explain it.
The proposal for the building and its planned entry/exit points also proves to be an issue. The location
that Valvoline is proposing using as a point of entry/exit is on private property.The street is owned and
maintained by the residents of Parc @ Whitman Court and even if Valvoline did have the right to use it,
the HOA reserves the rights to charge maintain ace and repair costs proportional to the amount of use.
Because the proposed exit to non-private property will only allow vehicles to exit onto NE 4th street
heading east, there would need to be some other way for vehicles to exit to the west on NE 4th street.
Worth noting that none of the 3 traffic signals immediately to the east of the NE 4th entrance allow for a
U-turn (nor do they have room for a vehicle to safely make a U-turn).
The residents are not at this point willing to allow for a business to use of private property.
Somewhat unrelated to this is a current issue we're having with just this with the Post Office on NE 4th
Street. They were granted an easement for use of the private road in which they consume
approximately 90-95% of all vehicle traffic. Now headed to court because they're not willing to honor
their obligation to the wear and tear they've created on the pavement which has a current expected
repair cost of $18,000.
