This approval is separate and distinct from your building permit application status. The City of Renton Hearing Examiner initially approved the above-referenced conditional use permit on July 18, 1991 . Although this approval is normally valid for two years, pursuant to Section 4-31-33 of the Renton Municipal Code, the Hearing Examiner is empowered to grant a one year extension of the conditional use permit. An extension request must be submitted to and approved by the Hearing Examiner prior to the expiration of the initial two-year approval period. Approval of an extension would allow you additional time to resubmit a new building permit application without going back through the environmental review/conditional use permit process again. PO Box 220 Seattle WA 98111 Re: Chevron Facility 301 South Grady Way Dear Mr. Johnson: This letter is in response to a conversation you had with Michael Aippersbach, one of our project consultants regarding your facility at the above location. This letter addresses two specific areas) touched upon in your conversation with Michael Aippersbach: (1) status of the review of your, submitted Site Remediation Plan and (2) the processing of the two remaining underground storage, tanks (USTs) not covered in the City's Determination of Non Significance - Mitigated issued on April 10, 1991. 1. Status of the City's review of the submitted Soil Remediation Plan (dated January 28,, 1992). We have preliminarily reviewed the site's Soil Remediation Plan and have the), following comment: a. Need Additional Copies. We will need three additional copies of the Site Remediation Plan for review by other City sections. Our files only show the receipt of one copy by the Fire Department which they have turned over to us for review. I The three additional copies can be included with the submittal materials and application fee required under item 2 of this letter since no further review will take place until these items are received. b. Presence of Contaminated Soils/Groundwater. Both the Plan and the earlier reports, (the Environmental Site Assessment report/October 14, 1991 and the Sitel, Assessment During Heating Oil Tank Removal report/October 14, 1991) disclose the presence of contamination of both the soils and the groundwater at the above site. c. Number of Tanks to be Removed. Page 1 of the Plan notes four existing USTs located in the motor fuel tank field being replaced by three tanks. Page 2 notes, there are six tanks, four in the motor fuel tank field and two located near the rear of the station. We will need you to clarify as to the tanks proposed to be removed and, those (if any) which would remain: The sizes of the tanks (in gallons) proposed for, removal and the sizes of the tanks being replaced will also need to be specified!, NOTE: We have noted that one 550 gallon heating oil tank has already been, removed. d. Haul Routes. No mention of any haul routes to be used to import or export materials to/from the site has been made. All hauling of materials must comply with the, 200 Mill Avenue South - Renton, Washington 98055 Timothy Johnson Chevron Facility May 8, 1992 Page 2 City's Truck Route Ordinance # 4328. Haul Routes must be approved in advance by the City's Transportation Systems Division for any material moving off/on the site. e. Lead Contaminated Soils. No mention is made of how lead contaminated soils (page 5 of Plan) will be handled during remediation. We assume they will be separated from other contaminated soils and be removed by hauling off site. f. On-Site Remediation. The proposed Plan leaves open the possibility of the use of on-site remediation (page 10). Techniques mentioned for on-site treatment are aeration/landfarming and soil venting. There is no discussion of type of equipment) to be used (heavy equipment, blowers, etc.); anticipated periods of time it will take to bring contamination levels down to acceptable levels; hours of operation of any, equipment; measures to reduce noise levels; location of stacks (vent flues), where on the site stockpiling would take place; etc. The City will require this information to evaluate the Remediation Plan. Also, please note aeration is generally not considered by DOE or the City to be an acceptable remediation technique in "urban" areas such as your site. g. Other Permits. The Plan contains references to DOE standards, but does not mention any other possible permits being required. Soil venting, if used, requires aI permit from the Puget_Sound Air Pollution Control Agency (PSAPCA). METROI requires a permit for any discharges (accidental or intentional) into the storm system.I And lastly, the City's Fire Prevention Bureau requires obtaining an Underground Storage Tank Removal/Fill Permit prior to removing any tanks. NOTE: Fire Prevention Bureau staff from the City of Renton are required to be present during any UST removal and witness any subsequent soil sampling. Therefore, you should call and schedule this event with them. 2. Changes to Original Proposal for the Site. The existing DNS-M (issued on April 10, 1991) covered the station remodel and the removal and replacement of three 12,000 underground storage gallon tanks. The DNS-M did not cover the removal of two 550 gallon tanks (used [waste] oil and heating oil) and their replacement with two additional 1,000 gallon underground storage tanks nor the substitution of a 15,000 gallon tank for a 12,000 gallon tank mentioned in a letter to the, City (Don Erickson) from Robert E. Lee & Associates (Steven Freech) and dated Februarys 20, 1992. To include the above changes in the original scope of work, a revised Environmental Checklist would need to be submitted to the City for review and processing since the', comment period for the DNS-M has expired. Prior to conducting any excavation work on the site relating to site cleanup/remediation, the, following must be submitted for review and approval by the Development Services Division of the City: a. Environmental Checklist. Since the original Environmental Checklist did not included any disclosure about the underground storage tanks (it scope was limited to the station remodel), I suggest you include the removal and replacement of all the USTsI and remediation plans. Since the Soil Remediation Plan is deficient in some areas, you may want to include revisions to the Remediation Plan in a project narrative which we can then attach to the Plan. If you intend on using the project narrative to supplement the Soil Remediation Plan, you will need to include the following kinds of information: a. project schedule/timetable; haul route and hours to be conducted; name of disposal site; days per week and hours of operation for site remediation; areas for stockpiling on the site (contaminated and non-contaminated soils); measures for dust control, etc. c. Application fee. You must provide an application fee in the amount of $500.00 for the City to begin processing. If the City determines that more staff time will be needed to complete the review of the application than is covered by the application fee, you will be asked to sign an agreement promising to pay additional money at 'I the rate of $75 per hour as provided for in City Ordinance No. 4322. The applicant shall, In order to mitigate aesthetic Impacts of the project, submit an amended i landscaping plan. This plan shall provide for landscape planting beds (minimum five feet in width) along the east and west property boundaries,a minimum of four foot wide planter along the south property line and an enhanced landscaping plan along S. Grady Way with a sidewalk. This plan shall be submitted to the satisfaction of.the Development Planning Section and the Transportation Systems Division prior to the public hearing by the Hearing Examiner. Natural Environment 2. The applicant shall provide an agreement ensuring that: a) complete soils testing will be conducted in accordance with the City of Renton and the State Department of Ecology standards; b)_if during construction of these facilities contaminated soils are found, all construction will cease . immediately; c) within one.week of discovering the contaminated soils, the applicant shall submit copies of a soils remediation plan to the satisfaction of the Fire Prevention Bureau and the Department of Planning/Building/Public Works prior to the resumption of any work on the site; d) State Department of Ecology approval will be required for remediation activities; and e) that all commercial and industrial activities within 300 feet of the project site are notified of the soils remediation plan and provided with a schedule of events. The agreement shall be submitted to the satisfaction of the Department of Planning/Building/Public Works prior to the issuance of any site preparation/building permits for this project. Note: 2.1 The contaminated soils may either be disposed of in an approved waste site outside of the City of Renton or treated on site. 3. The applicant shall, in order to address impacts to earth and storm water management, provide a "hold harmless" agreement which acknowledges that the City has informed the applicant that the I, subject property is located In an area which may be Included in an existing/altered 100 year flood plain, and that the applicants have decided to proceed, at their own volition, thereby waiving their rights to hold the municipality liable for any flooding and/or for any damages to property or person arising from such flooding. This document is to be approved by the Storm Water Engineering Section and the City Attorney, and to be duly recorded prior to the issuance of site preparation/building permits. Transportation 4. The applicant shall, in order to mitigate the impacts of increased traffic on area roads, provide the following mitigation fee of$9,900.00 (220 trips X $45 per trip) for the Grady Way TBZ prior to the issuance of site preparation/building permits. Note:The fee is based on the following: Trip Generation PM peak hour existing service station trips 108 PM peak hour convenience store trips . 130 PM peak hour trip generation difference +22 Daily Trip Generation Difference +220 • 220 Daily Trips X$45 per driveway trip = $9,900 The fee shall. be deposited to account number 105/572/318.70.00.67 Grady Way • TBZ/Chevron Facility • 5. . The applicant shall, in order to provide controlled Ingress/egress for the project site,.limit the east and west access points to the project site as follows: i East side of project: One access point a maximum of 30 feet wide and located a minimum of 50 feet back from Grady Way. West side of project: A maximum of two access'points a maximum of 30 feet wide and located a minimum of 50 feet from Grady Way'and a minimum of 50 feet from the south boundary of the project site. The plan shall be provided to the satisfaction of the Transportation Services Division prior to the public hearing for the conditional use permit by the Hearing Examiner. Construction 6. The'applicant, in order to mitigate construction-related