Renton, Washington 98055 Dear Mr. Baker: Per direction from your regional manager , I am forwarding to you a copy of our December 19, 1986 letter regarding the payment of a private latecomer fee. This fee, a_; explained In said letter, and in the amount of $6,204.16, is due and payable immediately. Also, it has come to our attention that there are some legal documents that have still not been completed for the above-referenced project. Every major utility extension, both water and sewer, must be properly transferred to the City of Renton for ownership, operation and maintenance. In order to properly transfer ownership to the City of Rerton, both a Bill of Sale and Easement form are required. we are in receipt of the waterline easement, but not the Bill of Sale. Also, the water plan must be as-built. and stamped by a certified engineer that the drawing reflects the as-built condition of the Installation. Your drawing is marked as-built but does not bear an engineer's signature or stamp. Upon receipt of your certified as- tuilt water plan, a final field inspection will be conducted over the project site. If the inspector finds any unfinished work, or work not done to City standards, these items must be Laken care of. As owner of the subject property, it is your responsibility to have these documents prepared. A blank form is enclosed for your use, together with a plan of your waterline and fire hydrant installation. It is suggested that you contact your engineer to aid you in preparing these documents. In your letter you indicate that the City has in the past not identified or defined a motel as a cooperative rental. I am not sure that that statement answers the question of whether or not you should pay $175 .00 per living unit or the 4C per square foot charge. The Ordinance clearly defines between residential units and business properties. The Ordinance was adopted trying to have development pay its fair share of the existing utility system within the City. Residential housing with showers and toilets impacts the system in an entirely different manner than does commercial property which often has negligible contributions to the water and sewer systems of the City. Therefore, two classes of users were established, one of a residential nature and another of a business nature. Using this analysis, it is clear that a motel falls within the classification of residential users. A motel would have the shower and bathing facilities as well as toilet facilities that contribute heavily to the usage of the system. It is obvious that a motel unit is closer to a residential unit than it is to say a warehouse. Since the attempt by the City is to measr,re the impact on the system, the Citv's distinction and its decision concerning this project is Eupportable. Baker Page 2 November 6, 1986 The law in the State of Washington gives substGntial dis- cretion to the administrating authority to interpret its own rules and regulations. The Department has made that decision and I believe it is legally supportable . I will not agree with you that the best classification for this use is a cooperative rental. The Ordinance states that the charge may also be made on similar multi-family occupancy residential structures. It would appear that your motel falls within that classification. It may also be implied by the regulation that your motel falls more closely within the residential classification than within the business classification. If the City has improperly classified a motel before it does not mean that it need make the same mistake again. Your inquiry may cause us to review past charges under the special utility connection charge. However. , a prior mistake is not the basis for the City to make that same mistake again. It is my understanding that Section 3-241 (F) subsection (2) was used as the method by which you calculated the special connection charge set forth in that ordinance. That subsection specifically provided for a $175.00 charge per living unit and we were considered to be a cooperative rental under your definition. This letter shall serve as an objection and a protest to chat assessment. It is my understanding that your department in the past, with motel projects, has used a subsection (3) under the heading of all other properties wherein only .04c per square foot of property connected was assessed and that you have not in the past attempted to identify or define a motel as a cooperative rental. I would be interested to see within other sections of your ordinances or your city code wherein you define cooperative rental. Under no kind of rn imagination can I picture a .motel as a cooperative rental. Clearly that phrase has a different meaning. However, if it is your interpretation that our motel is in fact a cooperative rental, then therefore it must mean that we do not at the same time qualify as an entity that is required to pay to the city any bed tax or sales tax for th, rentals of our rooms, just as a cooperat ve rental condominium or time share unit would not pay sales tax or bed tax. I have attempted to call you several times in the last week and have left several messages. Net having heard from you, I am taking this method to address this prnhlem and seek your imme 'iate attention. It is favorable and we are now preparing an offer of $333,a59 per the enclosure sent with our letter dated September 26, 1986. The offer should be mailed within three weeks. The mayor will then have one month to sign and date it, legally accepting our offer of funds. Sincer y, Peggy Johnson, Coordinator Municipal Water Supply Funding Programs PJ:clu cc: Ron Olsen Moe datra, District Engineer Glenna Gerdts, Program Accountant On September 25th, Olympic Pipe Line Company was notified by Mr. Craig Baker of the Washington State Department of Ecology (D.O.E.) that some type of fuel. product was leaching at a slow rate into the Cedar River approximately one (1) mile east of Highway I-505 near the Maple Valley Highway (Highway 169). The D.O.E. had deployed booms in a small area to contain and recover any product on the water. As Olympic operates a refined petroleum products pipeline system in the proximat,a area it immediately dispatched personnel to the site for investigation and evaluation. While the source was undetermined at that time, Clympic agreed to cooperate with D.O.E. while it continued Its investigation. Samples of minor quantities of the product were obtained and analyzed for content by both the D.O.E. and Olympic Pipe Line Company. On September 30th, it was determined that a mix comprised possible of gasoline, diesel fuel and • viatioa fuel was present in the effluent. Following this information, on October lst, Olympic sh•it down and conducted pressure tests on its pipeline system. These tests determined that there is no problem with the system. Olympic has taken an active role In this investigation and has secured a private consulting firm to further evaluate the existing problem, while continuing to work with the D.O.E. Page 2 A series of probes, strategically placed to detect background level hydrocarbon readings revealed an area in the vicinity of the pipeline which may be affected by subsurface hydrocarbon products. A plume extending approxlmr,tely 1,500 feet from the Olympic Pipe Line block valve site to the river has been determined, but additional testing will be necessary to further define the parameters of this plume. This testing is ongoing at present and will continue as necessary. As public safety is of uppermost concern in this matter, Olympic has briefed the City of Rentoa Fire Department and asked for their assistance in determining that no unsafe situation exists. A residence-by-residence evaluation of the affected Maplewood area in Renton is being, conducted by qualified authorities. Appropriate monitoring quality control sampling and clean-up operations will be conducted under the D.O.E. Olympi.c's preliminary investigation indicates that a possible source of the hydrocarbon in question coild have been a cracked one iac:i pressure sensing connection which was replaced in January 3.986.
