have the right, without prior notice or proceeding at law, at such times as
may be necessary to enter upon said above described property for the purpose
of cor eructing, maintaining, repair'.ng, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
obligations or liability therefore, provided, that such construction, main-
taining, repairing, altering or reconstruction of such utility shall be
accomplished In such a manner that the private irprovements existing to the right
rlght(s)-of-way shall not be disturbed or damaged, or in the event they are
disturbed or damaged, they will be replaced in as good a condition as they were
immediately before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises,
including the right to retain the right to use the surface of said right-of-way
;are if such use does not interfere with installation and maintenance of the utility
line, However, the grantor shall not erect buildings or structures over, under
or across the right-of-way during the existence of such utility.

water line location, I've generated the following legal description of the proposed
eas"gent for Puget Power that's shown on the drawing attached.
An easement on and under that portion of the BPA Right-of-Way that is 7> ft.

Gentlemen:
In 1968 Transamerica Development Co's Parcel f40 was developed and a private
waterline system was installed to serve the r'hunderhills Apartments.
Since then the waterline has been located, and certified as-built drawings
have been made by Mr. Michell H. Yuhl, P.E. The Thunderhills waterline
has been turned over to the City via a Bill-Of-Sale from Plaza Pacific
Equities.
It is the purpose of this letter to request an easement from your company
covering that portion of the waterline that lies outside the Thunderhills
property. The legal description for the easement has beer[ prepared by
Mr. Yuhl and enclosed herewith together with his recent as-built waterline
plan. Please prepare the easement in favor of the City of Renton, and
forward same to me for recording.
I have also enclosed a plan of Water Project W-246 which shows the original
plan as was approv..d by Puget Western in conjunction with their transactions
with Transamerica Development Company.

installed in 1968. This main was just recently turned over to

Dear Ron:
I have reviewed the agreement as presented to me.
Typically, Puget Power has written an agreement that is so over-
whelmingly one-sided that I recommend rejection of the agreement
unless it is absolutely necessary for the City to obtain this
easement. Throughout the document is scattered references to
requirements of Puget, which Puget shall reasonably deen necessary,
at the discretion of Puget, etc . What this means , is that we
will be at the whim of Pugec Power i ,. a number of instances .
You should also be aware that the document provides that we give
Puget at least six months prior notice to any scheduled construction
activity under this easement and that we give thirty days advance
written notice if we intend to do any repair or maintenance
activities. Those are very long time lines.
I also find it objectionable that under paragraph 10, Puget is
going to try and charge the City for inspectors for work being
done on laying a simple water pipeline. This would be like writing
a blank check.
Also, paragraph 11 starts off without a full sentence, but if I
read the paragraph as it was intended, I believe it states that
the City is obligating itself to potential further relocation of
lines , or expense.
Finally, Puget, through paragraph 16, Peeks %o protect itself from
its own acts and omissions that affects City's employees or contractors .
That paragraph also appears to be over-reaching.

This memo is in rp ,ards to reliability of water supplies in the
area of Thunder HITI Apartments, 1099 Eiher Road.
As you are aware, the water main servicing those building units
on Thunder Hill Lane is a 6" dead end main and has 4 fire hydrants
located for their fire protection.
The new construction in the area, warrants improvement to the main
reliability. Based on the information available I would recor :end
looping C e present private 6" main on Thunder Hill Lane to the
proposed ater system for the apartment complex to the south.
Accomplishing this would be beneficial to both developments since
it would in effect provide secondary feeder capabilities to both
systems.
The I.S.O. grading schedule recommends that the use of 6" dead-end
mains should be avoided and that secondary feeders installed as
required to meet fire flow requirements in all built-up parts of
the city, such that simultaneous fires may be controlled. Addit-
ionally the 14th edition of the Fire Protection Handbook, section
11-E, states the reason for this practice assu-es that a break in
a feeder main will not completely cut off supply.
I would stron^ly recommend that tieing the existing 6" dead-end
main to the development to the south Abitare Apartments" and
the granting of the 15 foot easement for maintenance be ,igorously
pursued. Attached you will find a copy of correspondence sent
on July 31 , 1979 to the manager of Thunder Hill Apartments
regarding this matter.

