We have enclosed our check in the amount of $6,869.01 and pay this under protest.
We have no objection to paying our reasonable share of late comer's charges when we 1
have some benefit. In this case, we derive no benefit from the hydrant on the w :y
property at Superior Fast Freight, because it is located on the other side of the
main tracks of the Burlington Northern Railway. There is no way we can depend on ,. 5. .
having the use of that hydrant during an emergency.
Furthermore, we have installer: a horizontal standpipe under our new warehouse, and e,
this has three twin hydrant connections coning off it: one each at the North and
South end of our building and one in the middle. This makes the hydrant across
the tracks superflbus in addition to being inacceiible. Had that hydrant been
"cesable to us, you would not have insisted that we go the additional expense of
installing our own standpipe and hydrant connections in the first Place.
We agree to pay our pro-rat11 charge for hook-up and the line loop which benefits
all of us, but you have never broken out all the separate costs on this so we can
analyze them. We have even agreed to put up - bond subject to final agreement, but
this too, you refused, as of this writing.
It appears yov are discriminating against Brady international wherc:.,s our neighbor
to the South, Service Paper, advises he received his permanent occupancy certificate
even though he abstained frola paying any late comer charge on this issue.
Under the circumstances, as we are s,heduled to begin moving into our new warehouse
tomorrow, you have left us no choice. We therefore pay this charge under protest.

Sometime back, Brady International was required to
pay the city of Renton $6,869.01 for a waterline to supply
water is the event of a fire. I have been contacted by
Mr. ^ E. Korry, Jr. , presi'ent of Brady International Hard-
woods, and he wants an itemization of the figure. Further-
more, he also requests the figure that he would be able to
charge whatever subsequent business would have to pay should
they construct north of Mr. Kerry's property. I would appre-
ciate your prompt attention to this matter.

In analyzing these figures we discovered a IGO foot error had been made on the
total number of assessable footage in Superior Fast Freight's favor as developer.
As a result, Brady International and Service Paper Overpaid their fair share of
the cost of the waterline in the following amounts:
Parcel B - Brady International - Amount Collected .n Error $6,869.01
Corrected LCAG Felt -6,631.85
Refund Due $ :31.16
Parcel C - Service Paper - Amount Collected in Error $7,437.94

Tne developer will be notified immedfatcly and the above refunds will be forwarded
to you when we receive same from .Superior Fasc Freight.
The _jst of the 8" water line installed between Brady International and Service
Paper (marked in blue on map .nd plan) was shared between the two companies by
mutual agreement.
Please inform Mr. Kerry, Jr. that he has the right to attach the 8" waterline on
the north side of his property with a latecomer agreement (marked in pink on map
at . plan). When Parcel A develops, he would be reimbureed for approximately one-
half of the cost of that portion of pipe. In order to initiate a latecomer agree-
ment, the developer must write a letter of request to the Mayor and City Council.
I have enclosed a typical form letter for this request, outlining the information
we need to process the agreement.
In reviewing the Brady International file, apparently some of this information
had balm provided by Mr. Kerry, but never submitted to Council through proper
channels. I have enclosed copies of the legal description for Parcel "B" and the
cost data for the B" water line on the north side of the Brady International prop-
erty.

Dear Gary:
In response to your letter of July 6, 1982 regarding itemization of the $6,869.31
figure paid by Brady International, I have put together the following explanation.
Renton City Council granted Superior Fast Freight a latecomer agreement for the
10" waterline installed along tl,e west line of their property. The installation
of the 10" line benefited the three abutting properties on the west by providing
enough water through a looped system to meet required fire flow demands. The
three parcels are shown on the attached vicinity map and marked "A", property
to the north, "B", Brady International and "C", Service Paper. The pro-rata
share of the cost of the waterline installed by Superior Fast Freight breaks
down as follows:

Gentlemen:
In May of 1981 the City of Renton collected certai- reimtursement fees
on your behalf under the terms of your latecomer agreement. We recently
have discovered an error In calculation, which resulted in an over-charge
to the Brady International and Service Paper properties. A 100-foot error
was made on the total number of assessable footage, which 1n turn changed
the cost per front foot figure. The cost figures are as follows:
