Your Letter dated October 7, 1989
I am confirming, for Utility Engineering, that we have received the Bill of
Sale for the water main, the Cost and Data Inventory for same, and the Backflow
Test Report (Items la, lb & 2d) .
It has also been confirmed by the Project Inspector that Items 2a, 2b, and 2c
(seal asphalt patch, repair depression in parking lot, and repair depression on
water main trench) have been completed.
Item 2e, according to the Contractor, is installed inside under the sinks. The
Inspector has requested that you have someone from Building inspect the urease
trap.
If you need anything further, contact me at 2631 . Any questions about the
grease trap installation should be referred to G T & L Construction.

SETTLEMENT AGREEMENT
This settlement agreement entered into this ^;_j day of
November , 1987 , by and between Evelyn H. Moffatt, hereinafter
referred to as "Moffatt" , and Roberto. Moore, Margaret Elizabeth
Moore and Quentin Control Systems, Incorporated , hereinafter
referred to as "Moore" . In consideration of the parties agreeing
to settle their disputes in the lawsuit pending in xing County
Superior Court under Cause No . 86-2-22551-0 , Moffatt and Moore
hereby agree as follows :
I .
Moore will repair and replace the approximate 45 feet o '
fence Moore removed from Moffatt ' s property with 3 fence of
similar quality to that presently on Moffatt' s property within 30
days of the date of this agree,tient. If Moore fails to replace the
fence as agreed to above , Moffatt shall be entitled to replace the
same and be entitled to judgment against Moore for the cost.
II .
Moffatt will enter into a ground lease with Moore for rent of

III .
That Moffatt is the fee owner of the property described on
Exhibit "A" attached hereto which includes the 30 foot strip which
runs between Shattuck Avenue South and Rainier Avenue South. At

the time of this agreement Moore has been using the 30 foot strip
for access to the garase on the Moore ' s property described on
Exhibit "B" . Such use shall be authorized until thirty ( 30) days
from the date of this agreement . After thirty ( 30) days from the
date of this agreement , Moore shall not be authorized to use nor
permit any of its employees or agents to use the Moffatt property
for any purpose.
IV.
If suit is brought: to enforce this agreement the prevailing
party shall be entitled to its reasonable attorneys fees and
costs.
V.
This agreement shall be binding upon and inure to the benefit
of the parti -rs, their respective heirs, administrators, executors ,
successors anti assigns.

Dear Mr. Lentz:
The water plan for the main extension (our job No. 87263) has been approved by
the City of Renton, Dept. of Public Works and a construction permit can be
issued after the City receives one at the following items:
o A Warrantee Deed to the City for an easement along the south property line.
This deed must be signed by both; the owner of the Mazatlan Restaurant
property and the owner of the property which lies just north of the 30 foot
wide strip at the east and of the site. There is a curreut dispute over
the ownership of the 30' x 120' strip and the City wants assurance that
they will still have an easement, regardless of the out come of the
dispute.

o A Title Insurance Policy for t!,. same easement. This would put the burden
of obtaining an easement onto the Insurance Company should the restaurant
owner lose the dispute.
