Honey Creek Interceptor Latecomer Fee APPROVAL OF VOUCHERS The Ways and Means Committee recommends approval of Vouchers No. 18363 through No. 18642 in the amount of $760,997.19. _ J Thomas Trimm m1��_t� .� Nancy Mathew September 8. 1986 Renton City Council MiniL) Page' 4 Dangerous Lee Ford, 372 Stevens Avenue SW, registered a complaint regarding Intersection - safety hazard at the intersection of Stevens and Sunset Boulevard SW, Sunset SW/Stevens near the CHG International "Sunpointe" development. He reported that as SW a result of high traffic volumes and impaired sight distance caused by steep grade, trees and signs, left turn movements onto Sunset are extremely dangerous as evidenced by numerous accidents in that location. He requested that the traffic signal installed by the developer at the intersection be activated from current blinking mode. Mayor Shinpoch indicated that the State will not activate the signal on that State route unless warranted by traffic volumes. Mr. Ford noted that many motorists avoid the intersection by taking detours, but felt that volumes would be much higher if the intersection were functional. Joan Walker, 1433 Monterey Avenue NE, agreed that if the State . activated the traffic signal, drivers would use the intersection at Sunset instead of detouring to Hardie Avenue SW behind Renton Shopping Center. Don Neuman, 380 Stevens Avenue SW, expressed concern for the safety of children bicycling and walking on streets in the area. Mayor Shinpoch indicated that she would investigate the matter to determine whether volumes and number of emergency responses at the intersection meet State requirements to activate the signal. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on July 23, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on July 29, 1986, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by, the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documentation relative to this request. Exhibit #2 - Site Plan. Testimony was given by Roger Blaylock, Zoning Administrator, regarding background information for this project. He stated the site is 0.46 acre in size, with a portion of the site currently occupied as a leased parking lot by an adjacent bank. There is approval for a professional office building on the site; the zoning was first applied in 1953, and public utilities are available to the site. Mr. Blaylock reviewed the comments received from staff noting there'were none opposing this project; the property is located in an area of transition; surrounding uses are commercial , and this proposal can be compared , to the Blencoe project on an adjacent site to the east. Continuing, Mr. Blaylock reviewed the four criteria necessary to meet the requirements of a rezone. The proposal does not comply specifically with the Comprehensive Plan but is supportive of other policies that suggest compability with other uses and transitions. The focus of the area was changed when the hospital was relocated to another area in 1968 and the K-Mart Shopping Center was constructed. Mr. Blaylock stated the office to the east of the site supports the trend toward a professional activity. Thomas W. Gordon R-056-86 August 7, 1986 Page 2 Referring to parking on the site it was pointed out initially there was concern regarding the use of the parking lot and the combined leased parking with the bank. It is felt the site will have to be redesigned to incorporate this parking. One other concern was the transitional nature of the area, making the transition from office to commercial a sensitive area. Because of this concern, it is suggested by staff that site plan review be required even though the size of any building placed on the property may be less than that permitted in the site plan ordinance. In conclusion, Mr. Blaylock recommended the Examiner recommend approval to the City Council subject to Site Plan approval on any size building. Calling for testimony in support of this application from the applicant or his representative, responding was: Thomas Gordon, 400 Securities Building, Seattle, Washington, 98101 . Mr. Gordon stated he is requesting the rezone in order to bring the property into compliance with the Comprehensive Plan. He clarified the surrounding uses in the area stating a school and church are several hundred feet from the site, with a clinic located on the Blencoe site. He had no further comments at this time. There was no one else in the audience wishing to testify in support of or in opposition to this proposal . There were no further comments from staff. The hearing closed at 9:25 A.M. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1 . The applicant, Thomas W. Gordon, representing Dr. John S. Vukov, filed a request for approval of a rezone of approximately .46 acres of property from P-1 (Public/Quasi-Public) to B-1 (Business/Commercial ). 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1 . 3. The Environmental Review Committee (ERC), the City's responsible official , issued a Declaration of Non-Significance (DNS) for the subject proposal . 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal . 6. The subject site is located on the north side of South Third Place, just east of Rainier Avenue S. The parcel is located in the 200 block of S. Third. 7. The subject site is part of the original townsite for the City of Renton. The site was zoned P-1 , it's current classification, with the adoption of the original zoning code in 1953. • 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of public and quasi-public uses, but does not mandate such development without consideration of other policies of the Plan. 9. The subject site is currently utilized as a parking lot for some adjoining businesses. Other than the parking use, the site is vacant. 10. The subject property is one lot removed from Rainier Avenue and is surrounded by K-Mart to the south, First Interstate Bank and a former spa on the north, with a donut shop to the west. Thomas W. Gordon R-056-86 August 7, 1986 Page 3 11 . A rezone was recently approved for the property immediately abutting to the east. The rezone was to B-1 . 12. The property to the south, now the K-Mart store, was originally the site of the Valley General Hospital , or predecessor institution. The hospital was moved to the vicinity of Talbot Road S. and S.W. 43rd Street. Some smaller clinics which were established near the old hospital site remain. St. Anthony's School is also located in this area. 13. The P-1 district in which the site is located is an 'L' shaped area containing some of the smaller properties north and east of the old hospital site. St. Anthony's is also located in this district. CONCLUSIONS 1 . The proponent of a rezone must demonstrate that the request is in the public interest, that it will not impair the public health, safety and welfare, and in addition, complies with at least one of the criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved. 2. This decision parallels the earlier Blencoe Rezone (File No. R-001-86). That site adjacent to the subject site was similarly zoned for P-1 uses although the reason for P-1 zoning in this area appears to have generally disappeared with the relocation of the hospital . 