ORDINANCE NO. 5883
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ESTABLISHING A
MORATORIUM ON ACCEPTING APPLICATIONS FOR RESIDENTIAL
DEVELOPMENT IN THE FORM OF TOWNHOUSES WITHIN THE CA (COMMERCIAL
ARTERIAL) ZONE, SETTING FORTH FINDINGS OF FACT IN SUPPORT OF SAID
MORATORIUM, PROVIDING FOR SEVERABILITY, DECLARING AN EMERGENCY
AND ESTABLISHING AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, the City is engaged in the process of reviewing Municipal Code zoning use
provisions and development standards applicable to townhouse development; and
WHEREAS, the primary purpose of the CA (Commercial Arterial) zone is to provide "a
wide variety of retail sales, services, and other commercial activities along high -volume traffic
corridors" and secondarily to allow "residential uses [to be] integrated into the zone though
mixed -use buildings;" and
WHEREAS, the standards for residential development in the CA zone can facilitate
development where the predominate use, notably at ground level, is multifamily housing,
especially when applied to large lots; and
WHEREAS, the development of CA zoned property with predominately residential uses
can result in a significant loss of opportunity for employment growth, local shopping and
services, and space for new or expanding businesses, and can result in the creation of mixed -
use projects that lack the City's desired balance between commercial and residential uses; and
WHEREAS, the process of reviewing Municipal Code use provisions and development
standards requires public discussions of potential regulations and standards; and
WHEREAS, establishing a moratorium on townhouse development in the CA zone
affords the public and City Council opportunities to advance potential regulations and

standards without being preceded by a vested application for residential development under
current Municipal Code zoning use provisions and development standards; and
WHEREAS, under state law, the City has the authority to establish moratoria on
accepting applications for development; and
WHEREAS, the City Council has determined that there is a need for a moratorium on
accepting applications for residential development in the form of townhouses within the CA
(Commercial Arterial) zone; and
WHEREAS, the City Council will hold a public hearing within sixty (60) days of the
passage of this ordinance;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION I. The above recitals as findings are found to be true and correct in all
respects and are hereby adopted as findings of fact in support of the moratorium adopted
herein pursuant to RCW 35A.63.220.
SECTION II. The City Council hereby declares and imposes a moratorium upon the
submission, acceptance, processing, or approval of any applications for townhouse
development upon CA (Commercial Arterial) zoned property with a depth greater than one
hundred feet (100').
SECTION III. The moratorium imposed herein shall be in effect until December 3,
2018, unless subsequently extended by the City Council pursuant to state law.
SECTION IV. A public hearing will be held on July 9, 2018, within sixty (60) days of the
passage of this ordinance, pursuant to RCW 35A.63.220.

SECTION V. If any section, subsection, sentence, clause, phrase or work of this
ordinance should be held to be invalid or unconstitutional by a court or competent jurisdiction,
such invalidity or unconstitutionality thereof shall not affect the constitutionality of any other
section, subsection, sentence, clause, phrase or word of this ordinance.
SECTION VI. The City Council declares an emergency for the protection of the public
welfare and to enable the purpose and intent of this ordinance to be accomplished. This
ordinance shall take effect immediately when approved by the City Council. Publication may be
by summary publication of the ordinance title.