It has recently come to our attention that the 6" water main and 4 fire
hydrants serving your apartment complex has never been looped o an addi-
tional supply main for fire protection as was required at .he time of
development. This connection to additional supply main was to be done
at a future date when a main was available. With the development of the
Abitare Apartments adjacent to Thunder Hill Apartments, th's additional
-)ply main is available.
-his time, the City of Re"ton is requiring that this inter-tie be made.
The only way that this inter-tie can be mdde at the present time is to
turn the existing waterlain and hydrants over to the City of Renton for
maintenance. This will also require the granting of a 15 foot easement
over said watermain and the installation of individual meters to each
building.
Attached herewith is a Copy of a memo from the Fire Department to me,
with their requirements and recolrmendations, with regards to the above
mentioned inter-tie or secondary supply main connections.
Your earliest attention to the above requirement for orantinq of the
easement and bill of sale transfering the existing water main to the Ci-y,
would be appreciated.

WHEREAS it is advisable to provide and establish definite
guidelines and standards concerning the installation of utility lines

WHEREAS the City does hereby set forth such apprapriate
guidelines for the benefit of the various departments of the City
NOW THEREFORE.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTONaAS FOLLOWS:
SEECTION I: The following standards and guidelines are
hereby astabl _ahed and shall be generally adhered to by the various

City departments in dealing with and considering the installation of
utility lines within thq City,
A. All Utilities within the City of Renton will be
extended in a manner in and along, routes which comply
with the comprehensive plans of the City of Renton.
B. If no such comprehensive plan exists, then the t'
utilities will be extended and installed in .a manner
as to best serve the citizens of the City of Renton
C. It is realized and acknowledged by the City Conncil
that the selected route or routes may not necessarily be
the shortest or most inexpensive route for the installation
of such utilities but will hest serve the City over an
extendei period of time,
D. If the route an established by this Resolution
significantly more expensive thar, other potential routes
then the City will study such rc tes and if it is
determined that said routes are for the general benefit
of the City, but significantly more expensive for the
abutting 'andowners or others sharing in the expense of
the installation of the utilities, the City may participate
in the payment of the installation of such uti'ities as
long as the system is within the City limits.
SECTION II: These standards and guidelines shall be and
remain in full force and effect until modified or amended by the City
Council.

2. Write the easement tc include the right to repair and maintain the water
line as shown together with the 5 ft. either side of the line as it now lays.
This will handle the problem of the nebulous location of the water line between
data points, especially the 2" and 3" water lines that service the 401, 402, 406
and 407 buildings as this location was taken from the as-built drawing.
3. Write the easement to permit access to the easement along the driveways
and walkways. Reason: To permit easy access for meter reading and maintenance.

Dear Ron:
In accordance with your earlier request, I've prepared an 81�,X 14 map and description
of the proposed water line easemert on the above subject projert.
This is submitted for your review and approval and use in preparing and securing the
ded%cation of this easer•nt from the property owners.
The location of the water line was determined from dig-ups, location of fire hydrant
tees, pipe finder, location information and, where no other data was available, the
location of the water line on the "as-built" drawing you loaned me. I located these
points and tied them into an earlier traverse that I had rut between the East and Westl
quarter corners.
The easement center line is the center line of the water line as found by the above
methods. I 've included an easement for a future water line to the south (G - G£)
through the driveway as you requested earlier.
I wrote the easement for the service lines to be from the as-built location of the
water meter or hydrant on the most direct route (at right angles) to the main. The
easement was written to end 5 ft. further than the meter or hydrant a apt where a
building is located. In '_hose cases, the easement center line was written to go to
the building wall .
As you requested earlier, I'm now preparing a 1"=40' mylar of the as-builts and the
easement location on a 24"06" sheet for the City's permanent records. (I'll also
include the Washington North zone coordinates of these points that I used in calcu-
lating the easement.)
I'd suggest that you incorporate the following thoughts into the preparation of the
easement:

1. Write the easement to exclude_ any area V,at .mav be within the buildings
shown. In some cases, the end of the easement is at an angle with the building so
that a portion of the 10' width would be in the building. In several other cases,
,the edge of the easement encroaches on the building.
