NARRATIVE
On 11/01/2025 at about 1410 hours I was dispatched to a non-injury two motor vehicle collision in the
300 block of Rainier Ave N located within the city limits of Renton, King County, Washington. The
collision occurred in the northbound lane of Rainier Ave S just south of S 3rd Pl. Both involved
vehicles pulled off onto S 3rd PI and waited for police. The north and south bound lanes of the 300
block of Rainier Ave N appeared to have been recently resurfaced, and temporary lane dividers were
placed on the street. No construction/street workers were actively working in the area at the time of
the collision.
Eyosias S. Hailemariam (Driver 2) was driving his vehicle (Unit 2-2025 Kia K5 with Washington state
license plate CSJ2828) northbound in the 300 block of Rainier Ave N when it was struck on its front
driver side by Unit 1 (2004 Oldsmobile Bravada with Washington state license plate ARZ3721). Gary
L. Witherbee (Driver 1) was the driver of Unit 1, and he stated that he was passing Unit 2 while
traveling northbound on Rainier Ave N. Gary said the northbound lane appeared to consist of two
traveling lanes after he claimed to have seen another vehicle in front of him pass Unit 2. The
northbound lane of Rainier Ave N was a single lane, and it did not have any visible markings to
indicate it consisted of two northbound lanes. Temporary yellow colored lane dividers were seen on
the street that appeared to divide the north and southbound lanes of Rainier Ave N.
Both drivers were able to pull their vehicles safely out of the roadway. The driver side air bags inside
Unit 2 deployed, but Eyosias was not injured. Unit 2 had damage to its front driver side and front
driver tire/wheel. Unit 2 was not able to be driven any further, and a tow was called to the scene
(private tow). Gary was not injured, and his vehicle had damage to the front passenger side area of
the vehicle. Unit 1 was able to be driven from the scene.
Gary's actions as he attempted to pass Unit 2 appeared to contribute to the circumstances of the
collision. Gary L. Witherbee was cited for improper pass (RCW 46.61.110) and for failing to provide
proof of motor vehicle insurance (RCW 46.30.020). The infraction (5A0778738) was sent to the court
to be mailed. Gary stated the vehicle (Unit 1) belonged to his brother (Bruce D. Witherbee), and that
Bruce may have motor vehicle insurance covering additional drivers; however, Gary was unable to
provide proof of insurance while on scene of the collision.
