This should clarify the direction we received from your department while researching utility availability for design purposes. We met with Arlene Haight, Don Monaghan and other staff to identify locations and availability of water, sewer and storm drainage connections for this project. We purchased copies of your maps and were told that the sanitary sewer main in Anacortes was not owned by the City. Apparently it had never seen transferred to the City following construction. We were told that the City owned sewer main on the east property line was available for connection and an easement may be required. After consulting with our client, we pro- ceeded to design our system to connect to the' City main. Your staff was in general agreement on this solution. It has been noted in a staff comment on the rezone documentation that the City wants the Developer to make arrangements for the inspection and transfer of the sewer line in Anacortes Avenue to the City as a condition of rezone approval .' While we understand it would be to the City's benefit to own and maintain this line, it seems to place an unfair burden on the Developer. Especially since he has access to a City-owned main closer to reasonable point of connection. • We request that the City Utility Department withdraw the condition of approval requiring the Developer to provide for the transfer of an existing sewer main in Anacortes Avenue to the City. Instead we request that you approve our connection to the City-owned sewer main at the southeast corner of the site. 1601 114TH AVE. Encore Occupancy The owner of Encore has been cited for occupancy requirements for the Limits night of July 10. Conditions were monitored this past week and no infractions were observed. Metro Treatment Mayor Shinpoch's recent vote on the siting of the Metro treatment plant Plant Site at West Point was pro taxpayer, not anti-environment (in 1995 when project comes on line, sewer rates for West Point will be $24.49.per month while for Duwamish they will be $32.10 per month). These figures assume receipt of a $300 million Federal grant; otherwise, $5 will be added to monthly charges. Local Theater According to Police Chief Wallis, the loop barricades are not significantly Access impairing access to local theaters. ,, Drivers Training Arrangements are being made to use a Boeing lot to continue the City's.l Courses driver training classes, halted when RVTI construction denied access to the previously used training course. It was noted that weekend calls for readings are handled on a need basis; emergencies requiring immediate attention, investigated by a City qualified reader (if available) or referred to King County for assistance. Pigeon Problem Councilman Stredicke indicated he had received a citizen complaint regarding 1,000 pigeons being kept at a residence in the vicinity of Tenth Avenue NE and Olympia and requested investigation by staff. King Subregional Councilwoman Keolker reported the King Subregional Council of the Council of the Puget Sound Council of Governments has agreed to give an advisory PSCOG recommendation to the King County Council regarding takeover of planning functions of solid waste issues. Suburban Cities had expressed concern regarding loss of control concerning solid waste issues, particularly in the area of rate setting; the recommendation of the PSCOG was to assume the interlocal forum function in solid waste planning issues and also to serve as the rate board for King County. The King County Council is scheduled to meet to discuss this matter in late July. Councilman Happy birthday greetings were extended to absent Council Member Earl Clymer's Birthday Clymer. PUBLIC HEARING: After reviewing the Building and Zoning Department • Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 13, 1986, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication, and other documentation relative to this request. Exhibit 02 - Assessors Map. Exhibit #3 - Illustrative Site Plan. Exhibit #4 - Illustrative Elevation Plan. Exhibit #5 - Letter dated May 12. 1986 from The Schemmer Associates, Inc. to Ron Olsen, Utility Engineering Department for the City of Renton. Exhibit #6 - Illustrative artist rendering-of proposed building. Opening testimony began with a review of the project by Roger Blaylock, Zoning Administrator for the City. He stated the applicants rezone request is to cover 1.44 acres • of property currently zoned R-3; the request is for B-1 zoning; the property is long and narrow with dimensions of approximately 140 ft. wide by 561 sq. ft. long. Also mentioned was the fact utilities are available to the property; the applicant is also requesting a functional limitation of the building for primary uses to be medical/dental and other healthcare services; the ERC looked at this site as•well as another site in the area and determined that the, interface would be too great to permit a retail user with high traffic volumes to be located on Anacortes, immediately across the street from a residential neighborhood. The proposed building will be 3 stories in height and will contain special loading access areas for patients. Mr. Blaylock expressed concerns over the design; a possible technical problem with the sanitary sewer in Anacortes as this sewer was never approved and given to the City, and curbs that have become damaged due to vegetation on the site that will have to be reconstructed. Bartel and Associates R-019-86 May 19, 1986 Page 2 