impacts (e.g., noise, dust, traffic) shall submit a construction management plan including the following; a) an erosion control element; b) an element for the periodic watering of any disturbed soil on the site to reduce dust; c) an element for the limiting of hauling operations to the hours between 8:30 A.M. and 3:30 P.M.; d) an element for the protection of the existing storm drains from soils on site disturbed by construction activities; and e) a$2,000.00 cash deposit for street cleaning. This plan shall be submitted to the satisfaction of the Department of Planning/Building/Public Works prior to the issuance of site ! preparation/building permits and implemented throughout the construction phase of this project. NOTES: A. The applicant will need to apply for permits from the Fire Prevention Bureau for the removal of the existing underground storage tanks and the installation of the new tanks. B. The applicant will need to submit a sign plan for any new signs for the proposed. development prior to the Issuance of building permits. C. The applicant will need for provide storm drainage In accordance with the King County: Surface Water Design Manual to the satisfaction of the Utility Services Division of the • Department of Planning/Building/Public Works. D. The applicant will need to provide a six foot wide sidewalk along S. Grady Way and replace the existing street light in accordance with the City of Renton Municipal Code. E. The applicant shall provide drainage plans for the proposed development in accordance with the King County Surface Water Design Manual to the satisfaction of the Storm Water Section of the Department of Planning/Building/Public Works. The drains for the fueling, stations will need to be tight lined to the sanitary sewer with approved water/oil separator, and a shut off valve to prevent large spills of flammable material from entering the sewer. Grade breaks in the pavement shall be installed in a manner to prevent storm water from; the portion of the project not covered by the proposed canopy from entering the drain for the fuel pumping area. This plan shall be provided to the satisfaction of the Storm Water, and Sanitary Sewer Sections prior to the issuance of site preparation/building permits. E :: • The applicant, Chevron Oil Company, is requesting to convert an existing service station located at 301 South Grady Way to a fueling station with convenience store. The proposed project will cause an increase in the traffic associated with this land use. As the project is located within the Grady Way TBZ, a fee will be assessed for roadway improvements. According to the FEMA maps for this area, the project is located within an area subject to flooding during 100 year storms. The FEMA maps indicate that majority of the project site is located above the 100 year flood plain. The underground fuel storage tanks will be replaced with double wall fiberglass tanks. The new tanks will be located in a portion of the site that is located outside of the designated flood plain and will be anchored in place in accordance with the Uniform Fire Code and the City of Renton Municipal Code to prevent their being forced to the surface during a flood. Staff is concerned with the lack of landscaping and site definition for the existing land use. Staff is • I recommending that additional landscaping be provided with the proposed development. The landscaping should be used to define the boundaries of the project site and the proposed ingress/egress points. The proximity of Village Place Shopping Center makes it desirable to get a visual buffer in this area too. The applicant has verbally indicated that the proposed conversion of the service station might not be implemented immediately following the approval of the conditional use permit by the Hearing Examiner. Whether the applicant has adequately Identified and addressed the following environmental • impacts likely to occur in conjunction with the proposed development. • a. Aesthetics/Land Use . Impacts: The proposed development Includes demolition of the existing single-story building which includes service bays, construction of a new single-story, 1250 s.f. building without service bays, construction of a 176 s.f. utility building/restrooms and replacement 3, of three 12,000 gallon underground fuel tanks. The new building will include;a convenience store. The increase in traffic generated by the new development will be • further discussed in the Transportation Section of this report. • A 45 X 92 foot canopy will cover the main building and the four fueling stations. Two standard parking spaces and one handicapped parking space will be provided on site in 'I • accordance with the Municipal Code. j, • The plans submitted by the applicant indicate a minimum 10 foot wide landscape strip al along South Grady Way as is required by Code. In addition to the Code requirement, the a • applicant will also be providing a landscape strip, minimum 2 foot wide, along the south !I boundary of the project site. • The plans submitted by the applicant indicate that the majority of the landscape area along Grady Way will be covered by turf. Staff feels that the majority of the area should be landscaped with trees, shrubs and flowers. The landscaping along the south boundary of • the project should be a minimum of four feet wide in order to provide sufficient planting area for the proposed landscaping. The applicant has not Indicated any landscaping along the east and west boundaries