BUILDING & 'ZONING The Building & Zoning Department Report was received DEPARTMENT REPORT: by the Examiner on January 13, 1987 PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on January 20, 1987 at 9:20 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Site Plan showing one acre plaza. Exhibit #3 - Utility drawing showing sewer and water lines. The hearing opened with a presentation of, the staff report by the Senior Planner, Jeanette Samek- McKague, at which time she noted such information as building #1 is completed and occupied, building #2 is nearing completion; the property is divided into 4 lots with lots 1 and 4 being developed and lots 2 & 3 so far undeveloped but covered by a Special Permit to fill the site. Zoning on the property is O-P which encourages landscaped and open space areas, which was the the rationale for the requirement of a one acre plaza when approval was given for building #2. Continuing, Mrs. Samek-McKague stated this request is to permit the applicant to construct the plaza in two phases which would place phase 1 on lots I and 4, with only one-half of the proposed pool being constructed at this time. The applicant had raised several points with regard to not completing the southern portion of the site such as the construction of the southern portion of the plaza would interfere with the fill and grade permit on the southern two lots; would interfere with the installation of utilities to be placed on the two lots in the future; construction of buildings 3 and 4 would hinder the use of the plaza as a result of construction trucks entering and leaving the site as well as dust and noise, making the use of the plaza less desirable; the applicant feels their design for the future on phase II may change from previously presented plans thus placing a financial burden on the applicant. She continued with a review of departmental comments noting Policy Development recommended the plaza be constructed in its entirety at this time, with mitigating measures for workers in Phase I and II being provided for recreation should the ERC accept the applicant's request for postponement. Design Engineering Department commented that the pool would be built over a utility easement granted to the City and requested the City be granted relief should repairs to those lines become necessary; and Traffic Engineering requested bonding be provided to insure the completion of the plaza at some reasonable point in time in the future. With the above information, Mrs. Samek-McKague stated it was staff's recommendation that this request be granted subject to the four conditions set out in the staff report of January 20, 1987. ' VALLEY OFFICE AND INDUSTRIAL PARK SA-101-86 February 3, 1987 Page 2 The Examiner called for testimony in support of this proposal from the applicant or their representative. Responding was Steve Southerland, Proiect Manager, The Austin Company, 800 - 16th Street. Renton, Washington, 98055. He began with comments on recommendations of staff stating the Austin Company will complete the north half of the plaza with the occupancy of Phase II which is anticipated to be completed in March, 1987; the southern most pool has been constructed in such a way that it can be extended; they are dedicated to completion of the southern half of the plaza with the completion of phases 3 and 4 as stipulated by the short plat, and the 5 year limit is an acceptable alternative if phases 3 and 4 are not implemented in the future. Referring to the occupancy projections, Mr. Southerland stated the figure of 2740 is the maximum number of persons that could be placed within the buildings and still comply with City codes; feels the design of the northern half of the property was set out to work with the 2 buildings already developed; and feels the continuation of the plaza at this time does not lead to what is felt to be a balanced design, hence their desire to complete the other half of the plaza in the next phase of the project. Speaking to utilities, Mr. Southerland pointed out Austin Company will work with the City as to the protection of the utility easements but noted that the current design for the pools is a result of a redesign after discussions with the city's Engineering Department. He presented Exhibit #3 and reviewed the easements for the Examiner. He pointed out the portions of the sanitary sewer line that fall beneath the northern and southern most pools; and stated he did not feel a bond was needed to guaranty completion as the site plan stipulates the completion of the plaza and a bond could not guaranty or make any more of an assurance this would be completed. He stated phases III and IV may not go forth if the occupancy load is not present to prompt moving ahead - in that case, it is felt the remaining portion of the plaza would not be necessary. He concluded stating it was possible the five year time frame may not be adhered to if the occupancy figures do not justify moving ahead with the project, which would also mean the plaza would not be completed. Also wishing to testify on behalf of the applicant was John Keegan, Attorney at Law. 1501 4th Avenue, Seattle, Washington. 