Mattison line, but there is a line directly to the south of the Mattison line that services Mr. Adams' property. Please be advised that all users on the line, that is the subject matter of the Water Main Agreement have no problems with water pressure, and it would appear inequitable, at this time, to require Mr. Mattison to put in a 4" main in light of the fact that all users on that line are quite satisfied with its pressure. I am sending you this letter to inform you of Mr. Mattison' s feelings and perhaps put this matter to rest as it would appear that if. As a result of numerous complaints about the low water pressure caused by the inade- quate size of the 1 1/4" water line; the City must now activate the aforementioned agreement, calling for the replacement of the existing pipe with a 4 inch water main. Enclosed are copies of two (2) agreements; one covering your property also known as TL IS2 Sec. 3-23-5 and the 2nd agreement encumbering the property adjacent to yours on the north also known as TL 163 Sec. 3-23-5. Though the 2nd agreement was origi- nally executed by Wm. S. Hassen (Peterson-Hassen Const. , Inc.) , the agreement is actually a covenant imposed upon the property. Therefore, the performance of said agreement is the responsibility of the present owner of record. It is the iptent of this letter to serve you, with official notice, to begin the installation of the new 4" water main in NE 15th Street from Union Ave. NE easterly for an approximate distance of 237 feet, within 30 days.