of the property which would improve the aesthetics of the site and define the east and west ingress/egress of the project site. Staff.recommends that the applicant submit a modified landscape plan for the project site which includes a ,1 minimum of five foot wide planters along the east and west boundaries, enhanced + plantings along S. Grady Way and a sidewalk. jl Mitigation Measures: See Recommendation#1. Policy Nexus: Environmental Review Ordinance 4-6, Landscape Ordinance 4-31-34 • ;I b. Natural Environment • • • Impacts: The existing site is almost entirely covered in asphalt, concrete and building. In the construction of the new project, the applicant will be providing new landscaped areas. The applicant has also indicated that the site will no longer provide an area for repairing of ;I automobiles: This should reduce some of the contaminates (e.g., oil) from collecting on the site and washing into the storm drains. The applicant will need to install oil/water 'I separators to ensure that oil does not get into the storm drains. �I If during the excavation of the existing underground steel storage tanks contaminated soils are found,the applicant will need to stop construction activities immediately and to submit • a soils remediation plan to the Fire Prevention Bureau and the Development Planning Section of the Department of Planning/Building/Public Works within one week of it • discovering the contamination. Construction will not proceed until the remediation plan II has been accepted by City staff. This project Is located within the 100 year floodplain area. The underground storage tanks will require special anchors to ensure that they do not shift during floods or periods of high ground water. The design of the anchors will be reviewed, in accordance with the Municipal Code,•at the time of building permit review. Traffic Impacts: 1. Construction Construction activities, including the excavation of the underground steel storage tanks and the remodeling of the existing service station, could generate traffic which would impact area roadways during peak hour traffic. Based on the fact that S. Grady Way is a Major Arterial, measures will be required (limiting hauling operations to the hours between 8:30 A.M. and 3:30 P.M.) to mitigate traffic impacts from Hauling activities on area roadways. 2. Operation The traffic study prepared by the Transpo Group, dated January 15, 1991,1. indicates that the conversion of the existing service station to a fueling', station with a convenience store will increase the traffic generated by the' development by 220 trips per day for a total of approximately 1,200 trips; per day. As the project site is located within the Grady Way TBZ a fee, as calculated below, will be assessed. The Transportation Division had� reviewed the traffic study and found it to be adequate. This leads to a confused traffic pattern that will only get worse as traffic increases. Project Description The project site is located on Grady Way, east of Rainier Avenue S in Renton. The proposed project is a remodel of an existing service station with gas pumps to a convenience store with gas pumps. The proposed convenience store would be 1,258 gross square feet (gsf) with eight fueling positions. Currently, there are eight fueling positions and two automotive repair bays at the existing service station. Trip Generation-Methodology The difference in PM peak hour trip generation associated with the conversion from service • • station to convenience store use was estimated from a PM peak hour trip generation survey• 1 at the existing service station and national data on'convenience store trip generation from the Institute of Transportation Engineers (ITE). This difference in PM peak hour trip gener- ation was then factored to obtain the daily difference in trip generation between the service station and convenience store use. A copy of this article is attached to this letter. The ITE article found that the average PM peak hour trip generation of a convenience store with gas pumps is 130 trips/hour, based on a survey of five convenience stores with gas pumps. This is considered to be a somewhat conservative estimate of PM peak hour trip generated by the proposed project since the convenience stores surveyed in the ITE article were much larger than the proposed project. The average store size from the article was 2,009 gsf; 758 gsf larger than the proposed convenience store. Larger convenience stores with gas pumps tend to attract more non-gasoline customers and trips by offering a wider variety of goods. Based on this information, the proposed convenience store would generate 22 more PM peak hour trips than the existing service station. To estimate the daily increase in trip generation by the proposed project, the ratio of PM peak hour traffic to daily traffic (K-factor) of 0.10 was used. This K-factor was derived from the information contained in the above referenced 1TE article. Applying the K-factor results in an estimated daily driveway trip increase of 220 trips due to the proposed project. Table 1 summarizes this analysis. Table 1. WHEREAS, the City of Renton has undertaken a study of traffic conditions known as the Grady Way Benefit Area Assessment Study; and WHEREAS, the area within the Grady Way Transportation Benefit Zone has experienced rapid growth which generates substantial additional traffic; and WHEREAS, the transportation system is inadequate to support the present development and the projected business development within the Grady Way Traffic Benefit Zone. