Committee also Whole recommended any comments from Council be forwarded to the Public Safety Fire Master Plan Committee prior to November 13, 1986, to allow consideration of the adoption of the plan during 1987 budget process. Transportation (Aviation) Transportation (Aviation) Committee Chairman Trimm presented a report Committee recommending Council concur in the Public Works Department Perimeter Road recommendation to accept the second low bid of Kohl Excavating, Inc., in Improvements Bid Award the amount of $457,632.16 for West Perimeter Road water main and sanitary sewer improvements and South Perimeter Road water main and roadway improvements, Renton Municipal Airport. It was noted low bid was withdrawn by Scoccolo Construction, Inc., due to major error in bid preparation. Committee also recommended Mayor and City Clerk be authorized to execute contract documents. MOVED BY TRIMM, SECONDED BY KEOLKER, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. Lane Sublease/Boeing Transportation (Aviation) Committee Chairman Trimm presented a report Company Apron Release recommending Council concur in the recommendation of the Public Works Department to approve: 1) Sublease by Joseph C. Lane to Lake Aircraft, Inc., of the new single-bay hangar for the purpose of a sales, distribution, repair and maintenance, and training operation involving the Lake Amphibian aircraft; and 2) Release by the Boeing Company of area adjacent to the Lane lease which will be added to the Lane lease to facilitate proposed sublease operation. MOVED BY TRIMM, SECONDED BY KEOLKER, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. Municipal Hangar Rental Transportation (Aviation) Committee Chairman Trimm presented a report Rate Adjustment recommending the monthly rental rate for municipal hangars be increased from $125 to $150 for a term of one year, with additional studies of market conditions during that year. Committee also recommended review of alternative operations such as leasing all hangar spaces to one operator who, in turn, would rent to aircraft owners. Councilman Hughes Councilman Hughes extended his appreciation for cards, letters, flowers, and Appreciation acts of kindness received during his recent recuperation from injuries sustained in a fall on August 17. On behalf of herself, Council members and City staff, Mayor Shinpoch welcomed Councilman Hughes back, and indicated he was sorely missed during his absence. At this point, Councilman Hughes was excused from the meeting. NEW BUSINESS Councilwoman Keolker announced that as a result of her service on the Puget Cedar Hills Landfill Sound Council of Governments Solid Waste Management Committee, Interlocal Agreement Councilwoman Lois North appointed her to chair an ad hoc subcommittee to devise an interlocal agreement for the cities to sign with King County for use of Cedar Hills Landfill. Time is of the essence since the City must submit a letter of intent to the County by the 12/31/86 for use of the landfill by 12/31/87. ADMINISTRATIVE The proposed 1987 budget will be provided late this week to the City REPORT Council.. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Approval by the City Council Hearing Examiner Decision: Recommend approval to the City Council. BUILDING & ZONING The Building & Zoning Department Report was received DEPARTMENT REPORT: by the Examiner on August 21, 1986 PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on August 26, 1986 at 9:35 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Assessors Map. Exhibit #3 - Site Plan. The hearing opened with a presentation of the staff report by the Zoning Administrator, Roger Blaylock. He presented such information as the rezone will be on property approximately 0.31 acre in size on which there is an existing motel. It is proposed in the future to also place a restaurant on the site. The site is shown on the Comprehensive Plan as commercial and has been occupied for many years by a motel. Major street improvements have been made for access onto Sunset Blvd within the last 18 months, with access for this property directly onto Sunset. He also stated the ERC has issued a declaration of non-significance for this proposal; access is limited to right-in and right-out from the site because of the street design; and he continued with a discussion of land use issues. It was pointed out by Mr. Blaylock that there will have to be site plan approval if there are any structures converted that are over 4000 sq. ft., but it is felt the conversions suggested in the applicant's building permit application will not necessitate site plan approval. In his review of the rezone criteria to be considered Mr. Blaylock stated the site has not been reviewed for rezone since 1983; the site is potentially classified as commercial on the land use map and has been for many years; major improvements have been completed by the City to handle the traffic volumes in the area; and the changes in the area suggest this rezone is appropriate. Continuing, he stated in a new B-1 zone there must be a 10 ft. landscaped setback, but in this instance on Sunset Blvd. there is no landscaping adjacent to the public right-of-way which should be addressed to bring the area into compliance with the zoning code, or the matter could be handled as a part of the building permit process. In conclusion, Mr. Blaylock stated the request is appropriate and recommended that the Examiner recommend approval to the City Council of this request. The Examiner called for testimony in support of this proposal from the applicant or his representative. Responding for the applicant was: CHARLES HASTINGS, 321 - 31st Avenue, Seattle, Wa. 98122. Mr. Hastings stated it is felt there is no reason why this property should not be rezoned to B-1; will work MING-LEI TSENG • R-040-86 September 4, 1986 Page 2 with the City on the landscaping requirements for the front of the property, and asked the Examiner to recommend approval to the City Council. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:45 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Ming-Lei Tseng, filed a request for approval of a rezone of approximately 0.31 acres of property from L-1 (Light Industry) to B-1 (Business/Commercial). 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official issued a declaration of non-significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located at 219 Sunset Boulevard North, just northwest of the I-405/Maple Valley Interchange. 7. The subject site is a part of the original townsite for the City of Renton. The current L-1 zoning was adopted for the site when the City first enacted its Zoning Ordinance in 1953. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of commercial uses, but does not mandate such development without consideration of other policies of the plan. 9. The site is located along Sunset Blvd, a limited access arterial which carries large volumes of traffic. 10. The subject site is located in the center of a strip zoned L-1 district straddling Sunset Blvd as it parallels I-405 just north of Liberty Park. 11. A B-1 district containing the zoning requested by the applicant is located immediately west of the site, just west of the railroad right-of-way. 12. A motel and single family home are located on the subject site. With a change in the language of the provisions applicable to L-1 districts, the current uses became legally non-conforming in 1985. Since modifications or changes to non-conforming uses are strictly limited by Code, the applicant seeks to rezone the subject site to attain a conforming status for the existing uses and permit other commercial uses on the subject site. 13. The applicant proposes converting part of the existing complex to a restaurant. While that conversion is subject to applicable Fire and Building Code Provisions, it is not part of this consideration. 