98101. Mr. Keegan reviewed the requirement and rationale for the one acre plaza from the approved plat of July, 1985; stated it is felt the one acre plaza mitigation measure request should be reviewed again as a measure to be completed only if all four lots are developed. If only two lots are developed, then he felt a one-half acre plaza would be sufficient to meet the needs of the developed area. The Examiner pointed out this mitigation measure was probably required to insure the plaza would not be developed in some undeveloped portion of the site and be so aesthetically undesirable it would not be used. Mr. Keegan assured the Examiner this will not be a wasteland plaza, and stated it is their desire to work out a time frame for completion of a design and full amenity-type plaza. Speaking to the projected number of employees, he indicated at full use of the first two buildings a projection of 1400 employees has been made. Referring to departmental recommendations he stated they are in agreement with condition #1; condition #2 they would like to see terminate at the wording "phase IV", but would accept the condition as stated if staff still feels the necessity for a specific time period; condition #3 they feel is beyond the scope of this re-examination request for the south half of the plaza as the condition deals with the north half of the plaza and is outside of the issue of timing and design. The Examiner wanted clarification as to just what this application is requesting and Mr. Keegan stated it is their belief they have presented an application for amendment to the decision of May 16, 1986, condition #2, which addresses the construction of the complete one acre plaza to coincide with the occupancy of this phase of development of the Short Plat. He stated it is that condition the applicant is asking to be amended to incorporate the language contained in conditions 1 and 2 contained in the staff report of January 20, 1987. He stated the applicant is willing to keep working with the City on the easements, and advised their concern over condition #4 which now seeks a bond to assure completion of the south portion of the plaza stating the bond was not needed to complete the whole plaza and now is being sought for just the south half of the plaza. He feels a bond is not required as the City has leverage over this proposal in the permit processes, and stated if the City is determined to tie down the location of the second half of the plaza they would agree to a requirement for an easement showing its location. He concluded stating it is still the intent of the applicant to have a symmetrical plaza. Speaking again was Steve Southerland referring to the proximity of the plaza to the fill site and stating it is felt they have tied the southern edge of the plaza into the northern half of the property. Closing, Mrs. Samek-McKague reiterated it is the feeling of staff that this proposal should have a time frame for completion and recommended the five year period in condition #2 stand, but possibly add an addendum to that condition stating the applicant could seek additional review by the City if not completed in the five year period. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 10:05 A.M. r) • / • • ' VALLEY OFFICE AND INDUSTRIAL PARK SA-101-86 February 3, 1987 Page 3 FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Valley Office and Industrial Park, filed a request for approval of a Site Plan to modify the timing of the installation of a portion of a required one (1) acre plaza which was required as part of the approval of the Site Plan for Valley Office Park II, the second phase of a proposed four phase project. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located more or less in the center of the block bounded by S.W. 16th Street on the north, East Valley Road on the east, S.W. 19th Street on the south and Lind Avenue S.W. on the west. 6. The site is a composite one acre area consisting at the current time of portions of the abutting interior corners of the four lots of Short Plat 022-86. That plat required on its face the creation of a one acre plaza which could and would be shared by each of the lots as part of a proposed Office Park. The buildings of the first two phases are complete, with office buildings located on Lots 1 and 4. Occupancy for the second building is not yet finalized. Those two lots, 1 and 4, are located on the northern half of the short plat. The approval of the Phase II development required the completion and installation of the entire plaza with the occupancy of Phase II. Phase II is almost complete and the applicant has only constructed the northern half of the required plaza. 7. The applicant has proposed modifying the scope, or more particularly, the timing of the plaza construction to include only those elements of the design located on Lots 1 and 4 and to exclude those .portions proposed to be included on Lots 2 and 3. As proposed, the plaza would include landscape elements, paving materials, two pools containing fountains, and a portion of a third pool. The third pool originally designed to straddle a common property line between Lot 4 on the north and Lot 3 on the south, has been constructed with a "break-out" wall to enable the pool to be enlarged as originally envisioned. 