It will be your responsibility to establish Lie grade to which we will set our facilities. We will not raise or lower the primary or transformer due to terracing or any other cause without a charge. You will also be respon- sible for running all service conductors to our padmounted transformer. We will make the connections on our equipment. Upon receipt of the signature of the Director of Public Works for the City of Renton, which constitutes acceptance of our design, we will release this job to be scheduled for construction, subject to an easement. Warren, City Attornev Re: Easement for Underground Electric System - Puget Power Dear Ron I have reviewed the easement for underground electric system as provided to me. My first inquiry is why we are going to sign this document in the first place. Before we are going to give Puget Power or anvone an easement, it has to benefit the City. Even if we do want to give the easement, we should be very sure that paragraph 4 can be met. That paragraph requires no digging, tunneling or other form of construction activity on the property which could disturb the compaction or unearth grantee's facilities on the right of way. We must be sure that that is not going to create a problem for us in the future. Outside of these comments, the easement appears to be in appropriate legal form. Lawrence .1. Install a 6 foot chain link fence at top of slope as shown on Exhibit "C. x 27. The Grantee shall be responsible for the continuous maintenance of the slopes on their side of the fence. x 28. Slope shall not exceed 2:1 on State right-of-way. From top of slope to top of slope shall be a minimum of 10 feet wide, the surface and vegetation steal' not be disturbed. x 29. State maintenance forces shall be allowed access t0 Slopes maintained by the Grantee. A 30. In the event any milepost, right-of-way marker, fence or guard rail is located within the limits of this project and will be disturbed during operations, these items will be carefully removed prior to operations and reset or replaced at the conclusion of operations to the satisfaction of the State. All signs and traffic control devices must be maintained to operation during operations. x 31. All slopes must be mulched, fertilized, seeded and orotected from erosion until vegetation is re-established. x 32. Wherever deemed necessary by the District Administrator and/or the Department of Labor and Industries, for the protection of the highwav pavement and the safety of the workers, the sides of the trench or excavation shall be supported by adequate lagging or cribbing to prevent am damage uy tracts, settlement, etc. to the pavement. No other work in the trench or excavation area will be allowed until this requirement is meet. x 33. In lieu of a surety bond to ensure compliance with the terms and conditions of this permit the City of Renton agrees that the State may effect reimbursement of the amount necessary to restore the highway from the monthly fuel tax allotments which the City of Renton is normally entitled to receive from the Motor Vehicle Fund, and in accordance with RCW 47.08.090.
