However, I see three problems with the Declaration of Restrictive Covenants : 1. In the fourth line of the actual covenant itself is a ' reference, at the very end of the sentence, to the existing grade of the property. That reference is improper as it would prohibit any structure above the existing grade of the entire parcel of property, when I think the reference must be to the 15 foot setback property. 2 . At the same point in , the restrictive covenant it would be wise to include the examiner's language, "including but not limited to decks, patios and rear stairways. " 3 . Finally,, at ' the same spot it would be advisable to include the hearing examiner's language, "any stairway shall reach grade outside of the 15 foot setback. A hand written amendment to Staff recommendation for the rear yard setback was provided to me in the hearing chambers on October 9, 1990. This amendment changed the recommendation from approval to denial. This late change did not allow sufficient time for me to prepare rebuttal statements and produce data for the hearing,including amendments to the requests. I feel that Renton Planning Staff did not give me the same consideration in preparing the Staff Report and presentation as is given to other variance applicants. This was very obvious on the date of the hearing for my variance applications. The Staff representative in the hearing ahead of mine had obviously worked closely with the applicant and offered no surprises to the applicant during the hearing. The Staff member presenting my application to you ,Mary Sevala,had not once contacted me since I filed the applications in early April 1990. Her words were essentially,"don't call me, I'll call you." I also wish to amend my variance application and eliminate the request for the zero side yard setback on the north property line. I agree that it is not in the best interests of me,my neighbor,or the City of Renton. A summary of my variance request follows: Original Examiners Revised Applicant/ Request Report Request Examiners Agreement Front Yard 5 feet 5 feet 5 feet Applicant agrees with Examiners report for acceptance. Side Yard 5 feet 0 feet 0 feet Applicant agrees with Examiner and withdraws request. �I Rear Yard 15 feet 20 feet 15 feet Applicant requests Examiners reconsideration. c - After consulting with a professional planner,Mr.Robert W.Thorpe, the issues of the rear yard, shoreline variance seem to boil down to fairness and determination of hardship. A copy of Mr.Thorpe's analysis is attached. I hope that the following discussions and analysis will persuade you to grant the 15 feet rear yard setback as requested. I believe that it is also important to consider each variance request separately and not treat them as a total package. Let's first address the hardship issue. As we all have certainly agreed in the referenced documents, the lot being discussed is small,of irregular shape,bounded on.the west and east by the lake shoreline and road easement,and has a large area under water. This lot also is very narrow,being 35 feet in width while most other lots in the area are at least 45 feet in width. These limitations and hardships are not self-created, but have been in existence since before the property was annexed in 1959. The house is a remodeled beach cabin,parts of which are 75 years old,and has reached the practical limit for remodeling and improving. The buildable area of the portion of the lot which is not underwater is 2465 square feet without accounting for setbacks. Setbacks as outlined in the reference b)report would reduce the buildable area to 944 square feet or 38 % of the buildable area. Approving the rear yard setback to 15 feet as requested would increase the buildable area to 1071 square feet or 43% of the buildable area. Strict enforcement of the setback requirements would interfere with reasonable utilization of the property. An error appears in the Hearing Examiner's Report on page 3 item 16. Both of Burdick's lots are 69 to 72 feet deep by 45 feet wide, not 45 feet deep. (I have personally inspected the Burdick properties and the bulkhead does not have the jog in it as indicated in his drawing.) I believe that the prospective portrayed by this transposition in numbers is significant. The Burdick case very closely parallels my situation. Also item 16 mentions that one of Burdick's variances was denied. Yes it was,but his request was for 14 feet and he was granted 15 feet. A summary of the Burdick decisions follows: 3709 Lk.Wash. Blvd.N- ask for and received 15 feet rear yard setback. - ask for and received 2 feet front yard setback. 3711 Lk.Wash. Blvd. N. - ask for 14 feet and received 15 feet rear yard setback. - ask for 2 feet and received 5 feet front yard setback A little history on Mr. Burdick may also be of interest and contribute to the fairness issue. Mr. Burdick purchased a 90 feet wide lot on which a single family residence existed,with the intent of removing the existing house and dividing the lot into two parcels on which two houses would be built. Through the variance process he was granted rear yard variances allowing 15 feet rather than 20 feet setback for both lots. As a point of reference,the area of my lot is only 79% of either of Burdick's lots to begin with. The variances issued to Mr. Burdick allowed for utilization of 59 % of the buildable area at 3709, which is a lot of approximately 3105 square feet and 55 % at 3711, which is also a lot of approximately 3105 square feet in area. My amended request(without the zero side yard setback)is to build on 43%of a considerably smaller lot of 2465 square feet in area. Existing utilization of the property including carport and raised