8. The applicant cited a number of factors to justify modifying the proposed phasing of the plaza. The applicant believes that the filling and grading of the two southerly lots would interfere with the use of the plaza, that the movement of soils and heavy equipment, as well as on-going construction of the two additional office buildings may harm or damage the plaza and especially the pools, that funding was not anticipated for the additional work and that design changes may occur for the latter two phases which would require modifications to the plaza design. 9. Public Works staff indicated that portions of the plaza, and particularly the pools, are located over utility easements containing water and sewer lines. They have suggested that the City be held harmless if portions of the plaza must be disturbed should access to those lines ever become necessary. These were factors which were known or should have been anticipated prior to construction. The plans for both the plaza and utility lines were approved by Public Works and it would be inappropriate at this stage to modify those particulars. This office suggests that any future plans receive careful consideration regarding the placement of the more permanent features, such as additional pools and fountains, but will not intervene in those aspects of the plans already constructed. 10. Staff recommended that the remaining portions of the plaza be completed and bonded, and such construction be concluded within fives years no matter what additional development activity occurred on the site. The applicant agreed that this would be an acceptable condition if their request to delay completion of the southerly half of the plaza were approved . CONCLUSIONS 1. Although this office is not entirely convinced as to certain aspects of the applicant's request, when coupled together, the various factors appear to warrant the relief sought. None of the factors taken alone appear sufficient to justify delay and some of the reasons are simply specious, but the request does not appear to adversely affect the public health, safety or welfare and will be approved. • VALLEY OFFICE AND INDUSTRIAL PARK SA-101-86 February 3, 1987 Page 4 2. The anticipated decrease in the resident employee population, obviously a factor in the applicant's analysis, has no apparent affect on the nature of the overall use of thersite and really is not a consideration under either the zoning or the Comprehensive Plan. This site is zoned for Office Park, and is similarly designated for Office Park in the Comprehensive Plan. The employee population has little bearing on the creation of open space, installation of landscaping and other amenities which marry to create the office park atmosphere mandated by Code. A park-like atmosphere and appearance is required in the O-P zone, and the employee population whether larger or smaller than projected should not affect those required amenities, at least not downward. Obviously, these amenities can add to employee satisfaction regarding their work environment, although overcrowding by a larger than projected employee enrollment could adversely affect enjoyment. The conditions imposed, therefore, relate to the zoning of the site. While SEPA permits the imposition of the aesthetic park-like conditions, the O-P zoning requires them. There is no change in conditions requiring the reduction of the plaza's size. 3. The applicant indicated that the on-going construction activity would interfere with the use of the southerly portion of the plaza. This office cannot reasonably distinguish the anticipated affects on users of the northern half from those of.the southern half. Any difference in discomfort would be minor in degree, since both the north half of the plaza and the south half abut each other and the undeveloped lots. Any discomfort probably would be equally obvious in either location, and the differences insignificant. 4. Similarly any subsidence created by the deposition of fill material or the movement of heavy equipment would appear to be felt on both halves of the proposed plaza. This office is aware of the tremendous delicacy required to intermesh new construction with existing construction, it is done all the time. Sometimes damage does occur, but careful attention to detail can usually minimize the consequences. If the subsidence were an issue as contended, why are the utility lines already in place along the common property lines and even within the southerly lots? 5. The economic justifications are entirely without merit. The plaza was anticipated as a result of the short plat approval. Any improvements required of the current applicant would almost certainly be recouped by the applicant as later phases would be relieved of these additional costs. In addition, the applicant has let well over a year pass before officially raising these objections. 6. The potential for design changes provide insufficient grounds for modifying the existing plaza requirements. Obviously, the adjoining undeveloped southerly properties will already be somewhat constrained by the design of the two existing buildings and their inherent aesthetics or lack thereof. The plaza would no more or less stifle creativity than would this adjacent development. 