14. While staff and the ERC entered into a preliminary analysis of parking and access to the site, those matters are not at issue in the current request to rezone the subject site. 15. In the last 2 to 3 years Sunset Blvd has been reconstructed, and some new construction has occurred along Sunset. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, that it will not impair the public health, safety and welfare and in addition, complies with at least one of the criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or MING-LEI TSENG R-040-86 September 4, 1986 Page 3 b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved by the City Council. 2. The request to reclassify the subject site to B-1 would permit commercial and business uses, both uses compatible with the Comprehensive Plan designation of the site for commercial uses. 3. Although separated from the adjacent B-1 district by the railroad tracks, the zoning would also be compatible with that B-1 zone. It certainly would not be incompatible with actual commercial uses along both sides of Sunset Blvd. in this location. 4. The public improvements along Sunset, together with new development, appear to demonstrate the early restructuring of uses and a transition away from the limited industrial uses which were at one time located along the rail corridor. 5. The City Council, therefore, should approve the reclassification of the subject site from L-1 to B-1 to not only restore the commercial status of the area which will permit modification of existing uses, but will also confer a zoning category compatible with the Comprehensive Plan. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council. Comprehensive Plan Compendium, March 1986, p. 61-67. 3. Section 3014(C), Change of Zone Classification (Rezone). G. DEPARTMENT ANALYSIS: 1. The applicant, Ming-Lei Tseng, is requesting a rezone of approximately 0.31 acre from L-1, Light Industrial, to B-1. Business Use. This will bring the existing motel complex into zoning compliance and allow the future construction of a restaurant on the subject site. 2. The Environmental Review Committee issued a declaration of non-significance for the proposed rezone. The appeal date expired at 5 p.m. on Monday, August 4. 1986. 3. The Environmental Review Committee in their discussion of the project requested additional information dealing with potential parking on the subject site and access onto Sunset Blvd. North. Sunset Blvd. North is a limited access arterial because of the huge volumes of traffic the street carries. Access will be limited to right-in and right-out as a result of the Committee's discussion. ISSUE: 4. Is there sufficient area to allow on-site parking to be provided to support a restaurant? The applicant did show that there was apparently space to provide on-site parking. Final designs are part of the building permit review stage. The applicant was advised that minimum standards for aisle widths and fire access would have to be complied with. 5. The applicant revised the site plan showing that ten feet of landscaping could be located on the subject site per City Code requirements. The site does appear tight because we are dealing with existing land uses and trying to incorporate a new restaurant on the site. The specific design of the site does not relate to the issue of whether the property should be rezoned or not. It is more of a site planning and code requirement evaluation. The applicant is aware that both the fire and building codes will be imposed in any reuse of any of the buildings on the subject site. 6. Under Section 4-3014(C)(1), a series of four criteria are established that the Hearing Examiner must review in the request for rezone: a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject property has not been reviewed since the Central Area Plan was adopted in March of 1983. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. PRELIMINARY REPORT iu THE HEARING EXAMINER MING-LEI TSENG, FILE R-040-86 AUGUST 26, 1986 PAGE 3 The Comprehensive Plan map designates the subject site area as Commercial. All uses along Sunset Blvd. North have been commercial in use since zoning was applied in 1953. The L-1, Light Industrial, use did allow commercial activities until the language was changed in the fall of 1985. Therefore, the request will bring into conformance the zoning and the actual uses on the subject site. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. The major improvement to the area has been the reconstruction of Sunset Blvd. North to new arterial street standards. Some development has occurred to the north with the establishment of a small shopping district and the Burger King store. Therefore, both public and private uses in the area suggest that the zoning is appropriate. d. The final test to determine whether a rezone is appropriate is to address the question of timeliness. The subject site is both experiencing a change in public improvements and private development to higher intensities of commercial activities. The rezone appears appropriate and should be granted. ISSUE: 7. The underlying land use issue is the question of transitionalizing existing commercial structures into new commercial activities. Can this transition occur within the limits of the City Code and with the new development trends in the general vicinity? The applicant is proposing a rezone primarily to bring an old motel into legal conformance for land use. It does not address the question of upgrading the motel to present City standards. The requested action does not require the applicant to upgrade the facility, but it is a general issue of the area. • The second portion of the request is the conversion of part of the motel into a take-out Japanese restaurant. Conversion of a building is very difficult in that it must meet all applicable City Codes for fire and building code provisions. The land use problem is allowing a building that may not be compatible with the adjacent uses. In this specific case, it appears a hodge-podge of development to allow a portion of an existing motel to be converted into a restaurant. Adequate parking, access, and circulation become critical issues. The Environmental Review Committee specifically noted that access would be limited and that circulation on the subject site was inadequate. Major modifications to the site design will be required. 8. In conclusion, the rezone request to B-1. Business Use, from L-1, Light Industrial, use appears warranted. However, the actual activity that the applicant is proposing appears to be highly problematic as it relates to the other City Codes and their implementation. The applicant is presently processing a building permit request through the Building and Zoning Department. All plans will have to comply with City Codes. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the rezone request, file R-040-86 by Ming-Lei Tseng, be recommended for approval to the City Council as requested. r...� + fll r!!