deck is 57%. My immediate neighbor to the north,has a rear yard,shoreline setback of 10 feet,and a review of the photographs submitted with the variance application shows that a majority of houses in the area have less than 15 feet setback. I will continue to work with my neighbors and keep them informed of my building plans during the design so that any problems and conflicts can be avoided. Denial of my variance of 15 feet is totally inconsistent with rulings made on the Burdick cases. Why is granting my variance precedent setting,when his was not? Denial of the variance for rear yard setback of 15 feet definitely does not permit me the utilization of land and denies privileges enjoyed by a majority of neighbors. Please accept this as my formal request for reconsideration. If your response is delayed beyond November 5, 1990,please authorize an extension for an appeal submittal to allow me time for preparation. The following are my findings and an analysis of all of the four required showings under Section 31 of the Renton Code. These are confined only to the rear yard setback recommendation. Initially, let me say based on my own experience of five years of reviewing and recommending on variances as a planning supervisor at the City of Mercer Island and my familiarity with variance procedures at the City of Renton as well as other variances that our staff has done, that your application has substantial merit on the rear yard setback issue. My feeling is that the application had all the various points j and findings that were necessary; however, some clarification and additional bringing out of the significant amount of information that you supplied to the examiner, may assist in his re-evaluation. Further, I believe that the original staff report recommending approval with a change on a handwritten note given to you at the Staff Hearing probably should have resulted in a continuation at that time and given you ample time to respond. I trust the examiner will see the fairness in your request for reconsideration and an opportunity to clarify some points that you did not have any opportunity prior to the Hearing. The following findings (all of which are required), appear to be in order. A. Hardship - We believe that this hardship exists because of the special circumstances of the size of the property including shape, topography, and location, and that the adjacent property owners had their houses extended waterside beyond that of the request. Further we believe that the hardship is not of applicant's making. In addition, under the Shorelines Management Act, an averaging of frontage on adjacent properties for bulkheads and structures is allowed. As one looks at the site plan of the two adjacent properties, your 15-0 request effect, would be an averaging between the structures on the north and south (see Site Plan Exhibit). Further, we believe that this hardship and extension to other property owners, was set forth in a precedence of the two Burdick variances. These two variances, along with several others cited by Mr. Deeds in the area, show several precedences, and the allowance of this type of mitigation for site hardship on a majority of the properties in the area. Further, review of the photographs shows that numerous buildings throughout the area not only have houses in the rear yard setback, but that they have decks, guardrails and fences that extend to the waterline. Guardrails and fences are considered structures and should be at the shoreline setback. Thus, the denial of this variance would make Mr. Deed's property truly an anomaly in terms when compared to most of the properties in the area. B . "The granting would not be materially detrimental to the public welfare." We believe this finding can be demonstrated by the fact that the two adjacent property owners have indicated no objection and in fact, have supported the applicant's request. It is my understanding that no other property owners have objected to this. From my own education and experience in M.A.I. classes (real estate appraisal), it would appear that there would not be an adverse economic impact or degradation in values of the adjacent properties, nor would there be any adverse environmental impact on these properties. "Approval will not constitute the granting of special privilege inconsistent with the limitations of the properties in the vicinity and zone" - see findings in ' B - see also: photographs and see site plan that shows two adjacent properties already have this rear yard development patterns. D. "That the application is the minimum variance that will accomplish the desired purpose." I have advised Mr. Deeds to discuss this matter with staff and his adjacent property owners to insure that there may not be some minor alteration of the fifteen foot rear yard setback, for design purposes, to create the best design and have a minimal impact. This would likely be minor in nature, a foot or two in terms of this variance, or an averaging between his neighbors in order to accomplish the desired purpose. In summary we feel that Mr. Deeds has prepared an extensive record on his property and that he is asking for a variance to expand his house similar to others. In the Burdick case, a single site was taken, the house was removed and two additional I houses were placed on the property and variances granted for both houses. Here, Mr. Deeds is proposing to utilize his property similar to every other one in the area. His request is only to be able to upgrade an aging house and make it compatible with the surrounding uses both for enjoyment and value. Denial of this request would mean that he would not be able to enjoy the views and the