Interpretation of Phrases: a. 'ahenover the word "City" is used in this contract, it shall be under- stood to mean the City of Renton. b. Whenever the word "Engineer" is used it shall be understood as refer- ring to the City Engineer, or his representative en the job as the case may be. Whenever the words "directed," "permitted," "considered necessary," or words of like import are used, it shall be understood that the direction, permission order, etc. of the Engineer is intendadl similarly, "approval," "satisfactory," "acceptable" shall mean approved, satisfactory, or acceptable to the Engineer. c. The word "contract" will be understood to include all the terms, stipulations, and covenants contained in the Bid Proposal, General Conditions, Specifi.cstiors, Plans, and Bond. d. Whenever the word "Contractor" is used it shall mean the oerson(s), co-partnership, or corporation who has agreed to perform the work covered by the contract, or to his legal representative. During the absence of the Contractor, the job superintendent will be considered to be the Contractor's representative unless otherwise designated by the Contractor. II. ?sights and Responsibilities of the Aistriot: a. Ins ction: It is rnutally agreed that the City, through its agent the City nn�shZl inspect the work during the construction to determine its acceptability, conformance tt plans and specifications, quantities of work perform- ad, and other functions requisite to securing a satisfactory, works, nlike job. The Contractor shall furnish reasonable aid and assistance as required by the Engineer, or Inspector, for the proper inspection of the work and measurement of quantities. b. Eight of Entry: The City reserves the right to construct or install :rxh cnliatera work—s—a—TE may desire daring the period of this construction. Su.h work will be done with as little hindrance or interference as possible with the Contractor. The Contractor agrees not to interfere with or prevent the perforn- ar.--s of such work or to claim any extra compensation or damages by delays or hin- d.an-es which may be caused. o. If such alterations diainish the quantity of the work to be done, they shall not constitute a claim for damages or anticipated profits on the work that may be dispensed with. If they increase th- omoent of work, such increase shall be paid for according tc the quantity actually done, and at tts prices established ter such work under the contract. It is understood and agreed that the basis for pay- ment shall be the actual amount of work done and the material furnished. f. Lines and Grades: The alignment and grade :hall be as shown on the plans, and as staked in the rield by the Zngineer. Extra Work: If during the performance of this contract the Engineer steal, order.-other work done or materials furnished which cannot be class- ified under the unit prices of this contract, the Contractor shall perform such work and furnish such material and shall be paid therefor the actual cost plus 151 in addition thereto. All construction operations shall be conducted in c_rh mane^r as to interfere as little as possible with the normal procedure of traffic. General Conditions e. Protection Against Claims for Tabor and Material: The Contractor agrees that he wiSS irolemni and save harmless tbsCC ty—fFm- all claims for mater- ial furnished or work done under this rontraot. It is further agreed that he will furnish the City satisfactory evidence that all persons who have done work or f%u - nisied material under this agreement have been dully paid for such work or mates:. In case such evidence is demanded and not furnished, such amount as may do the opinion of the City be necessary to meet the claims of the persons aforementioned, may be withheld from the money due the Contractor until satisfactory evidence is furnished that all liabilities have been fully discharged. f, Assi nment and Subletting: The Contractor agrees that he will not sublet the aforesaid work or the furnishing of material, and that he will not assign by power of attorney or otherwise any portion of said contract unleae by and with the previous consent of the City. The granting of such consent by the City shall not in any way relieve the Contractor of his prime responsibility for the performanca of the work Lneluding the work done by subcontractors. g. Abandonment: In case the Contractor shall abandon the work and fail, ,or refuse ?o oommence it againwittin 10 days after notification, or if he shall fail to owply with the orders of the Engineer or with this agreement, then and in that case the sureties on the bond shall be notified and directed to complete the Same. h. Time and Order of Com lP etlon: It is the meaning and intent of this contract, urless other_ se eras er specifically provided, that the Contractor shall be allowed to prosecute his work at such times, in such order of precedence, and in such manner as shall be most conducive to econurw of construction, provided however, thwt the order and the time of prosecution shall be s•ich that the work shall be completed as a whole within the time of completion hereafter designated; provided also that when the City is having other work done, the riginser may direct tt.e time and manner of constructing the work under this contract so that conflict will be avoided an. the various works being done shall be harmonised. SPECIFICATIONS WELDED STEEL WATER STORAGE TANK 1. GENERAL 1.01 Sco a of this Contract TE s esitract s to ewer the design, fabrication, delivery to site, erection, testing and painting of a welded steel water reservoir of 3,000,000-gallon capacity. The tank is to be flat bottomed, resting directly on a prepared grade, and with a standard steel conical roof. The site provided by the City is located immediately east of the main bcsiness district. Distance from a rail siding is approximately 1/4 mile. Water at 100 psi is available within 300 feet. The grading and preparation of the site, including construction of tank foundation and :cease road,will be perfcrmed by others prior to delivery of tank materials. 1.02 Ga••ernln S ecifications work to be per roamed under this centre:t shall conform to A.W.W.A. specification D10042 for the construction of steel water tanks, D102-52 for the painting of steel water tanks, or any subsequent modifications of the same. 1 03 Guarantee l aTT-onr'actor shall guarantee the structure against any defective mterials or workmanship, including paint and painting for a period of one year from date of completion. If any materials or workmanship prove to be defective within one year they shall forthwith be replaced or repalzed by the Contractor. Specifications 2_ MATERIALS 2.01 Quality The quality of material incorporated in this tank, and used in painting it shall conform to the apec!.fications of the American Water Works Aasoci.atfon referred to in . .tion 1.02 and to the reference ASTM specifi- cations. 