Responding to Council concerns regarding cash flow to fund construction of community center when funds from sale of Mother's Park will not be received until the end of 1989, and possible default by purchaser, Mayor Shinpoch and Administrative Assistant Michael Parness indicated that although the transaction is not risk free, a thorough financial background investigation has been done and determination made that the contract is financially viable. BUILDING & ZONING The Building & Zoning"Department Report was received DEPARTMENT REPORT: by the Examiner on October 1, 1986 PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on October 7, 1986 at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Assessors Map. Exhibit #3 - Site Plan Map. Exhibit #4 - Elevation drawings. The hearing opened with a presentation of the staff report by the Zoning Administrator, Roger Blaylock. In his review of this request, Mr. Blaylock advised the site is 6.4 acres in size; currently zoned G-1; is located in the close vicinity of Valley Medical Center; there is currently a building on the site that has been utilized as an office for the last 12 years by several attorneys and staff. The building is to be replaced with a newly proposed 3000 sq. ft. structure; the conditional use permit is • requested to permit a business use in the P-1 zone, which is allowed by City Code; services are available to the area, with major water and sewer improvements having been made within the last five years; applicant has granted an additional 10 ft. easement to the City for the widening of Talbot Road South with the easement being held by the Public Works Department until the land use issue has been resolved. Mr. Blaylock also stated the applicant is paying a trip generation fee for general improvements to S.W. 43rd Street; reviewed the various City departmental comments for the proposal; the request complies with the Comprehensive Plan goals and policies; rezoning on this site has not been reconsidered since 1968; and stated the hospital and supporting facilities around the hospital are changing, with the desire for more commercial uses to support the hospital. It was pointed out the law practice is to continue to supply legal support to the doctors and patients within Valley Medical Center, dealing with personal injury matters. The Zoning Administrator continued stating it is believed this rezone request is timely, and recommended the Examiner recommend approval to the City Council. He continued with a review of the Conditional Use request. The Conditional Use request is to permit a B-1 use in a P-1 zone. Staff felt the applicant has addressed all of the criteria to be considered for a request of this type; the proposal is not creating a new use in the area; the structure itself is one-story and will not be intruding into the character of the surrounding neighborhood; access will not change with an easement being provided to the city to permit the expansion of Talbot Road, and the applicant will provide the off-site improvements along ARTHUR D. SWANSON R-059-86 & CU-060-86 October 14, 1986 Page 2 the frontage of the property, meeting all City standards. Mr. Blaylock stated it is staff's recommendation that the Conditional Use request be approved. The Hearing Examiner called for testimony in support of this proposal from the applicant or his representative. Responding for the applicant was: Todd Gardner, 4512 Talbot Road South, Renton, Wa. 98055. Mr. Gardner advised he is one of the attorneys occupying the building presently on the site; the property was annexed by the City in 1978; the proposed new building will replace the current structure and it is anticipated there will be no addition to the current staff. Mr. Gardner stated the current building is simply too small for the current staff and is in need of major repairs inside and out - hence their desire to replace the complete structure with one that will add to the enhancement of the community. He stated there will not be any additional traffic generated; feels they are adjunct to the medical profession in the area representing victims of negligent activities, primarily automobile ;' accidents, with most of their clients being treated by medical personnel on surrounding sites in the immediate area. Mr. Gardner stated it is felt the building design is compatible with the surrounding buildings; and clarified that the comments contained in the report from the Traffic Engineering Department with regard to design concerns have now been taken care of and that department is now expressing support for this request. In,closing, Mr. Gardner stated the applicant is requesting the rezone and conditional use to permit them to continue the same business they have had on the site for the.past 12 years and to do so in a newer building, using the same number of staff they have used to serve the same type of clientele they have always had. He had no further comments. Testifying for the Renton Police Department was: Lieut. Claude Evans, 200 Mill Avenue South, Renton, Wa. 98055. Lieut. Evans stated the Police Department wanted