interior space similar to the other property owners. We believe there is precedence for this request and that all impacts can be mitigated so that there are no significant impacts attached to this request. We also feel there is a clear showing on all four points. We trust this gives you some additional insight. We would encourage you to work ' with staff and neighbors to see if there are any modifications or conditions that might be attached to the fifteen foot rear yard setback that may clarify this matter before the Hearing Examiner. PLANNING DIVISION REPORT: The Planning Division Report was received by the Examiner on October 2, 1990 PUBLIC HEARING: After reviewing the Planning Division Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: MINUTES The hearing was opened on October 9, 1990 at 10:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Vicinity Map Exhibit #3 - Map showing existing homes in the area. II Exhibit #4 - Map showing proposed setbacks. The hearing opened with a presentation of the staff report by MARY SAVELA. Assistant Planner. it Her review comments follow. The applicants wishes to build a new home on this site to replace the current older residence. The it requested reduced setbacks were felt to be necessary to accomplish the completed design. Mr. and Mrs. Deeds wish to reduce the rear yard setback from 20 ft. to 15 ft., the side yard from 5 ft. to 0 ft., and the front yard setback from 20 ft. to 5 ft. There were three letters from adjacent neighbors submitted I,I at the hearing, two from neighbor Mr. John. In his second letter Mr. John expressed opposition to the requested 0 ft. side yard setback along his common property line. Ms. SAVELA noted the property is located in the Kennydale area, is located along Lake Washington Blvd., the lot is very narrow with a building footage of 2,465 sq. ft., with the remainder of the lot under Lake Washington. This request is subject to special provisions of the Shoreline Master Program for Renton. In reviewing criteria for a variance SAVELA addressed the three variance requests separately. The front yard variance is on the easterly side of the property facing the easement road which provides access to the property. It must be determined if the variance is necessary due to special circumstances applicable to the property that would cause undue hardship to the applicant should he wish to develop the property in generally the same manner as other properties in the area. The lot is narrow, ,I irregularly shaped, with the shoreline and a railroad right-of-way making it difficult to develop. Staff feels there are special circumstances that make consideration-of this front yard setback from 20 ft. to 5 j ft. necessary. It is felt the front yard variance will not be detrimental to public welfare as other front Jay W. and Elizabeth A. Deeds V-055-90 October 23, 1990 Page 2 yards in the area have been reduced. This request (front yard setback) would not be considered a special privilege granted to the applicant. The variance for a side yard setback from 5 ft. to 0 ft. was reviewed. SAVELA said staff believes reducing the side yard setback to 0 ft. will not be necessary to build a reasonable home on this site. It is felt the granting of a 0 ft. side yard setback would be injurious to the property to the north due to possible fire hazards and interference with that property's light and air. She said it is felt the 0 ft. variance would be granting a special privilege not enjoyed by other property owners in the area, and is not a pattern the city would want to continue (even though there may be some currently in the area). Staff does not recommend the Examiner approve the 0 ft. side yard request. Regarding the rear yard request from 20 ft. to 15 ft., staff feels the existing house on the site currently respects the 20 ft. setback, and a reduced rear yard from Lake Washington is not necessary to accomplish the building of a newer residence. SAVELA said staff feels, if approved, the shoreline request would be a special privilege to this applicant that is not enjoyed by neighboring sites. Based on information available, Ms. Savela said staff recommends the request for reduced rear and side yard setbacks be denied and approval for the front yard setback from 20 ft. to 5 ft. be granted. The applicant, JAY DEEDS, 3607 Lake Washington Blvd. North, Renton 98056 responded stating he and his wife moved into this seventy-five year old residence approximately 10 years ago. He said they have completed as much remodeling as is practical on such an old house, and now desire to build a new residence on the site. He said the square footage for building is consistent with other sites in the neighborhood; agrees with the recommendation to reduce the front setback to 5 ft.; feels the requested 15 ft. rear yard setback from the shoreline is consistent with what has been approved in the neighborhood in the past (3709 and 3711 Lake Washington North have been approved); he said nearly all the homes in the area have rear yard setbacks of less than 15 ft.; does not agree his requests would create a hardship for surrounding neighbors because the home is a remodeled beach cabin and is not, by today's standards, as large as most homes that are being constructed. He said he feels the hardship is a result of the lot size, dimensions, and location, and requested the 15 ft. setback be approved. Referring to the 0 ft. side yard setback, MR. DEEDS said the request is consistent with present utilization. He said in 1988 a variance was approved permitting the 0 ft. side yard setback for the existing carport and wall along the northern property line. Deeds said there will be no difference