While I understand that the goal of the specifica- tions is to obtain equipment that meets certain performance requirements, and that price alone will not be controlling, I believe that the way the specifications are worded may lead to trouble with the State bid law. I would feel more comfortable if you were able to state a minimum acceptable performance level and accept bids only on that performance - level. As you are probably aware, the State Bid Law requires the City to accept the lowest responsible bidder. Included in the State law is a requirement that the lowest responsible bidder also submit a bid that is responsivle to the call ,P for bids. If we do not establish minimum specifications. then all bidders will potentially be responsive and then the State law might require us to award the contract to simply the lowest bidder. It might be possible for you to establish a minimum set of standards and then include alternatives that would upgrade certain portions of the system asking for bids on alterna- tives.
