Said heretofore mentioned grantee, it- successors or assigns, shall have
the right, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property for the purpose of cpnstruct-
Ing, maintaining, repairing, altering or reconstructing said utilities, or making
any connections therewith, without incurring any legal obligations or liability
therefore, provided, that such construction, maintaining, repairing, altering or
reconstruction of said utilities shall be accomplished in such a manner that the
private Improvements existing in the rig„t(s)-of-way shall not be disturbed or
damaged, they will be replaced in as good a condition as they were immediately
before the property was entered upon by the Grantee.
The Grantor shall fully use and enjoy the aforedescribed premises, including
the right to retain the right to use the surface of said right-of-way if such use
does not Interfere with Installation and maintenance of the utilities. However.
the grantor shall not erect buildings or structures over, under or across the
right-of-way during the existence of such utilities.
This easement. shall be a covenant running with the land and shall be binding
on the Grantor, his successors, heirs and assigns. Grantors covenant that they
are the lawful ownr.rs of the above properties and that they have a good and lawful
right to execute this agreement.

A developer will be granted a credit of 60% of the current 3/4" water service cost
for installing the stub portion of the water service when he makes a meter applica-
tion. This credit is based on a portion of Ordinance k3tA City of Renton,
Washington, which amends Chapter 2 of Title III (Departments) of Ordinance #1628
entitled "Code of General Ordinances of the City of Renton" pertaining to the Water
Department, relating to charges; installations, fees and procedures.
Sectio„ ?-206, Subsection (F) as amended:
(F) Whenever it is deemed prudent, in case of a new development
of subdivision, to install the service from the main to the
i property line, lu?reinafter referred to as "stub service"
g prior to completion of street construction, the City will
j provide such service for sixty percent (60%) of the then
current installation cost for such service. At such time
that meter installation is requested, the remaining balance
of the then current rate shall be collected and paid for by

The developer for Snmmerwind Division #2 has completed all work in the above
referenced subdivision, subject to the one-year maintenance period. The City
therefore will be accepting for continual maintenance, the improvements
installed in this subdivision, unless you advise of work that has not been
completed or is unsatisfactory. Minor items needing repair or adjustment can
be corrected during the maintenance period. If I do not hear from you by
March 25, 1988, I will assume that everything is in order and make the
acceptance of Division #2 effective as of March 31 , 1988.

A developer will be granted a credit of 60% of the current 3/4 , water service cost
for installing the stub portion of the water service when he makes a meter applica-
tion. This credit Is based on a portion of Ordinance M3056, City of Renton,
Washington, which amends Chapter 2 of Title III (Departments) of Ordinance #1628
entitled "Code of General Ordinances of the City of Renton" pertaining to the Water
Department, relating to charges, installations, fees and procedures.
Section 3-206, Subsection (F) as amended:
(F) Whenever it is deemed prudent, in case of a new development
