CONSTRUCTION REPORT FOR PUBLIC WATER SYSTEM PROJECTS - Y,

Effective September 9, 1983 the following Regulation applies: WAC 248-54-035(2) - A
construction report shall be submitted to and accepted by the department within sixty days
of completion and prior to use of any project for which plans and specifications have been
approved by the department for projects designed by a professional engineer. The "s
construction report must be signed by a professional engineer. The report shall state in _
the opinion of the signee whether the project has been constructed in accordance with
approved plans and specifications and the installation, testing and disinfection of the
iystem were carried out in accordance with department regulations.
(a) If a project is being completed in stage construction, attach a map and description
of portion of project being certified as completed as approved on date given below. _
(b) As future portions of staged construction projects are completed, each must be
certified as required by WAC 248-54-035(2).
(c) Additional certification forms are available upon request from DSHS offices
listed below.

Dear Mr. Harpertt
You recently forwarded to me copies of the specifications
for bidding on the Water Telemetry and Supervisory Control
System. While I understand that the goal of the specifica-
tions is to obtain equipment that meets certain performance
requirements, and that price alone will not be controlling,
I believe that the way the specifications are worded may
lead to trouble with the State bid law. I would feel more
comfortable if you were able to state a minimum acceptable
performance level and accept bids only on that performance -
level.
As you are probably aware, the State Bid Law requires the
City to accept the lowest responsible bidder. Included in
the State law is a requirement that the lowest responsible
bidder also submit a bid that is responsivle to the call ,P
for bids. If we do not establish minimum specifications.
then all bidders will potentially be responsive and then
the State law might require us to award the contract to
simply the lowest bidder.
It might be possible for you to establish a minimum set of
standards and then include alternatives that would upgrade
certain portions of the system asking for bids on alterna-
tives. This might provide you with a more complete picture.
I believe that the State Bid Laws are designed to remove as
much discretion in awarding bids as possible. The system i

Please re-submit the enclosed form(s) to the Department of Labor
and Industries for approval with a fee of $12.50 for each set
of forms (i..e.. a 'set' of Statement of intent to Pay Prevailing

and two (2) duplicates). Fees shall be made payable to the