to go on record recommending approval of this proposal as it is felt there will be no affect on fire or police services, and felt the improvements that will be made will be an upgrade as compared to what now exists on the property. The Examiner called for further testimony regarding this project. There was no one else,wishing to speak, and no further comments from staff. The hearing closed at, 9:25 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the.following: FINDINGS: 1. The applicant, Arthur D. Swanson, filed requests for approval of a rezone of approximately .64 acres of property from G-1 (General; Single Family Residential; Minimum lot size - 35,000 sq ft) to P-1 (Public/Quasi-Public), and approval of a Conditional Use Permit to allow a B-1 (Business/Commercial) professional office use in a P-1 zone. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a declaration of non-significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located at 4512 Talbot.Road South. The site is on the east side of Talbot, just south of the S.W. 43rd Street intersection with Talbot Road South. 7. An existing small office building is located on the site and currently houses the applicant's existing law offices. The applicant has had law offices at the site for approximately 12 years. The applicant's practice is mainly devoted to representing personal injury victims, and as-the applicant indicated, many of his clients use the Valley General Hospital and nearby doctors. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of public and quasi-public uses, but does not mandate such development without consideration of other policies of the Plan. 9. The subject site was annexed into the City with the adoption of Ordinance 2394 enacted in March, 1968. The site was automatically classified G-1 upon annexation. 10. The site immediately south of the subject site is zoned P-1, the category requested by the applicant. North of the site is a large medical complex on property zoned R-3. Immediately across the street is a large P-1 site. A relatively small parcel of G-1 zoning is located south and west of the subject site across Talbot Rd, while much of the property south of the immediate area is still zoned G-1, and is sparsely developed. !/, ARTHUR D. SWANSON R-059-86 & CU-060-86 October 14, 1986 Page 3 11. This area not only contains the Valley Medical Center, but a large array of medically related clinics and support facilities. Professional offices were approved by conditional use for the P-1 property across Talbot in the One Valley Place complex. 12. Water and sewer services have been upgraded within the last few years by the City, to serve this area. A major LID is pending for improvement of the Talbot/S.W. 43rd intersection. 13. The new building will be slightly larger than the existing structure, approximately 2,990 feet in total. The building will be a single story, approximately 16 feet tall. The exterior treatment will consist of wood and brick walls. Existing landscaping along the frontage and along the south half of the lot will be maintained. Supplementary materials will be added in and around the new construction. CONCLUSIONS REZONE 1. The proponent of a rezone must demonstrate that the request is in the public interest, that it will not impair the public health, safety and welfare, and in addition, complies with at least one of the criteria found in Section 4-3010 which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or • b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved by the City Council. 2. The P-1 zoning requested is compatible with the Comprehensive Plan for the area. The Plan generally calls for development consistent with the functioning of a regional medical complex. Valley Medical Center and a substantial number of allied services have congregated around the Talbot Rd. and S.W. 43rd intersection. The P-1 zoning proposed not only complements these functions, but also simply expands the area covered by this P-1 district. The request assists in continuing the homogeneous character of the area. 3. The utility' infrastructure has recently been upgraded to allow new uses and to allow the expansion of existing uses without taxing the system. Roadway improvements are planned, and an LID should accomplish needed intersection improvements to this critical area. •4. The site itself has not been previously reviewed for reclassification and it appears timely to do so. Rezones similar to that requested have been approved for property north of the subject site and also west, across Talbot. In addition, P-1 reclassifications have also occurred north of S.W. 43rd Street. The proposal, therefore, continues the conversion of some of the more hospital focused property to compatible zoning. CONDITIONAL USE PERMIT 5. The applicant for a Conditional Use Permit must demonstrate that the use is in the public interest, will not impair the health, safety or welfare of the general public and is in compliance with the criteria found in Section 4-748(C) which provides in part that: a. 