tion and until such time as the utilities and appurtena.ces have been accepted
for the operation and maintenance by .the Grantee but not later than

Said heretofore mentioned grantee, its successors or assigns, shall Q>
have the right, without prior notice or proceeding at law, at such titres as
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any leoal
obligations or liability therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility shall be
accomplished in such a manner that the prfvate improvements existing in the right
right(s)-of-way shall not be disturbed or damaged, or in the event they are
disturbed or damaged, they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.
O The Grantor shall fully use and enjoy the aforedescribed premises ,
lam- including the right to retain the right to use the surface of said right-of-way
if such use does not interfere with installation and maintenance of the utility
line. However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.
This easement. shall be a covenant running with the land and shall be 1•ind-
ing on the Grantor, his successors , heirs and as< igns. Grantors covenant that
they are the lawful uwners of the above properties and that they have a good and
lawful right to execute 4is agreement.

Gentlemen:
It has come to our attention in the review of our old open files that there
are some legal documents that have still not been completed fur the above-
referenced project. Every major utility extension, both water and sewer,
must be properly transferred to the City of Renton for ownership, operation
and maintenance.
In order to properly transfer ownership to the City of Renton, both a Bill
of Sale and Easement form are required. We are in receipt of the waterline
easement, but not the Bill of Sale. Also, the water plan must be as-built
and stamped by a certified engineer `flat the drawing reflects the as-built
condition of the installation.
As owner of the subject property, it is your responsibility to have these
documents prepared. A blank form is enclosed for your use, together with a
plan of your waterline and fire hydrant installation. It is suggested that
you contact your engineer to aid you in preparing these documents.
The installation of your fire hydrants was a requirement to meet your fire
flows by the City of Renton Fire Department. We have been trying to get
this paperwork taken care of since the completion of your facility here in
Renton in 1980.
Your earliest attention to this matter would be gratefully appreciated. If
you have any questions, please call the number listed above.

Dear Mr. Curran:
This letter is in regards to the request for Condominium conversion of the
Misty Cove Apartments.
The Misty Cove apartment building located at 5021 Lake Washington Blvd. was
built in 1968, as a group H occupancy, construction type V-1 hour in Fire
Zone 3. It is a three story building with a basement housing 52 rental
units.
Attached is a copy of an inspection conducted of December 19, 1979, out-
lining those-item that the Fire Department will require to be corrected
prior to conversion to condominiums. The rwst important of which is
included under the Fire Protection section (2) of the inspection sheet.
These apartments were constructed prior to the City Council passing an
ordinance adopting the Unif:) m Fire code and setting Tnaximan distances to
fire hydrants.
At present, out Water Eingineer advises us that the fire flow available
at the nearest hydrant can be no more than 1,000 gallons per minute.
The fire flow required for this building based,on our pre-fire information
indicates that 6,000 CR1 is required.
Cur Water Engineering Divis*.an advises that construction of the 16 inch
water main along Meadow Ave. No, conbianed with the new 12 inch main
crossing under Hwy 405 at North 28th will increase available fire flow to
approximately 3500 gallons per minute.
Based upon this infonmtion and the fact that conversion to condominiums
would change sipieantly the nature of the ownership to this occupancy
and the definition of responsibility for future fire code enforcement,
the Fire Department reccumends that the approval for conversion be granted
oily when the following conditions are met:

(2) Installation of 3 :rydrants on mains the size approved by
Water Engineering adequate to provide fire flow and located
along access drive on South side of building.
(3) Correction of all itnrs listed on Ccaxkminium Cxiversion
Inspection sheet.
The Fire Departamt will be Vaopy to work with the representatives of
the Misty Cove in planing these chanties.