7. While the arguments above would seem to suggest that alteration of the site plan is not appropriate, the timing of events and the flexibility inherent in the office park and site plan provisions would appear to offer sufficient latitude to delay installation of the southerly half of the plaza. In order to alleviate to some extent the potential noise and dust which may emanate from the southerly construction sites and to soften the rather sharp demarcation between plaza and void, the applicant shall plant additional landscaping materials along the southern boundary of the plaza and extending away from the plaza both 10 feet easterly and 10 feet westerly. This landscaping 'shall be of such nature and placed in such fashion as shall be necessary to achieve screening and filtering of the plaza from the dust and noise. The landscaping may be placed in large planter boxes or similar manner which would permit the landscaping to be utilized elsewhere when it is not needed for these purposes. 8. The original intent of this office in requiring the completion of the plaza was to avoid the potential of on-going construction immediately adjacent to the plaza. Creating the southern half together with the northern half would have moved the construction somewhat from the immediate vicinity of the northern half of the plaza, thereby preserving to some extent its utility. With the second half delayed, the southern edge will be subject to disruption at some future time. The additional landscape materials will at least help to achieve the original intent of screening the plaza from the construction. 9. In order to avoid continued disruption, and since -this office does not believe that the scope of review is limited, a commensurate commitment on the applicant's part to assure timely completion of the remaining plaza half is required. The remaining plaza shall be constructed in one phase, rather than in separate additional quarters. This next plaza phase shall include the entire southerly plaza, that is the remaining approximately half acre. It shall be completed prior to the occupancy of the third phase of development, but in any event not later than five years, whether additional construction on the remaining buildings has been accomplished or not. The applicant agreed that this would be an acceptable condition if the southerly half of the plaza were delayed as they requested. • ' VALLEY OFFICE AND INDUSTRIAL PARK SA-101-86 February 3, 1987 Page 5 10. This office believes that it is necessary to comment on the poor timing involved in this application, if only to avoid a similar situation in the future. The timing of the request is awkward since the applicant has already started procedures to permit temporary occupancy of the second building prior to fulfilling the terms of that site approval. That is, completion of the entire subject plaza was a precondition to occupancy. Again, to emphasize, it was an occupancy which was dependent upon the completion of the entire subject plaza. One has to wonder why the applicant waited this long to present changes which must be approved in order to avoid a delay in their occupancy. This office takes exception to such a request, and especially its timing. This office does not like being placed in the position of having to either approve the plaza changes or delay an almost completed project. The applicant was obviously quite aware of the situation and has placed this office in this unfair position. One has to additionally wonder how staff permitted the plans and construction to progress to this stage without requiring the appropriate plaza construction since if this request were rejected, occupancy would have been jeopardized. DECISION The modification requested which would permit the delay of the necessary improvements for the • southern half of the plaza is approved subject to the following conditions: 1. The applicant shall plant additional landscaping materials along the southern boundary of the plaza and extending both 10 feet east and 10 feet west from the actual southern edge of the plaza. This landscaping shall be of such nature and placed in such fashion as shall be necessary to achieve screening of the plaza and filtering from the dust and noise. The landscaping may be placed in large planter boxes or similar manner which would permit the landscaping to be utilized elsewhere when it is not needed for these purposes. 2. The remaining elements of the plaza shall be constructed in one phase which shall include the remaining approximately half acre. The plaza shall be completed prior to the occupancy of the third phase of development, or in five years, whichever event shall occur first. Construction shall occur whether additional construction on the remaining buildings has been accomplished or not. 3. The applicant shall post a bond to enable the City to accomplish plaza construction if the applicant should fail to carry out the above condition. