Pre-Collision Driver 1 stated that he was traveling East on NE 6th St in the #1 lane crossing over Queen Ave NE. Unit 2 was parked and unoccupied at the time of the collision. Collision Driver 1 stated that as he crossed Queen Ave NE, the front bumper of his vehicle detached and fell underneath Unit 1 as it was moving East. Driver 1 stated that the bumper was previously defective and was hanging on rather than being properly secured. Driver 1 stated that the bumper got caught underneath the front passenger side tire causing the front tire to lose traction and Unit 1 began to move clockwise towards the Southern curb. Driver 1 stated that he was unable to bring Unit 1 to a stop or slow to avoid a collision and the front passenger side bumper of Unit 1 collided with the rear drivers side bumper of Unit 2, then scraping along the entire drivers side of Unit 2. Unit 2 was forced East approximately 6 feet. Injuries None reported Vehicle Disposition No vehicles were towed at the time of collision as they were safely off of the roadway. Unit 1 was later towed back to the residence by a private company. Proximate Cause I determined that Driver 1 is the proximate cause of this collision because when any motor vehicle was originally equipped with bumpers or any other collision energy absorption or attenuation system, that system shall be maintained in good operational condition, and no person shall remove or disconnect, and no owner shall cause or knowingly permit the removal or disconnection of, any part of that system except temporarily in order to make repairs, replacements, or adjustments. Had Driver 1 maintained the bumper in good operational condition, it would not have fallen off and this collision would not have happened.