in light and air between what is currently on his property and what they are requesting, and prior to rebuilding the carport the old carport was of the same dimension and size and was in place for over thirty years. He referred to two variances approved in 1987 (properties north of his) which have a 0 ft. setback for building carports. It was clarified that this request for 0 ft. side yard setback is for the house, not a carport, and the Examiner questioned how Mr. Deeds would maintain the northern property line without trespassing. Mr. Deeds responded he would have to obtain permission from his neighbors. The Examiner pointed out that the second letter received this date from that neighbor expressed objection to the 0 ft. setback request. DEEDS also said all of the lots in the neighborhood, excepting his, are a minimum of 40 ft. wide. His lot is 36 ft. wide, parking in the area is a premium, , and by allowing additional width on the house and going to a 0 ft. setback it would allow him to put in a two-car garage and keep their vehicles off the street, which he believes is much more aesthetic for the neighborhood and provides more security for him. He requested this 0 ft. lot line setback on the north side be approved. Expressing support for the complete proposal was a neighbor JAMES DENZER, 3613 Lake Washington Blvd. North, Renton 98056. The Examiner pointed out that the shoreline portion of this application will be a recommendation to the State Department of Ecology, who will make the final determination on that portion of this application. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 11:15 A.M. FINDINGS, CONCLUSIONS & DECISION: j Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Jay W. and Elizabeth A. Deeds, filed a request for approval of two variances from the setback provisions of the Zoning Code and for one variance from the provisions of the Shoreline Master Program 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. • Jay W. and Elizabeth A. Deeds V-055-90 October 23, 1990 E' Page 3I 3. The Environmental Review Committee (ERC), the City's responsible official, determined that the proposal is exempt from an environmental assessment. ti 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located at 3607 Lake Washington Boulevard North. The site is located on the shore of Lake Washington approximately 600 feet north of Kennydale Beach Park. 6. The subject site was initially annexed to the city with the adoption of Ordinance 1791 enacted in September, 1959, as amended by Ordinances 1800 and 1804 enacted in October and December 1959, respectively. 7. The site is zoned R-1 (Single Family; Lot size - 7,200 sq ft). 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses, but does not mandate such development without consideration of other policies of the Plan. 9. The parcel is shaped like a parallelogram. The north and south property lines run almost rl directly east to west. The west and east property lines angle from the southwest to the northeast - constrained by the shoreline on the west and the road and railroad right-of-way on the east. 10. Being a shoreline lot the majority of the lot is submerged below the waters of Lake Washington. The upland or buildable portion of the lot is approximately 2,465 square feet in area. This small lot area does support an existing single family home located on the subject site. 11. The Shoreline Master Program requires a 20 foot setback from the shores of Lake Washington. The existing home sits back the required 20 feet, thereby observing the required setback. A deck attached to the home observes a setback that varies from 6 feet to more than 13 feet. 12. The Zoning Code requires a 20 foot front yard and a 5 foot minimum side yard. The existing house is constructed along the normal east/west-north/south axis and, therefore, sits off-angle on the lot. This configuration creates uneven setbacks. The front yard setback varies from approximately 5 feet to approximately 14.5 feet. The side yards vary from approximately 2.5 feet to approximately a half foot, where a bay-type projection extends from the house on the south side, to approximately 10 feet excluding the attached carport. The variance approved by the Board of Public Works permitted a carport with a zero (0) setback on the north side. While the carport does observe a zero (0) foot setback it is angled low, and its height near the property line probably does not exceed 7 to 8 feet. 13. The applicant proposes erecting a new house on the site that would reflect the parallelogram 'I shape of the parcel. The lines of the new home would more or less be parallel to the property lines, although there would be some articulations that would create a stepped setback. The proposed second floor would overhang the first floor along the front yard and be stepped in along the north sideyard. 14. The neighbor to the north, the owner of the property adjacent to the proposed zero setback, objected to the setback if it would affect the property and if a setback is required. This reversed an earlier endorsement of the proposal prepared by the applicant. 