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. DEPARTMENT ANALYSIS: 1. The applicant, Valley Office and Industrial Park. Inc., seeks site plan approval to modify the Hearing Examiner's conditions on completion of the one acre plaza with the development of Phase II of Valley Office Park II. The condition to be modified follows: "Construction of the entire approximately one acre plaza to coincide with the occupancy of this phase of the development of the Short Plat." The condition was imposed by the Examiner as a result of a site plan approval decision of Phase II of the Valley Office Park II on May 16, 1986. (See reference file SA-017-86.) The condition was required due to the limited recreational opportunities available in the area to meet the needs of the employees of the two buildings approved for Phase I and Phase II. In addition, the Office Park designation on the property intends developments to be in a park-like or campus setting. The plaza provides both passive recreation opportunities for employees but also ensures the project meets the intent of the Office Park designation. 2. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Memorandum of Concurrence was issued on November 12, 1986, by the Environmental Review Committee, the responsible official. 3. The applicant requests that construction of the plaza be done in two phases. The north half is proposed for completion by the time Phase II of Valley Office Park II is to be occupied. This would include all walkways, pools and landscaping. (See applicant's letter dated November 21, 1986.) The applicant, with the current request, is asking that construction of the south half of the plaza be delayed to a future date. Among the reasons cited were that construction of the entire plaza would: (1) interfere with the fill activity for permit SP-078-86 approved for filling lots 2 and 3 (future sites for Phases III and IV) of the short plat approved on the property; (2) interfere • with the installation of utilities for Phases III and IV (manholes, vaults, valve • Preliminary Report to the Hearing Examiner Valley Office & Industrial Park, SA-101-86 Public Hearing: January 20, 1987 Page 3 and meter pits, water and sewer lines, etc.); (3) construction of buildings III and IV would render the south half of the plaza unusable due to noise, dust, and safety considerations as well as pool damage due to settlement caused by the operation of nearby heavy equipment; (4) design considerations since the applicant has not guaranteed that they will follow the Master Plan developed for the site nor can they guarantee continuity of ownership; and (5),place a financial burden on the developer not anticipated for Phase II construction.' 4. The arguments set forth above under points 4 and 5 concerning design considerations and not being able to guarantee the completion of the Master Plan are not valid arguments for not constructing the entire one acre plaza. With respect to the design of the plaza, the applicant has provided a conceptual drawing of the plaza approved bond required by the Examiner for Phase II (see file SA-017-86). This plan can be modified through a request to the Hearing Examiner with respect to the second point; financial burden is not a valid reason for not installing the south half of the pool. 5. The applicant has, however, raised some valid concerns with respect to the impacts of construction (points 1 - 3) on the plaza. The half plaza seems sufficient to provide some recreational opportunities for the employees of the current buildings until such time that Phases III and IV are constructed. In additiion, the applicant has provided the Parks and Recreation Department with $10,000 to complete a master recreation plan for the Green River Valley in lieu of providing the actual off-site public recreation. This was a condition of the Environmental Review Committee. 6. A question arises as to the number of employees in the buildings for Phase I and II and the adequacy of the one-half acre plaza. The Examiner's report of May 16, 1986, indicated that up to 4,000 employees would be using the plaza, therefore justifying the construction of the entire plaza. The applicant's environmental checklists for site approval applications on Phase I and II (file SA-035-85 and SA-017-86) show an anticipated employee .level of 1,000 persons per building of the employees for every 1,000 sq. ft. of building. The applicant, in a letter dated September 19, 1986, states that if the number of employees was calculated at 1 per every 100 square foot of building, there would be approximately 2.740 employees. Further. the applicant noted that survey of the Phase I building and the soon to be completed Phase II building will initially have 1,400 employees. The applicant did not go into detail as to how long a period the buildings would be occupied by 1,400 people. In a conversation with staff at the Parks and Recreation Department, the person indicated that standards do not exist with respect to the necessary square footage of passive recreation space necessary for employees in office complexes. The individual felt that the one-half acre plaza would be adequate to meet the needs of the employees. As with other employers in the area, those wishing to have more actual recreation opportunities tend to jog in the surrounding areas. The City during the environmental review for the site approval (file SA-017-86) traded the development of an off-site active recreation area for money with which to complete the master recreation plan for the Valley. Therefore, the half acre site appears sufficient to meet the needs. 