Continuing, Mr. Blaylock reviewed the rezone criteria to be considered. He stated the site has not been considered for a rezone since 1968; is in conformance with the goals and policies of the Comprehensive Plan. The Policy Development Department requested that the landscaping along tile parking lot be increased to allow transition from the commercial property to the east and residential property to the west of the subject site. In reviewing traffic, it was felt a medical facility would generate less traffic than a retail facility on the site, and the adjacent property on the east has recently been rezoned from G-1 to B-1 which would lend support to this request being presented in a timely fashion. In closing, the Zoning Administrator requested the Hearing Examiner to recommend approval to the City Council with the signing of Restrictive Covenants limiting the uses on the property. The Examiner called for testimony in support of this proposal from the applicant or their representative. Testifying was: Michael Gemza, Architect 1601 - 114th Avenue S.E. Bellevue, Washington, 98004 Mr. Gemza introduced the other representatives in attendance and available for questions from staff or the audience. He commented on the statement in the staff report wherein mention was made that the City wants the developer to make arrangements for the inspection and transfer of the sewer line in Anacortes Avenue to the City as a condition for rezone approval. He said there is a sewer line available on the east side of the property, and the applicant had been told they could not hook into the sewer on Anacortes as it was a private sewer. They met with the City, discussed it with the City Engineers, and do not feel it will be to their benefit in this rezone to make it a condition to have this applicant go through the hardship of trying to purchase a sewer line that they do not own. The Zoning Administrator spoke saying the sewer in Anacortes Street services the multiple family property to the west of the site. It was felt this sewer line is not the responsibility of the applicant, and could be further addressed in, the Site Plan approval, but accordingly. felt this should be resolved with the Public Works Department. Continuing, Mr. Gemza advised their wish was to accommodate medical offices/dental/pharmacy/health care types in their building that would be available to the local community. Mr. Gemza closed stating the referred to bulge in Anacortes Avenue is due to a house on the property that was too close to the street. The applicant has demolished the house and for safety reasons has taken the bulge out of the street and applied the proper setbacks for the proposed office building. He feels'the office building tenants will be a good neighbor to the community, and stated they are fencing off the back portion of the property on the north and west to shield the cars from the residents. He closed with a description of the aesthetics of the building and courtyard area and how they will blend into and complement the surrounding neighborhood. Also wishing to speak in support of this proposal was: Dan Bartel 214 First Street, Suite itC Kirkland. Washington, 9 8 0 3.3 Mr. Bartel presented a rendering of the proposed office building and explained the uses they anticipate housing within the building. He said the applicant wants to be a good neighbor; they will provide medical health care services for the community. Referring to the sewer system he said they will be willing to transfer rights to the City. Mr. Bartel feels this service is needed in the area, and requested a recommendation of approval from the Hearing Examiner. The Hearing Examiner called for testimony in opposition to this proposal. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Bartel & Associates, filed a request for approval of a rezone of approximately 1.44 acres of property from R-3 (Medium Density Multi-Family).to B-1 (Business/Commercial) subject to the limitation that only professional offices would be located on the subject site. Bartel and Associates R-019-86 May 19, 1986 Page 3 • 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC). the City's responsible official, issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located on the northeast corner of N.E. Sunset Boulevard and Anacortes Avenue N.E., one block west of Duvall Avenue N.E. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial uses, but does not mandate such development without consideration of other policies of the plan. 8. The site was annexed into the City by the adoption of Ordinance 2408 enacted in May, 1968. The site was reclassified from G-7200, the single family category it received upon annexation, to R-3, its current classification, by the adoption of Ordinance 2451 enacted in December, 1968. 9. The zoning in the areas surrounding the subject site represents a wide variety of districts. North of the site is a large R-1 district. West of the site, west of Anacortes, is a small R-3 district, the subject site's current zoning. East of the site is a parcel which was recently reclassified B-I. the category requested for the subject site. South of the site across Sunset is another R-3 district and a B-1 district. 10. North of the subject site is a large area containing exclusively single family homes. West of the site is an apartment complex. Commercial uses are located east and west of the site along the Sunset Blvd. alignment. 