15. An easement roadway approximately 15 feet wide serves the subject site and other homes along the waterfront in this area. The setbacks vary ranging from almost a zero setback for some ;j garages to approximately 4 to 5 feet of setback. A number of homes have setbacks of 2 to 3 feet. tit 16. The applicant referenced the Burdick variances. The Shoreline variances produced mixed, although limited relief. One variance was denied. The one that was approved was for a lot that; was only 45 feet deep, whereas the applicant's lot is between 60 and 64 feet deep. The variances to reduce front yard setback were approved. CONCLUSIONS 1. The nature of the variances requires separate considerations of each one individually. Two of ;I the variances are from provisions of the Zoning Code, while the third variance is from provisions of the Shoreline Master Program. While similar, the criteria for review for Zoning Code variances is different than the criteria used to review variances from the Shoreline Master Program. • • Jay W. and Elizabeth A: Deeds til it V-055-90 October 23, 1990 Page 4 2. The following criteria are applicable to both the variance from front yard setback requirements 11 and the variance from side yard setback requirements. Variances may be granted when the property satisfies all the conditions described in part below: ;j a. The applicant suffers undue hardship caused by special circumstances such as: the size, li shape, topography, or location where code enforcement would deprive the owner of rights and privileges enjoyed by others similarly situated; b. The granting of the variance would not materially harm either the public welfare or �! other property in the vicinity; c. The approval will not constitute a special privilege inconsistent with the limitations on 1 other property in the vicinity; and d. The variance is the minimum variance necessary to allow reasonable development of the subject site. Front Yard Variance ill 3. The applicant's property appears ripe for the variance requested. The limited upland area of this Lake Washington lot, coupled with the variance relief afforded other property owners along the narrow access road, demonstrates that the front yard variance should be granted. The lot's limited size (uplands) of approximately 2,465 feet, and its irregular parallelogram shape, would deprive the owner of rights granted to others along this street. 4. Granting a variance to reduce the front yard to five feet is reasonable given the nature of the 1 development along this stretch of Lake Washington Boulevard. One can approach the subject site in two ways. The lot was platted in an arbitrarily small fashion, and as such, the hardship pi was self-created by the applicant or his predecessor in interest, and deserves little consideration. On the other hand, it seems equitable to ignore to some extent the self-created hardship and grant the variance to permit the applicant to utilize the site in a fashion similar to the use enjoyed by others in the immediate vicinity. The site is undersized and is not shaped like the i ordinary rectangular lots elsewhere in the city. 5. The approval should not materially affect adjacent properties since they are similarly aligned along the frontage. Setbacks vary from almost zero to closer to standard, but many approach the five foot setback requested by the applicant. The clearance provided elsewhere along the easement already permits the maneuvering of emergency vehicles. The requested variance would not additionally hamper passage. 6. Since other properties along the frontage have similar setbacks, the approval of the variance will it not grant the applicant a special privilege inconsistent with rights conferred elsewhere under similar circumstances. 1 7. Reviewing this variance is not done in a vacuum. The proposed front yard variance is balanced against the other requested variances, the side yard and rear yard/shoreline variances to allow a reasonable redevelopment. In that balance, the front yard setback appears reasonable. As explained below, the other variances are not justified in this balancing scheme. Side Yard Variance 8. This variance must be denied. While it obviously meets some of the criteria demonstrated for the front yard variance (the lot is still obviously small and irregularly shaped) it fails in two important respects. It infringes on the rights and property interests of the adjacent homeowner. It also is not beneficial to the public welfare in maintaining reasonable setbacks and distances j between property for light and air. 9. First, the neighboring property owner has objected. But even if the objection had not been !, registered, the public welfare is not preserved by imposing zero setbacks between existing properties. It is not as if these adjacent properties had been initially designed with a zero setback where design skills could have been employed to counter the loss of light and air. The zero setback is being imposed on an existing house which was not designed to be nestled so close to its neighbor. The proposed sidewall will be approximately 35 to 40 feet long and at least one story high. This is not a carport. 10. Its obvious that with a zero setback the only way the applicant would be able to maintain the exterior wall would be to intrude on the northerly lot's privacy. While it may be infrequent, there is no justification to allow such an intrusion. It is also the neighboring property which will be left to stare at this wall. III Jay W. and Elizabeth A—. V-055-90 October 23, 1990 Page 5 11. The prior variance was granted by the Board of Adjustment for a carport. The Board was dealing with existing construction, and existing constraints may have dictated the results. This office will not second guess the Board of Adjustment since preexisting development may have precluded locating off-street parking in any other fashion. That is not the case any longer. There are no preexisting conditions on locating the parking. This will be new construction. When that variance was granted the existing development may have justified a zero setback, but' with a new design there can be absolutely no justification for intruding on the neighboring property as now proposed. 