'The proposal generally conforms with the Comprehensive Plan; b. - There is a general community need for the proposed use at the proposed location; c. There will be no undue impacts on adjacent property; d. The proposed use is compatible in scale with the adjacent residential uses, if any; e. Parking, unless otherwise permitted, will not occur in the required yards; f. Traffic and pedestrian circulation will be safe and adequate for the proposed project; g. Noise, light and glare will not cause an adverse affect on neighboring property; h. . Landscaping shall be sufficient to buffer the use from right-of-ways and neighboring property where appropriate; and ARTHUR D. SWANSON R-059-86 & CU-060-86 October 14, 1986 Page 4 i. Adequate public services are available to serve the proposal. The requested conditional use is warranted for among other reasons, continued, identical use of the subject site by the applicant for his compatible professional offices for the last 12 years 6. While the map element of the Comprehensive Plan suggests that the area be used for P-1 uses, the plan also indicates that services supporting the medical complex are also suitable for this area. Additionally, the zoning code permits professional offices, such as the attorney's proposed offices, to be located within a P-1 district. 7. The existence without problems of the identical use in this area demonstrates community support for the use. In addition, the applicant's legal practice is comprised almost exclusively of personal injury accident victims. Many of the applicant's clients are served by both the hospital itself, and by physicians located near the hospital. 8. The new building appears designed to blend with the area. It will be one story, finished with wood and brick exterior, and well landscaped. It will replace an older, more shabby structure, and should not have any undue impacts. The building will provide additional 'elbow room' for the current personnel but will not provide space for additional personnel, thereby holding constant such factors as traffic. 9. There is currently a trend away from the scattered single family homes in the immediate vicinity of the Talbot/43rd intersection, but again, the modest size and exterior treatment will enable the facility to blend with surrounding uses, whatever they may be. 10. Sufficient parking for personnel will be provided on-site and adequate client parking will also be provided. The 14 stalls are sufficient for the proposed use. 11. The applicant's agreement to provide funding for the intersection improvements, when coupled with the fact that the existing use has not created any traffic difficulties, appears to satisfy the provision that safe traffic circulation will be provided. In fact, the payment assessed for traffic is welcomed since the applicant is not changing the existing traffic impacts of the site. The site is only being modified and will not modify existing traffic generation for the site. 12. Again, the modernization of the structure on the subject site will not in any way modify the impacts on adjacent property. Noise, light and glare do not appear to be substantially different from that already on the site, that is negligible. 13. Existing landscaping will be preserved and supplemented. An expansive lawn area with scattered trees will be preserved. The entire frontage, with the exception of the 24 foot driveway, will be landscaped to a depth of approximately 20 feet. 14. As indicated in the rezone discussion above, the utility and roadway infrastructure is, or will be, adequate to support the proposed use. 15. Once again, the proposal is simply to remove an old shabby structure, and replace it with a slightly larger structure. Therefore, the use, number of personnel, traffic, and demands on services should not radically change, if they change at all. The City Council should approve the rezone as compatible with the zoning in the area, and the Conditional Use Permit is approved. RECOMMENDATION The City Council should approve the reclassification of the subject site from G-1 to P-1. The B-1 use is being requested under provisions of Section 4-748(D)2a. 4. The Valley General Hospital area is under increasing development pressure. Several previous office development proposals have fallen by the way side. Presently the City has four applications pending for development. Not only has the development interest increased in the area, but there has occurred a general shift in type of use. The Southeast Renton Plan was adopted on January 28, 1980 by Ordinance No. 3389. Since that time, the function of Valley General Medical Center has been changing as a result of economic pressure in the hospital industry. The hospital itself now provides support activities including functions such as hotel, banking and general health counseling programs. Many of the support functions that would have been normally associated in the area around the hospital are now included directly in the hospital complex. Doctors have still tended to locate around the hospital for convenience of both their patients and themselves in their interacting role with the hospital. The