3. While the map element of the Comprehensive Plan designates the site for public and quasi-public uses, the site is on the edge of the area so designated. And, like the Blencoe site, it is surrounded by B-1 zoning on all sides. The Comprehensive Plan designates these adjoining lots for B-1 uses. The designation on the map therefore, should be weighed against the additional factors and elements of the Comprehensive Plan. 4. At one time the site was across the street from Valley General Hospital , and as such, the site and adjacent uses provided locations for supportive services like nearby clinics. That narrow focus is no longer appropriate, the hospital has relocated and restricting the site to P-1 zoning is unreasonable - it unreasonably restricts the applicant's development potential . Also, the permitted uses in the P-1 zone have been narrowed. Where once any type of office could locate, now only professional medical offices are permitted. Again, to review, K-Mart is located south of the site and a bank and spa site are located to the north, with a fast food donut shop immediately west. It no longer seems an appropriate location for either a governmental complex, also permitted in the P-1 zone, or medically allied services. 5. Restricting the site therefore, to either governmental services or medical services is no longer justified, and the City Council should reclassify the subject site to B-1 . 6. While it does not seem necessary to limit the range of uses on the site, the Council might want to consider that option. What should be required is Site Plan review to assure any development on this site is compatible with the area. Thomas W. Gordon R-056-86 August 7, 1986 Page 4 7. As this Office commented in the Blencoe Rezone: "This Office generally does not comment on the policy aspects of the Comprehensive Plan, but as this recommendation indicates, the designation of this area for P-1 uses may no longer be appropriate, and the City Council and Planning Commision may want to review the designation. For now at least, any requests will , as usual , be handled on a case-by-case basis, comparing the site, the map designation and the policies and goals of the Comprehensive Plan. " 8. As indicated above, the City Council should approve the rezone request. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council . All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as Appeals to the City Council . For purposes of these decisions and recommendations the terms "Should" and "Shall " are to be considered mandatory. The term "May" will be considered discretionary. Various City departments have reviewed the rezone request as proposed. The - - Police Department and the Fire Prevention Bureau along with both divisions of the Building and Zoning Department have recommended approval without conditions. The other departments recommended approval with conditions with the following comments: • Utilities Engineering Division: Approved with conditions. 1. Rezone only. System development charge for water and sewer both applicable. Total amount: $1,616.96. 2. Subject to Fire Marshal comments. • Policy Development Department: Approved with conditions. 1. Although the subject site is an area designated Public/Quasi-Public on the Comprehensive Plan, we would support the rezone request to B-1 for the following reasons: a. The property is located in an area of transition between Public/Quasi-Public and Commercial on the Comprehensive Plan. b. The P-1 zone has become more restrictive since the category was amended to narrow the range of professional uses to medical in March 1983. c. The surrounding land uses are commercial in nature. 2. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was part of. the original township of the City of Renton. The site itself has not been considered specifically in the public hearing process since the P-1 zone was placed on the property with the adoption of the Zoning Code in 1953. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The Comprehensive Plan suggests the area to Public/Quasi-Public. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. The area has gradually being redeveloped 'to commercial uses. The K-Mart shopping center was constructed in 1968 after the Renton Municipal Hospital was relocated to South 43rd Street and Talbot Road. The 'development to the west and north has also been towards commercial uses.. 'A professional office building is proposed to the east to the east . of the subject site. This will support the existing professional building that is located to its east. _.. _ _ The need for supportive public or quasi-public uses is no longer appears appropriate in this area. The 'probable development pattern for the area 'would be to have commercial uses along Rainier Avenue South with transitional professional office uses buffering the churches and elementary school . located to the west. d. Timeliness: The final test to determine whether the rezone is appropriate is to address the question of timeliness. Public services and changes in the general development pattern of the vicinity' suggest it is appropriate and timely to consider the rezone request. 5. The staff at an early stage raised the issue of whether the subject site was actually required parking for adjacent developments. Based upon information provided by the applicant, it appears that only ten parking spaces located at the north end of the lot are leased to First Interstate Bank. These do not appear to be required under the limitations of the Parking and Loading Ordinance but are provided for convenience to the bank. 6. Another issue that arises is whether a rezone request to B-1, Business Use, is appropriate for the subject site because it will allow all retail activities. The most intensive commercial developments such as a drive in restaurant or bank •could create a problem with traffic congestion and access. Access is solely from South Third Place. South Third Place also functions as an access street to the K-Mart shopping center located to the south of the subject site and the public/quasi-public uses to the east of the subject site. A full retail use could impact the lower' intensity public and medical office uses in the neighborhood. Since this is the interface between those two types of uses it could be appropriate that site plan approval be required for any size building located on the subject site. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the Hearing Examiner recommend to the City Council approval of the rezone request, file R-056-86, for Thomas W. Gordon with the condition that restrictive covenants be required that require site plan approval before the Hearing Examiner on any size of building. The owner's also own 111 South 3rd, east of the vacant parcel. The current zoning of the vacant parcel is P-i dating back to before 1953 and the current compre- hensive plan designation is P-1, revised January, 1980. It is our desire to build a professional office or retail building on this presently vacant parcel of land. To do so, we must request that the property be re-zoned from P-1 to B-1 for this purpose. It is our contention that this proposed zoning better reflects the existing development of this area. An environmental impact statement (EIS) must be prepared for allproposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required. Instructions for Applicants: This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge.