12. The applicant indicated that a reasonable home could be constructed on the lot, but that it might have to be three stories. Since variance relief is only available when reasonable alternatives don't exist, the exceptional relief sought must be denied. Shoreline Variance for a Rear Yard I' 13. The criteria for a Shoreline Variance generally parallel those for ordinary variances, and the same conclusions are applicable to the uniqueness of the size and shape of the parcel. The conclusions must diverge in the area of material hardship. Again, while there is no question that the lot is small and irregularly shaped, a variance from the Shoreline Master Program is not justified. The existing house, exclusive of the deck, observes the required setback. The approval of the front yard variance already provides more than enough relief to allow reasonable development on the subject site. Finally, the request if approved, would create an inappropriate precedent where similar requests have been either denied or strictly limited. 14. As stated in the previous conclusion, a balancing of the front yard variance against encroachment along the shoreline yields approval of the front yard request, but does not necessitate a precedent setting shoreline variance. The constraints on this lot were, or should have been evident when it was purchased. It is inappropriate to squeeze too large a home on j such an undersized lot. While it is reasonable on occasion to waive some setback requirements (in this case the front yard setback) waiving others creates a poor precedent permitting overdevelopment or inappropriate development. That is one reason the side yard variance is inappropriate, and similar logic guides review of the variance sought from the Shoreline Master Program. 15. There is no pressing need to extend any precedent as the city attempts to enforce its shoreline regulations. If the setback standards are to mean anything they must be observed and not waived unless there is a compelling reason to do so. As staff noted, there is no compelling reason. Reasonable development can occur on this site without variance relief. It's just that the , applicant has chosen a design that requires a variance, not that other methods would not permit reasonable development. Since a reasonable home can be constructed with the frontage variance approved without further encroaching on the shoreline and the neighboring property, this variance is unnecessary. 16. Finally, since similar requests have been denied it would be inappropriate to grant this request. DECISION 1. The Front Yard Variance is approved. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, Including size, shape, topography, location, or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification. The buildable area of the applicants' lot is ap proximately pproximately 2,465 square feet in size with the remainder of the lot being under water. The lot Is long and narrow and the buildable area is almost a parallelogram in shape. Although the buildable area is constrained by the location of an easement roadway and a railroad right-of-way along the eastern property fI line, the site accommodates an existing single-family house that does respect the twenty I' (20) foot setback from Lake Washington established in the Shoreline Master Program. The size and shape of this lot constitute special circumstances that make a variance necessary however for both side yard and front yards under the City's Zoning Code. b. That the granting of the front yard variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated. The granting of the variance will not be detrimental to the public welfare or Injurious to the it property or improvements in the vicinity. Front yard setbacks in the area vary from almost zero to the required twenty feet. Several homes in the area have setbacks of from two to ten feet. Currently, emergency vehicles are able to maneuver along Lake Washington Blvd. North even though several properties In the vicinity have reduced front yard setbacks. c. The approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties In the vicinity and zone in which the subject property is situated. The approval of a reduced front yard variance will not constitute a grant of special privilege which is inconsistent with the manner in which nearby properties have been developed. As noted above, several homes in the vicinity have similar front yard setbacks. The applicants submitted photographs showing other properties with comparable front yard 'l setbacks. d. That the approval, as determined by the Hearing Examiner, is a minimum variance that will accomplish the desired purpose. . The approval of this front yard variance would appear to be the minimum that will accomplish the desired purpose, particularly if the Shoreline Master Program setback from the lake is respected. SIDE YARD VARIANCE 5. As noted in (4) above, in considering a variance,the Hearing Examiner is asked to consider the following conditions and find that they exist: a. That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of the rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: As noted above,the subject lot is small, narrow, and of an irregular shape, however, these conditions will be substantially relieved by the recommended granting of reduced front yard setback. The present house located on the subject property received a variance (V- 538-88) in 1988 to allow a zero side yard on the north side of the property, but the applicants' intention is to remove the existing house and construct a new house. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: The granting of this side yard variance would be materially detrimental to the public welfare (fire hazard) and injurious to the property in the vicinity, especially the adjoining property to the north (fire hazard,deprivation of light and air). c. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone In which the subject property is situated: .1 Approval of this side yard variance would be a grant of special privilegernot commonly enjoyed by other property owners in the vicinity. Many of the lots in the area are'narrow and the houses are close together, but zero side yards are unusual. The fact that zero side yards occasionally were allowed in the past Is not a reason to allow new construction to follow this pattern. Most homes in the vicinity were built under King County standards before the area was annexed into the City of Renton. As these older homes are replaced, City of Renton regulations should be followed whenever reasonable. d. That the approval as determined by the Hearing Examineris a minimum variance that will accomplish the desired purpose: .1 Approval of the zero side yard variance is not necessary to allow construction of a new house on the subject property. The recommended approval of the variance for the front yard setback would, in staff's opinion, provide the applicants with a reasonable building area without the detrimental effects on neighboring properties that the zero side yard setback would cause. SHORELINES VARIANCE 6. The applicants also seek approval of a variance from the required 20 foot setback from Lake Washington in the City Shoreline Master Program. The State of Washington, in the legislation for Shorelines Management (RCW 90.58) establishes the criteria with which to review variance applications which affect state shorelines. The City of Renton Shoreline Master Program, in Section Eight, reflects the criteria established by the State. These criteria are as follows: a. That the strict application of the bulk, dimensional or performance standards set Ili forth in the applicable master program precludes or significantly interferes with a reasonable use of the property not otherwise prohibited by the master program: The City of Renton's Shoreline Master Program requires that all residential structures be set back a minimum of twenty (20)feet from the shoreline. The existing house on the site currently respects this setback. In this case, with the granting of the front yard setback to five (5) feet, staff do not believe that the strict enforcement of the setback requirement would interfere with the reasonable use of the property. Therefore, staff do not support this setback if the front yard setback Is granted. • b. That the hardship described in WAC 173-14-150 (2) (a)above is specifically related to the property, and is the result of unique conditions such as irregular lot shape, size, or natural features and the application of the master program, and not, for example, from deed restrictions or the applicant's own actions: Since an existing house on the site does meet the prescribed shoreline setback, it would appear that hardship, in this case, is a result of the applicant's own actions. c. Whether the proposed use is consistent with the Comprehensive Plan? The proposed use is consistent with the Comprehensive Plan Map which designates the subject site for single-family residential use. It also generally is consistent with the Goals and Policies for single-family residential use as stated in the Comprehensive Plan. 2. Whether the proposed use is consistent with the'Land Use Map and the applicable zoning ordinances? The proposed single-family residence is allowed outright in the R-1 zone in which the subject property is located. The proposed single-family development does not meet two setback provisions of the Renton Zoning Code, Section 4-31-5 (C) (4), nor does it meet the setback requirement from Lake Washington as stated in the Shorelines Master Program, Section 4.07.02 (D) and Section 7.14.01 (B). An exemption and a variance are sought from the Shorelines Master Program and two variances from the Zoning Code. Variances are sought from the Zoning Code to reduce the front yard setback from twenty (20) feet to five (feet) and to reduce one sideyard setback from five (5) feet to zero feet. A variance is sought from the Shorelines Master Plan to reduce the rear yard setback from twenty (20) feet (minimum setback from Lake Washington) to fifteen (15) feet. r. The Hearing Examiner has the authority to grant variances, provided that the following conditions are met: City Code 4-31-19(F)(3): The Hearing Examiner....shall have authority to grant a variance upon making a determination in writing that the conditions specified below have been found to exist: 1) That the applicant suffers undue hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification: Variance• (a): ,request to reduce the back yard (Lake Washington frontage) setback from twenty (20) to fifteen (15) feet: The applicant does suffer undue hardship and there are special circumstances that would justify granting this variance. The lot is of an unusual shape, being nearly a parallelogram and smaller than average even in this lake front residential area which has many small lots. The buildable area of the lot is approximately 2,465 square feet. The houses on either side of the subject site are setback approximately fifteen (15) feet from the lake front. Variance (b): request to reduce the front yard setback from twenty (20) to five (5) feet. The applicant does suffer undue hardship and there are special circumstance as stated in Variance (a) above. However, a five (5) foot setback does not seem adequate from the road easement. Averaging the setbacks of the houses on each side of the Deeds property (not including carports) it is found that the average setback from the road is fifteen (15) feet. Staff recommend that the new Deeds residence be required to be setback fifteen (15) feet also. • Variance (c): request to reduce the side yard setback on the north side of the property from five (5) feet to zero setback. Staff recommend that this request be 'denied.'The special circumstances described in Variance (a) above do not justify a zero setback. The fire danger of construction on a lot line is severe. 