Reducing this penalty to an infraction for first- and second-time offenders would assist Animal Control and the prosecutors in enforcing this section of the code. Currently, owners who are criminally charged under this ordinance are often seeing their charges reduced to an infraction to facilitate plea bargains anyway. These offenders typically do not have extensive criminal history and they usually express remorse for their actions. This proposed legislation would amend the Renton Municipal Code to make a first and second violation of this chapter a civil infraction with a fine of $250 while maintaining a criminal penalty for any subsequent violations. Also, amending the definition of “vicious” will simplify the code for more standardized enforcement. STAFF RECOMMENDATION: Adopt the ordinance amending sections 6-6-4 and 6-6-5 of the Renton Municipal Code, revising the definition of "vicious" and reducing the penalty for first-time and second-time offenders for violating the ordinance governing habitually barking dogs. 5b. ‐ City Attorney Department  recommends amending City Code  Page 3 of 111 1 CITY OF RENTON, WASHINGTON ORDINANCE NO. ________ AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, AMENDING SECTIONS 6-6-4 AND 6-6-5 OF CHAPTER 6, ANIMALS AND FOWL AT LARGE, OF TITLE VI (POLICE REGULATIONS) OF THE RENTON MUNICIPAL CODE, BY AMENDING THE DEFINITION OF “VICIOUS”, ADDING IDENTIFYING LANGUAGE AND REDUCING THE PENALTY FOR FIRST OR SECOND TIME OFFENDERS TO A CIVIL INFRACTION FOR KEEPING OR HARBORING ANIMALS DISTURBING ANY PERSON IN THE NEIGHBORHOOD BY HABITUAL HOWLING, YELPING OR OTHER FREQUENT OR LONG, CONTINUED NOISE. THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION I.The definition of “Vicious” in section 6-6-4, Definitions, of Chapter 6, Animals and Fowl at Large, of Title VI (Police Regulations) of the Renton Municipal Code, is hereby amended as follows: VICIOUS: An animal other than a dog “dangerous dog” or “potentially dangerous dog” that displays the characteristics or propensity to do an act that might endanger the safety of a person, animal, or property of another, including but not limited to a disposition to mischief or fierceness as might occasionally lead to attack on human beings or other animals without provocation, whether in play or an outbreak of an untrained nature. SECTION II.Subsections 6-6-5.B.7, 6-6-5.B.8 and 6-6-5.B.9 of section 6-6-5, Dogs at Large; Requirement of Leash or Chain, of Chapter 6, Animals and Fowl at Large, of Title VI (Police Regulations) of the Renton Municipal Code, are hereby amended as follows: 7. To keep or harbor any dog, cat or other animal or fowl whether licensed or not, which by that emits habitual howling, yelping, barking or other noise disturbs or annoys any person in the neighborhood, or to keep 5b. ‐ City Attorney Department  recommends amending City Code  Page 4 of 111 ORDINANCE NO. ________ 2 any domestic bird or animal that emits frequent, or long, or continued noise so as to disturb the peace, quietness and comfort of the neighboring inhabitants that would disturb a reasonable person. The first or second violation of this Subsection shall constitute a civil infraction punishable by a fine of up to $250, not including costs. Any subsequent A violation of this Subsection shall constitute a misdemeanor in accordance with RCW 9A.20.021(3), as now or hereafter amended. 8. To keep, harbor or maintain any vicious dog or dog with vicious propensities dangerous dog, potentially dangerous dog, or vicious animal in a manner which may or does endanger the safety, health and well being of persons or the safety of property being or located off the owner’s or custodian’s premises or lawfully on said premises. A violation of this Subsection shall constitute a misdemeanor in accordance with RCW 9A.20.021(3), as now or hereafter amended. 9. To allow a vicious dog or dog with vicious propensities dangerous dog, potentially dangerous dog, or vicious animal to run at large at any time, or allow such dog or animal off the owner’s or custodian’s premises unless securely leashed and in the control of a person of suitable age and discretion to control and/or restrain such dog or animal at all times. A violation of this Subsection shall constitute a misdemeanor in accordance with RCW 9A.20.021(3), as now or hereafter amended. Included in those new standards was a numeric caseload limit for the attorneys providing indigent defense. Cities have until September 1,2013 to come into compliance. Staff's analysis of a straight caseload limit would result in a significant cost increase to the city, while likely underusing our experienced Pubic Defenders. As an alternative to the straight limit on caseloads, the Supreme Court allows cities to adopt a weighted caseload system. Staff is proposing the adoption of a proposed case weighting system for indigent criminal defense cases as required by Washington State Supreme Court's New Standards for Indigent Defense. The Washington State Supreme Court has ordered such a system to be established and adopted in its entirety on or before September 1, 2013. Adopting the weighted system now will allow us to have several months of operations prior to the September deadline, should any adjustments need to be made. WHEREAS, on June 15, 2012, the Supreme Court of Washington issued Order, No. 25700-A-1004, which established New Standards for Indigent Defense (NSID), which it amended on August 9, 2012, No. 25700-A-1007, and again on September 7, 2012, No. 25700-A-1008; and WHEREAS, NSID became effective, in part on October 1, 2012, with the remaining becoming effective on September 1, 2013 (subsection (e) of the Certification Form), and October 1, 2013 (Caseload Limits); and WHEREAS, the Council recognizes, agrees and accepts that an intent of the NSID is to ensure that each indigent criminal defendant receives effective representation (NSID 3.2), and that each Attorney working with an indigent criminal defendant has the time necessary to ensure effective representation (NSID 3.2); and WHEREAS, the Council recognizes, agrees and accepts that the experience of an indigent criminal defendant’s attorney is a factor to be considered; and WHEREAS, the Council believes that