7. Various City departments have reviewed and commented on the project. The comments are as follows: Building Division: Approved with the condition that the plaza be so designed so that one-half could be installed prior to occupancy of Phase II. o Policy Development: Did not approve the proposal. Made the following comment: We would like to have the applicant provide convincing evidence that the construction of the plaza 'at this time would be adversely impacted by future dust generated from Phase II and IV construction and utility implacements. It is recommended that additional seating possibilities be examined to further increase the plaza's potential to be a people place, as well as a pedestrian connection between buildings. • Design Engineering: No recommendation made. The following comment was provided: Pools constitute structures which will be constructed over utility easements previously granted to the City. Renton, WA 98055 Subject: BCS Office Facility Phase II W.O. 86-5371 Gentlemen : The intent of the attached site plan application is to ask that the decision by the City of Renton Hearing Examiner on May 16th, 1986 , be modified with respect to the completion of the .one acre plaza with this phase of the development for the reasons set out below. A short history of the permit process for this site is in order . On November 24, 1985, the site plan application (SA-017-86) was received by Renton' s Building and Zoning Department. After working with the City' s staff for a number of months , a public hearing was held on May 16 , 1986 , chaired by Mr. Fred Kaufman. The site plan was approved , subject to 4 conditions . The second condition is the subject of this request for modification to the site plan and decision thereof . The condition setforth was : "Construction of the entire, approximately, 1 acre plaza to coincide with the occupancy of this phase of the development of the Short Plat ." On July 31, 1986, a letter was written to Mr. Kaufman requesting that this condition be voided for the following facts : 1. Construction of the plaza would interfere with the fill activity associated with the permit application (SP-078-86) which is now before the City for consideration. 2. Construction of the plaza would interfere with the installation of utilities for Phases III and IV (manholes , vaults , valve and meter pits, water and sewer lines , etc .) . Q Dept . of Building & Zoning September 19, 1986 Page 2 3. Construction of the plaza would create construction problems for the buildings of Phases III and IV. Damage to the completed pools caused by settlement due to the use of heavy equipment in the vicinity could occur. In addition , the south half of the plaza would be rendered unusable due to noise , dust and safety considerations . 4. Requiring the construction of the entire plaza places a financial burden on the developer which was not anticipated for this phase . 5. Additionally, design considerations must be taken into account. Completion of the plaza prior to Phases III & IV creates an unbalanced design. While we have every hope and intention that Phases III & IV will follow the master plan developed for this site , we have no guarantees that such will be the case, nor is continuity of ownership guaranteed . The reasons above still are valid and should be considered in reaching a decision on this application. In addition, several. other reasons should be reflected upon. They are: 1. The Hearing Examiner estimated that the total population for the two buildings would be 4000 employees . This is in error . Our environmental impact statement approximates the employee number at 1000 per building . Even using the minimum floor area of 100 sq. ft. per person as defined in the Uniform Building Code standard for this building type would yield approximately 2740 employees . A survey of the tenants existing population in the completed Phase I building and their plans for the soon to be completed second phase found that the two building totals will initially be only 1400. 2. While it is fair to state "recreational ' opportunities are limited ( in the Valley) " it should be noted that this applicant has already contributed $10 , 000 to the City of Renton for the purpose of development of recreation in the valley. • 4 Dept . of Building & Zoning September 19, 1986 Page 3 3 . While the examiner has the right to impose such a condition, we ask if, without the direct support of facts brought forth by the staff' s investigation of the matter at hand or testimony during the hearing process , the condition is warranted . Again , for the above reasons , we ask that the site plan as designed and submitted be accepted without the requirement of completing the entire 1 acre plaza prior to its originally scheduled completion.