2) That the granting of the variance will not be materially detrimental to the public•welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated: Technical Advisory Commit itaff Report ' Deeds Shoreline Exemption.and Variances July 13, 1990 Page 3 The granting of variances (a) and (b), as modified by staff recommendations, will not be materially detrimental to the public welfare or injurious to the property in the'vicinity, however, granting of variance (c) would be materially detrimental to the public welfare because of the fire hazard involved. 3) That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated: The granting of variances (a) and (b), as modified by staff recommendation, would not constitute a grant of special privilege since they are consistent with existing uses in the immediate vicinity. However, the granting of variance (c) would be a grant of special privilege and a fire hazard. It is true that the existing Deeds carport wall is on the lot line, but when new residences are constructed, they should conform to all regulations unless sound grounds for a variance can be shown. 4) That the approval as determined by the Hearing Examiner is a minimum variance that will accomplish the desired purpose: The granting of the three variances is the minimum action that would accomplish the desired purpose. However, the granting of variances (a) and (b), as modified by the staff recommendations, and the denial of'•variance (c) would allow the applicant to construct a house that would reasonably fulfill his needs without being detrimental to nearby residents. What condition of the subject property (i.e. , size, shape, topography, location or surroundings) NOT CREATED BY THE OWNER OR APPLICANT which have created the hardship and are the basis for granting a variance? The buildable area of the lot is approximately 2465 square feet. The remainder of the property is underwater. This lot is one of the narrowest in the neighborhood, as most lots are 40 feet or more in width. The buildable area is nearly a parallelogram of this shape and dimensions: 64' Lake Washington 35' 36' N 60' The buildable area is limited by Lake Washington on the west, and a roadway easement on the east. See Attachment 1 for lot details and existing construction. 2. How is the hardship a result of the application of the requirements of the Shoreline Act and Master Program? The Shoreline Act and Master Program does not accommodate lots having small , irregular shaped buildable areas, with the major portion of the lot under water. A house of reasonable size and proportion will not fit on this lot without variances to setback requirements. The proposed house has 862 square feet of living space and 400 square feet of garage on the first floor. The second floor has 936 square feet for a total of 1798 square feet of living space. See Attachment 2 for proposed construction. Compliance with the Shorelines Act and Master Program would not allow for the construction of this modest sized house. The existing house was built on the lot with zero to 2.5 feet side setbacks prior to annexation by the City of Renton and adoption of the Shoreline Act and Master Program. The setback requirement as required by the Shoreline Management Program does not allow for reasonable use of the property. This request is consistent with present construction. 4. Is the development proposed for the subject property similar to other developments which presently exist in the immediate area (and within the same shoreline environment designation), and if so, in what respect is it similar? In what respect (if any) does it differ? Give specific illustrations if possible. The proposed construction is consistent with existing conditions and utilization of the property. See Attachment 1 which shows present utilization of the lot. The carport north wall is currently on the north property line and the house is setback from 0.5 to 2.5 feet on the southern property line. The carport was erected in November 1988 following approval of variance V-538- 88 on October 26, 1988. As the carport has two enclosed sides, (the house to the south and the wall to the north) it is considered to be a garage. The north wall was constructed as a fire wall per variance requirements. The neighbor to the north has a deck attached to the house which has less than one foot setback from the common property line. See Attachment 3 for current side yard conditions. Two other variances for carport walls on side property lines have been issued to home owners in the neighborhood. The proposed construction does not create an adverse effect to adjacent neighbors. The footprint of the proposed construction is less than the existing house, carport and elevated deck. The proposed construction goes beyond preservation, it will enhance the public welfare and interests. The new construction will be built per code and therefore be safer, it will be more energy efficient, and certainly will be more pleasing to the eye. The closeness to the northern neighbor will remain the same on the first level but will be setback to the required five feet on the second level , see Attachment 2 for proposed construction.