11. The sewer moratorium which affected the subject site has been lifted, and the trunk line is now serving the area. A private sewer line runs along Anacortes just west of the site, and a sewer line tied in to the main city sewer is available just east of the site. 12. The applicant has proposed developing a building catering primarily to professional, licensed personnel including doctors, dentists, architects, lawyers and pharmacists. The applicant has agreed to limit occupancy to these groups to minimize the potential impacts on the immediately adjoining single family and multiple family homes. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, it will not impair the public health, safety and welfare and in addition, complies with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The requested reclassification is justified and should be approved by the City Council. 2. The Comprehensive Plan designates the area for commercial uses and the reclassification will permit such uses to be established on the site. 3. As proposed by the applicant, professional offices would be established on the site, thereby minimizing the impact of commercial development on the nearby adjacent residential uses west and north of the site. No high traffic retail uses would be permitted, nor would there be substantial evening hour traffic to the site. Bartel and Associates R-019-86 May 19, 1986 Page 4 4. The zoning requested, B-1, would also be compatible with the recently granted B-1 zoning immediately east of the site, furthering the aims of the Comprehensive Plan of combining unified blocks into districts of similar zoning types. 5. Since the adoption of the current R-3 zoning the Comprehensive Plan was amended to designate the site for commercial uses. The sewer moratorium was enacted, and lifted, and major commercial uses have been established both east and west of the site along Sunset. The rezone, therefore, appears timely and should be approved by the City Council subject to the limits requested by the applicant that only professional offices and a pharmacy be permitted on the subject site. 6. There does not appear to be any reason to limit or tie this applicant to conditions related to a private sewer not within the applicant's ownership or control. Without more the applicant should be permitted to connect with the City sewer running along the east side of the subject site. RECOMMENDATION The City Council should approve the reclassification of the subject site from R-3 to B-1 subject to the following conditions: The filing of Restrictive Covenants limiting the uses permitted on the subject site to professional medical, dental, legal, and architectural offices, and a traditional pharmacy specializing in and generally limited to prescription and over-the-counter drugs and medical products, but not including such items as housewares, gifts and other non-medically related items. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. For purposes of these decisions and recommendations the terms "Should" and "Shall" are to be considered mandatory. The term "May" will be considered discretionary. The office building gross floor area exceeds 25.000 square feet and will require site plan approval before the Hearing Examiner under the new Site Plan Ordinance No. 3981. 2. The Environmental Review Committee has issued a declaration of non-significance on March 19. 1986. The appeal period expired on Monday. April 7, 1986. at 5 p.m. 3. Various City departments have reviewed the proposed rezone request. Their comments are as follows: • Police Department - Approved (March 13, 1986) • Fire Prevention Bureau - Approved With Conditions (March 7, 1986) Building is to meet current codes and ordinances adopted by the City. • Parks Department - Approved • Design Engineering Division - Approved With Conditions (March 5, 1986) 1. Subject to Fire Marshal's comment at time of development. • Traffic Engineering Division - Not Approved (March 11, 1986) Street lighting plan required for Anacortes Avenue N.E. per City standards. • Building Division - Approved (March 7, 1986) • Zoning Division - Approved With Conditions (March 10, 1986) Recommend preservation of mature coniferous trees be incorporated into the development where possible. • Policy Development - Approved With Conditions (March 13, 1986) The proposed rezone is consistent with the Comprehensive Plan Land Use designation of Commercial and is compatible with the adjacent land uses provided that there is generous buffering of the residential uses to the north and west as part of the future development permit approvals. The landscaping. screening and traffic circulation should be closely monitored. 4. The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification to the City Council. The following evidence demonstrates the rezone request is appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed to the City in 1968 by Ordinance No. 2408. In December of that same year. Ordinance No. 2451 rezoned the property to its present R-3. Residential Use, classification. It has not been considered since that time. and the area-wide update of the Northeast Renton Plan completed in December of 1981 reclassified this area as Commercial. Thus. the criteria appears to be complied with. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The proposed rezone request to B-1. Business Use, is in direct conformance with the Comprehensive Plan Land Use Map designation of I Commercial for the subject site. The goals and policies of the Comprehensive Plan suggest that areas adjacent to established residential areas should be utilized as buffers. The Policy Development Department points to the fact that the proposed use of medical office is an appropriate use buffer between the higher use retail commercial activities to the east and the multiple family residential uses to the west. In addition. they suggest that heavy landscaping should be encouraged to provide a physical visual transition. The applicant's site plan includes very major landscaped areas intended to create physical buffers. The medical office facilities will generate traffic at approximately 1/3 the level that the adjacent retail development would thus creating a use transition and a reduction of impacts going from east to west. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements. permitted private development or other circumstances affecting the subject property have undergone significant and material change. During the last few years. the property in the general vicinity has not been aggressively developed primarily because of the limitation of sanitary sewers. The completion of the Honey Creek sewer trunk line now will allow the expansion of uses within the basin. The recent rezone of the adjacent property to the east (Mullens) is suggestive of this change in land use pattern. d. Timeliness: The final test to determine whether a rezone is appropriate is to address the question of timeliness. Public services have been extended into the area to serve the anticipated development under the Comprehensive • Plan. Gradual changes in land uses are now occurring after approximately a five year period where development was delayed as a result of lack of sanitary sewer service. Therefore, it does appear that it is timely to develop the subject site. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis. it is recommended that the Hearing Examiner recommend to the City Council approval of the rezone request. file number R-019-86. by Bartel & Associates, subject to the filing of restrictive covenants to limit the use of the facility to professional offices including medical. dental. and health care services. From: Bartel and Associates Bartel and Associates requests the rezoning of a 1.44 acre parcel of property located on the northeast corner of Sunset Highway and Anacortes Avenue NE, from R-3 Residential (Multiple Family) to B-1 (Business). Area Description The subject property is a parcel of land approximately one hundred sixteen feet (116') wide by five hundred sixty one feet (561 ') long, running the entire length of the Anacortes Avenue cul-de-sac. The property currently is underdeveloped, overgrown, and contains an older single family residence. Property to the east, fronting on Sunset Highway, is zoned General Business and contains the Tum-a-Lum Lumber Company; east of that the King and Bunnies Appliance Store, a nursery and Coal Creek Parkway. To the west of the proponents property, across Anacortes Avenue, and zoned R-3, is located the Sunset East Apartments. The medium density Sunset East Apartment complex is oriented in an east-west direction along Sunset Highway (only the manager's office is oriented toward this site) with two driveways entering off of Ana- cortes Avenue to the on-site garage and parking areas. To the north of the site is located a R-1 single family area. The single family properties located along the rear property lines of the apartment complex, the lumber and appliance stores as well as the proponents property are generally oriented to the north, with the changes in zoning occurring at the rear property lines. Property to the south of the proponents property, across Sunset Highway, is zoned B-1 (Business) and contains a gg16r 1, • - McDonald's Restaurant, and a shopping center containing an Albertson's Grocery store, a Pay and Save Drugstore, and an Ernst/Malmo Hardware/Nursery store. The center also contains a Taco Bell Restaurant and Burger King Restaurant. Proposed Use of Property The proponents, Bartel and Associates request the change in zoning from R-3 to B-1 for the purpose of constructing a professional building to provide medi- cal , dental and other related health care services to this area of the com- munity. The structure is proposed to be located at the south side of the site, adjacent to Sunset Highway, with the parking to the north between the building and the R-1 Residential area thereby providing distance and open space as a buffer between the use of the property and the northern residences. A solid screen and plantings will provide a visual and sound barrier to residents from the parking area. Additionally, long-term parking will be assigned to the north of the parking area, thereby limiting the major movement of both customer and pedestrian related traffic to the south part of the parking area. An exit drive is proposed at the south end of the cul-de-sac, but should present a minimum of interference with the residents to the north. Lighting of the parking area will be oriented toward the internal portion of the parking site;-away from the residential areas, eliminating off-site glare. Area and City Benefits by Rezoning As the proposed use of the site is for a medical related facility, four positive features for the surrounding properties are realized. First, the structure itself, being an office building, will only support office type use. Given a situation where, for some reason in the