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO RESOLVE AS FOLLOWS: SECTION I. The above recitals are found to be true andl correct in all respects . SECTION II . Our repeated efforts to contact each other by phone have been unsuccessful, as have my efforts to reach Mr. Charlie Regele. I am specifically concerned about your letter to me, dated November 12, 1991, referring to a potential stop work order for failure to submit a SEPA Environmental Checklist for our project. An Environmental Checklist had been filed and finalized with the city on May 28, 1991 for the conversion and upgrading of the existing service station. This is referenced in the July 18, 1991 Office of the Hearing Examiner's documentation of the July 2, 1991 hearing. On July 22, 1991, I spoke with Ms. Laureen Nicolay of your office concerning site cleanup activities associated with the UST replacement. I explained the need to complete a site assessment before developing a remediation plan. It was agreed that a remediation plan would be submitted to and approved by the City of Renton prior to removal of the existing UST system. In my October 25, 1991 letter to the Department of Ecology Northwest Regional Office, I stated a possibility existed that the reconstruction project may not be initiated in 1992. Since the time of my letter, the project is again scheduled for the first quarter of 1992. Based on the understanding of the above, I am unclear as to why a stop work order will be issued for this project. Presently, a site assessment has been completed and the remediation plan is being finalized by our consultant, EA Engineering. It is still Chevron's intention to submit this plan for city approval prior to site work. I would be greatly appreciative of any guidance you can provide me so both the site remediation and station upgrade can be initiated without undue delays. The original scale of il"=500' has been enlarged 5 times to 1"=100 ' . This allows the FEMA Map to be directly compared with the CH2M Hill flood work map. Note that both maps show cross section A, B, C, locations on Rolling Hills Creek. This allows exact alignment in at least one direction between the two maps. These cross section lines are drawn immediately north of the west bound off ramp from I-405 to SR-167. With the FEMA map enlarged to the 1"=100 ' scale I think it is clear that the Zone X designation on the FEMA map aligns right on top of the Chevron service station. This adds a second! confirmation that the CH2M Hill map and the survey are accurate in describing most of our site as being above the FEMA 100 year flood plain, (24 feet) . Grady Way Dear Mr. Pywell; This letter is to submit to you additional information regarding the exact location and extent of the one hundred year flood plain in and near the site of our proposed convenience store at 301 South Grady Way. Attached are two copies of the FEMA flood map provided by the Fire Marshal, Glen Gordon, showing the 100 year flood elevation being 24 ' in the area surrounding our site. Also please note the kidney shaped area designated as "Zone X" . We understand this designation to be above the 100 year flood level. Also attached are two copies of the "Review Draft" work map for flood insurance rate map and flood boundary. This map is an aerial photo with flood level overlays done by CH2MHILL for the City of Renton. This map clearly shows an area around the existing Chevron facility as being above the 100 year flood plain. This confirms that the "kidney" shaped area on the official FEMA map is in fact the site for our proposed project. I have also enclosed two copies of a stamped survey by Bush Roed & Hitchings Inc. showing spot elevations for our site. These spot elevations confirm the more generalized mapping which shows much of our site to be above the 100 year flood plain. Finish floor of the existing structure is shown as 25. 64 or more than a foot and a half above the 24 ' FEMA flood level. You will also find enclosed a plot of our proposed site plan on tracing paper so that you can line up the proposed tank locations with the existing spot elevations. Reading the spot elevations through the tracing paper, I see three of them reading 24.21, 24.21 and 24.76 running west to east centered on the tanks. Page 2 We could find even higher spot elevations of the existing site to the south and east of the proposed building. We would prefer to keep the proposed tanks as shown. Re-grading of the site for the new construction will be done to keep the finished grade elevations at or above these existing elevations. Based on this new information I request a written determination that: A. The proposed location of our three twelve thousand gallon tanks is currently above the established 100 year flood plain. B. The proposed location of our convenience store is above the established 100 year flood plain. C. The existing finish floor height of 25.64 is adequate to meet the City of Renton's requirements for the height of finished floors above the 100 year flood event. I further request a copy be sent to Mr. Glen Gordon, Fire Marshall, City of 1 Renton. We do understand that this detailed information was not available to the Technical Advisory Committee at the time of their initial review. We do hope that a careful review of this additional information will allow the proposed Chevron Fueling Facility and Convenience Store to proceed to SEPA Review and then to the Hearing Examiner.