entire issue of the function of the Valley General Hospital and its surrounding environment has not been re-evaluated by the Policy Development Department, the Planning Commission or the City Council. A major land use issue appears to surround the change in the function of the hospital. ISSUE: HAS THERE BEEN SIGNIFICANT CHANGES IN THE GENERAL DEVELOPMENT AND FUNCTION OF THE VALLEY GENERAL HOSPITAL AND ITS SURROUNDING AREA TO PROMPT A CONSIDERATION TO ALLOW GENERAL OR MEDICAL SUPPORT OFFICES UNDER THE INTENT OF THE COMPREHENSIVE PLAN? The applicant instead of aurguing this issue has approached the problem by utilizing the conditional use provisions along with zoning reclassification request. The is divided into the rezone request and the conditional use permit request-. REZONE: 5. The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification to the City Council. The following evidence demonstrates that the rezone request is appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed into The City in March of 1968. The site has not been consider for a reclassification of zoning since annexation. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The proposed rezone request to P-1, Public Use, is in direct conformance with the Comprehensive Plan land use map designation of Public/Quasi-Public. r � PRELIMINARY REPORT _ _ THE HEARING EXAMINER ARTHUR SWANSON/R-059-86/CU-060-86 OCTOBER 7, 1986 Page 5 c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. During the last five years, development surrounding Valley General Hospital has dramatically changed. Medical office buildings have been constructed north of the subject site in King County and in the City of Renton. Planned public improvements including arterial street reconstruction suggest that the development of the site may be appropriate. d. Timeliness: The final test to determine whether the rezone is appropriate is to address the question of timeliness. Public services including water, sewer, and storm drainage are available to the site. The issue of traffic circulation and access to the site is the major concern that has been addressed as part of the environmental review process. CONDITIONAL USE: 6. The applicant has prepared a very detailed analysis of the application of the conditional use criteria for the project proposal. The Building and Zoning staff agree with the logic an conclusion reached by Mr. Swanson. First, it is supportive of the medical profession and the hospital facility. The community need has been demonstrated over last 12 years with the operation of Mr. Swanson's business on the subject site. The proposed building is not intrusive to the area in either bulk or style. Access to the site and traffic generation were found to be at acceptable levels if mitigated according the the Environmental Review Committee's decision. 7. In conclusion, the application prepared by Mr. Swanson, clearly shows that ' both the rezone and condition use permit requests are appropriate. H. DEPARTMENTAL RECOMMENDATION: Based upon the above analysis, it is recommended that the rezone request, File Number R-059-86, be recommended for approval to the City Council. It is further recommended that the conditional use permit request, File Number CU-060-86, be approved by the Hearing Examiner subject to the approval of the City Council of the rezone request. The left turn movement is needed on Talbot Road and is needed.. now at the intersection of 43rd St. and Talbot. However, the need for it extending as far south as your property, is futuristic at this time, but the City is required to prepare for the future if the need is addressed. Comprehensive Plan: The proposed use shall be compatible with the general purpose, goals , objectives and standards of the comprehensive plan, the zoning ordinance and any other plan, program, map or ordinance of the City of Renton. Arthur D. Swanson has been practicing law at this location since 1974. This office specializes in personal injury law, representing individuals who have been injured as the result of another ' s negligence . A major part of the practice involves meeting personally with physicians and other health care professionals who have treated our clients for their injuries . On many occasions the treating physicians are located in buildings adjacent to or within the general area of the law office. Our location enables our clients to obtain health care and legal services in the same geographic area. ( 1 ) Lot Coverage : Lot coverage in residential districts (R-1 and R-2 ) shall not exceed fifty percent ( 50%) of the lot coverage of the zone in which the proposed use is to be located. ( 2 ) Yards : Yards shall conform to the requirements of the zone in 'which the proposed use is to be located. Additions to the structure shall not be allowed in any required yard. (3 ) Height : Building and structure heights shall conform to the requirements of the zone in which the proposed use is to be located. Spires , belltowers , public utility antennas or similar structures may exceed the height requirement upon approval of a variance . Building heights should be related to surrounding uses in order to allow optimal sunlight and ventilation, and minimal obstruction of views from adjacent structures . This building shall not result in any substantial or undue adverse effects on adjacent property. As can be seen from the drawings the proposed structure clearly meets the lot coverage requirements and yard requirements . The building itself will be 19 feet 8 inches at its highest point which easily conforms to the structural requirements . d. Compatibility: The proposed use shall be compatible with the residential scale and character of the neighborhood. -2- As can be seen from the drawings ," the building ' s design is residential in nature. The design is somewhat similar to a building near Valley General Hospital and adjacent to the Chin Hills Building recently constructed by Dr. Eugene Brain. The building is compatible with the residential scale and character of the neighborhood and shall in fact enhance the character of the neighborhood. The appearance of the new structure will be a tremendous improvement over the appearance of the current building. e. , Parking: Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five percent ( 75%) of the lot coverage requirement, of the zone in which the proposed use is located if all parking is provided underground or within the structure . The number of parking spaces required by a building of this size is rather limited. The parking spaces as set forth in the preliminary drawings meet the zoning requirements . f . Traffic : Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be reviewed for potential effects on, and to ensure safe movement in the surrounding area. The traffic patterns for vehicles and pedestrians for the new building shall be identical to the traffic and circulation patterns of vehicles and pedestrians for the existing building. The new building shall not result in additional attorneys nor increase the size of the law office ' s practice . The additional size of the building is simply to accomodate the physical needs of the current office, rather than for expansion of the law practice itself . Traffic and circulation patterns of pedestrians will be enhanced by the extension of the sidewalk that will be completed as part of this project . g• Noise, Glare : Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the location of on-site parking areas , outdoor recreational areas and refuse storage areas . There will be no increase in noise, light or glare as a result of the proposed use. As noted above, the amount of pedestrian and vehicular traffic will be. the same as it is at this time and the building will in fact be set farther away from the road than the existing building. The materials from which the building are constructed will result in no additional light or glare in the neighborhood. h. Landscaping: Landscaping shall be provided in all areas not occupied by buildings or paving. The Hearing Examiner may require additional landscaping to buffer adjacent properties from potentially adverse effects of the proposed use . \ -3- The landscaping provided for this lot and new building shall exceed the landscaping requirements . The amount of ground left uncovered by paving shall be greater than it is for adjoining lots , enhancing the neighborhood. The building shall not result in any adverse effects , so there is no need for additional landscaping to act as a buffer. i . Accessory Uses : Accessory uses to conditional uses such as day .schools , auditoriums used for social and sport activities , health centers , convents, preschool facilities , convalescent homes and others of a similar nature shall be considered to be separate uses and . shall be subject to the provisions of the use district in which they, are located. This provision does not apply to this application. j . Conversion: No existing building or structure shall be converted to' a conditional use unles such building or structure complies , or is brought into compliance, with the provisions of this Chapter. Public Improvements : The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements , facilities, utilities and services . Swanson asks that his property identified in the enclosed site plans and drawings be re-zoned from G-1 to P-1. This property was annexed by the City of Renton on December 4, 1978 pursuant to ordinance #3268 . Since the date of annexation this property has been zoned G-1 . From December 5 , 1974 to December 4, 1978 the property was zoned RM900 by King County. Prior to December 5, 1974 it was zoned SR. Arthur D. Swanson has been practicing law at this location since 1974. The reclassification requested was not specifically considered at the time :of the last comprehensive plan land use analysis . Since the date of annexation there have been significant changes in this general area. Much of the area is zoned P-1 , including most of the land surrounding the Swanson property. The Springbrook property was recently re-zoned "Office Park" which indicates that responsible development has been approved in this, general area.