experienced criminal attorneys provide indigent criminal defendants the most beneficial defense and as a result, Renton has created the case weighting system in Section III in compliance with NSID 3.5; and WHEREAS, in response to the Washington State Supreme Court’s NSID, Renton has written the City of Renton Case Weighting Policies and Procedures (CWPP). Recommendation: Council authorize the Mayor and City Clerk to sign the Lease Amendment Six to LAG-04-003. Background: ·King County METRO has leased parking spaces at the CCPG since 2004. ·Lease Amendment Three (2009) provided for a fixed number of spaces, 250 with a fixed price of $3,750.00 per month. ·Lease Amendment Five, which provided METRO with 200 spaces, expired at the end of 2012 and the Lease is on continuation. ·METRO wishes to extend the terms and conditions of Lease Amendment Five for an additional year, with an option to Lease up to an additional 50 spaces for an amount to be negotiated if that option is exercised. ·There is sufficient additional space available. There are 580 total spaces available in the CCPG and there are 40 monthly lease customers on average. ·The business points of the proposed Lease Addendum are as follows: o The rate per space remains at $15 per space per month. o Lease payments are $3,000.00 per month. o The Lease Amendment term will be one year. This position has traditionally been assigned the duties of payroll (TeleStaff), accounts payable/receivable, purchasing card reconciliation, Medical Incident Report Forms, public records requests and other related support tasks. This position is currently vacant due to a promotion to fill a vacant Administrative Secretary I position and we are considering recruitment options. One of the options is to convert the vacant position to an Administrative Secretary I position. To support this option, please consider the following: • Over the past several years, there has been a higher level of responsibility required of the Office Assistant III position especially in the area of TeleStaff maintenance which pushes the boundaries of the job description. • Cross training of Fire Support Staff is necessary with pending retirements over the next several years beginning the first of 2014. Converting the vacant position eliminates the need to have the OAIII work out- of-class and receive out-of-class pay. • Converting the position would also provide a higher level of administrative support to the Fire Executive Staff and the department members. Both positions are covered by the AFSCME bargaining unit. The Office Assistant III position is at grade a05, while the Administrative Secretary I position is at a09. There will be an estimated combined salary savings from vacant administrative support positions of $10,409 for 2013. Additional salaries of $5,160 in 2014 will be absorbed within the Fire Department budget and will be offset by savings in out-of-class pay during cross training. No additional budget funds are being requested. As members of the administrative support staff retire over the next few years, replacement staff will be hired at a lower rate, which will assist in sustaining the integrity of the Fire Department budget. More specifically, the City has recently received a bid from Kenworth Truck for purchase of a new T-800 dump truck as budgeted by the Surface Water Utility Maintenance Section. This new addition to the city’s fleet is included in the 2013 budget approved by Council in December. The request to the state Legislature was initiated by the city’s Department of Community and Economic Development. The West Hill/Skyway areas are part of Renton’s potential annexation area. This grant will be used for costs related to the revitalization of the West Hill/Skyway corridor. The improvements include landscaping, lighting and signage at the entrance of the business district. Sidewalk treatments, landscaping, bicycle lanes and pedestrian enhancements will be provided in key areas of the corridor. King County is the lead agency on the project and will have the construction and maintenance responsibilities. An interagency agreement with King County for such services (CAG-11-069) was approved by Council in April 2011. Prior to August 1st of each year or d During the City's annual budget process, the Commission shall review with the Mayor, or his/her representative, all capital improvement projects anticipated within the following two (2) year period to determine which projects are appropriate for inclusion of works of art and to estimate the amount to be allocated for said purpose. The Mayor, with appropriate budgetary authorization from the City Council, may establish the amount to be provided for the project(s), as guided by RMC 2-8-7. If, however, the Mayor decides that there will be no funds expended for art on a municipal construction project, and upon concurrence from the City Council, then the funds allocated therefor shall be expended as set forth in RMC 2-8-7C or as otherwise determined by the City Council. Copies of any proposals prepared by the Commission shall likewise be furnished to the Department of Community and Economic Development of the City. 1. Definition of municipal construction project: Any public building, decorative or commemorative structure, park, street, sidewalk, parking facility, or any portion thereof, within the City limits, which will be constructed, renovated or remodeled, and paid for wholly or in part by the City, and the total project cost of which exceeds ten thousand dollars ($10,000.00) to construct, renovate or remodel. 2. H. The Commission shall be responsible for disbursing money budgeted to it for support of cultural arts performances, arts-related activities and orfianizations, as resources allow. Such money shall be used to support specific performances such as choral concerts or play performances, performing arts events such as the River Days Art Show, or special projects of a performing arts group such as coaches and music tutors for the Ronton Youth Symphony. Such funds may not be used for capital purchases, facility renovations, maintenance or other non-performance expenditures. Any such funded performance must be held in Renton and primarily benefit Renton residents. SECTION Ii.