future, medical uses were no longer possible on this site, only other professional or business offices would be feasible as a replacement use in this type of structural design. This greatly reduces the possibility of any detrimental future retail commer- cial sales use of the facility or site. Second, hours of operation as a medical facility or, for •that matter, profes- sional or business office use is generally limited to daytime hour usage. gg16r This eliminates the conflict in traffic, night time use, and other adverse time of use conflicts between residential and commercial land use--the hours are compatible. Third, this use of the property represents an excellent transition in land use from the existing adjacent apartments to the west of the site to both existing and future commercial retail sales on property east of the site. This type of transitional use eliminates the problem of incompatible use and building design associated with changes in zoning districts. The alternative, in most cases, is to either unreasonably increase density or lessen, the quality of the design to satisify the economic realities of land development. Fourth, the existing use of the site is both undervalued and physically unat- tractive. The value of the site is obviously not in single family use, therefore to try to upgrade the existing use of the site, or the buildings .on ' the site, is counter productive. To put money into upgrading the site to make it more livable or to .otherwise improve the site increases the eventual cost of redevelopment, and creates a need to redevelop at a higher, more intensive ' re-use of the land to realize additional cost. The alternative is to let the site deteriorate further to a point of being an eyesore and to further devalue adjacent properties. The proposal creates an attractive use, compatible with surrounding property, and eliminates an existing eyesore. ' The Requested Zone Change Is in Conformance to the City of Renton Comprehen- sive Plan The land use element of the Comprehensive Plan designates the proponents ; property as commercial , with medium density residential designated to the west, Commercial designated to the south and east, and Single Family desig- nated to the north. The subject property is actually the only property in the surrounding area that is not developed according to the Comprehensive Plan. This request for rezoning, if approved, will make this area in compliance with the plan and in conformance to the surrounding area. The proposed use of this site meets the site design (site-access and arterial access design standards of the Northeast Plan Commercial and Land Use Objec- ggl6r tives. This is a normal , logical progression of land development in the area. The apartment complex to the west is a solid, well developed permanent use of property. The shopping center has also completed the normal progression of land use on the south side of Sunset Highway. The proponents property is the next logical property to be developed, and will be the transition between residential use to the west and north and future commercial land develop- ment/shopping center development to the east, to Coal Creek Parkway. Anacor- tes Avenue acts as a peremiter road; being a cul -de-sac street it only pro- vides access to the apartment complex and to this site, consequently the street and the access to said street from this site meets the design criteria of the plan. The site meets the policies for urban development objectives under the Urban Design Goal (page 11 ) in that the property, while containing a house, is basically underdeveloped, therefore by plan should be given priority for development particularly in that public utilities are available. The proposed development will help achieve a balance in area land use and will be an upgrade of marginal land. The proposed site use also meets the District objectives (page 12) of the plan in that it provides both a buffer and a functional land use relationship between uses in the area. It is a rehabilitation of an existing under devel- oped, low economic valued property. Design of the exterior of the structure is such that it should set an attractive precedence for future commercial development to the east. Landscape objectives of the plan have been previous- ly described in the section on proposed use of the property. All zoning requirements on site development, buffering, screening and planting are de- scribed and shown on the supporting site plan document. The general commercial goals to promote attractive, convenient viable systems of commercial facilities are exemplified in this proposal. The use proposed provides an additional transition of land use, decreasing adverse economic, visual and environmental effects on adjacent properties typical of general commercial uses that could occur on the site; and in effect creating a better visual and environmental effect than the current use of the site. Traffic and pedestrian traffic circulation policies are realized in that access to the gg16r „ high volume Sunset Highway is minimized by one controlled access egress point, Anacortes Avenue: is effectively an access point to only the Sunset East Apart- ments and the proposed medical and office facility. • It is therefore requested that the proposed property, 1.44 acres on the north- east corner of Sunset Highway and• Anacortes Avenue NE be rezoned from R-3 (multi-family) to B-1 (business) to construct a medical and office facility.