3. It shell be covered with a bolted steel plate. A ladder shall be provided on the outside of the tank, extending from a point 8 feet above the foundation to the roof. The ladder shall be of steel, securely fastened to the tank shell. Side members not less than 2 x 5/15 inches and nmgs not less than 5/8-inch round or square bars. A roof hatch or manhole shall be provided near the outside ladder. Cover shall be hinged and se-ured by a padlock hasp. A curbing approximately u Leaches high above the roof surface shall exclude surface water from the tank. The cover shall lnp over the curb. ,he roof sr..�ll be provided with a ven'c of sufficient size to equalize pressures inside and outside tha tank at any possible rate of flow. It shall be screened or so constructed as to effectively exclude birds and animals. In addition a stub overflow emending at least 12 inches beyond the shell and not lose than 12 inr.hes in diameter shall be provided. A fanged fitting for connection to 16-inch pipe shall be presided it the tank floor. CONSTRMTICN 4.01 Oeneral T=tractor shall provide such ?abor, tools, and equipment as may be necessary to completely erect th^ tank ready for use. The City will provide a clear, graded site approsimatoly 180 feet by 300 feet with suitable road access prior to erection of the tank. The City assumes no liability for damage to property adjacent to the site. The Contractor shall provide for delivery of tank material to the site and for its arrangement and storage thereon.. Welding procedures and welding operators shall have been qualified in accordance with the American Welding Society's Standard Qualification Procedure. Reports mid records of er..h qualifying tests, examinations by a reputable testing agency shall be available on request. 4.02 Preparation of Base Prior arect—io—nVy the tank Contractor, the City will have graded the site, installed pipe line connections to the tank vicinity, constructed an access road, and concrete ring wall foundation, and had a sand cushion spread uniformly over the base of the tack. The tank Contractor as, or before, the bottom plates are laid out for welding shall re-level the sand cushion as necessary to secure uniform support and a level botton. 4.03 Welding Fieldassembly shall be done entirely by the shielded electric are process. Auturatic processes may be used where practicable. La^ joints, welded on the top side only, shall be used for the bottom and ro%f plates. Shell plates shall have butt joints. Any clips, jigs, or lugs welded to the plates for erection purposes shall be removed without damaging the plates and any porti:n of weld beads remaining shall be chipped or ground smooth. Welding procedures and techniques shall be such an to produce sound, strorg joints with a minimum of distortion and internal stress. Trepanned plugs shill be cut from important shell seams by the Contractor sufficient to show the quality of the welds. 4.04 Grouting Base Xgie-rise to c has been completed and triad up, the sand cushion shall be removed for a distance of about 12 inches back from the outer edge of the tan% and replaced with a L1 sard-cement grout. TESTING Upon completion of erection and before painting, the tank shall be tested for watertightness by filling to the overflow level. Any dbfects shall be repairea by cutting out the defective welds and re-welding. The City will furnish water for the test. Upon completion of the test, the rater stall be drained to waste. 6. SURFACE PREPARATION AND PAINTING 6.u1 F_reparaticn for Painting tee an atruc�u shapes shall, after fabricating, be cleaned of all rust and mill sale by the phosphoric acid "pickling" process, or by send or grit blasting, to bare metal. The latter process may be applied in the shop or in the field after completion of erection. All surfaces cleaned shall be painted the same day with a red lead primer cat. 6.02 Interior Paint surfaces Inside the tank after completion of erection shall be dried, cleaned, and wire brushed as necessary to remove any rust or other undesirable material from the surface of the steel and thereafter shall be covered with three coats of rust inhibitive red lead paint, the first coat being a patch coat repairing and completing the shop primer coat. The paint say be applied by brushing or spraying. The Contractor shall provide ample ventilation and illumination for the safety of the workmen, reasonable drying time and the securing of good workmanship and inspection. Succeeding cats of the red lead paint shall be tinted slightly to help indicate proper coverage. 6.03 Exterior Paint T es�x e. of surfaces shall be given a patch coat of red lead primer and two finish cats of an aluminum, or other color, .s may be selected, exterior paint. If applied by spraying, the Contractor stall select weather conditions that will not cause drifting of the spray. The Contractor shall assume all liability for any damage resulting from spray drift. 7. STERILIZING AND CLEANUP 7.01 Steriliaili Auer c-o mp etion of interior rainsing and removal of scaffolding and othe- materials, the interior of tho tank shall be carefully cleaned by ho":ng down the side walls, roof and roof supports, and flushing out the bottom. The surfaces shall then, be sterilised by spraying with a water rolution containing approximately 50 parts per million of available chlorite. The suggested method is to use a "Cascade Sprayer" or similar type of sprinkler nozzle, which incorporates an aspirator type of auction, introducing chlorine solution into the stream of water. 53OW Spaaifieatlxu ?. If the Contractor reuses or fails to prosecute the work or any part thereof, with such diligence as will insure its completion within the ti w specified in this contract, or any extension in writing thereof, or fails to complete said work within svah Use, or if the Cortracton shall be adjudged a bankrupt, or if he should make a general assignment for the benefit of his creditors, or if a receiver shall be appointed on account of the Contractor's insolvency, or if he or any of his sub-contractors should violate any of the provisions of this contract, the City may than serve written notice upon him and his surety of its intention to terminate this contract, such notice to contain the reasons for such intention to terminate the contract, and unless within ten (10) days after the serving of such notice, such violation or non- compliance of any provision of the contract shall cease and satisfactory arrangement for the correction thereof be made, this contract, sha P_, upon the expiration of said ten (10) day period, cease and determine in every respect. The tank contract was signed August 30, 1954, with stipulated completion tine of 175 calendar days, which would be February 21, :.955. 0n November 30, 19549 I wrote a letter to Hammond in which I informed them that the site was com- pleted suific_ently to receive materials at any tiara, and that erection could begin within ten days. 1'ne steel for the tank started arriving Jav,uary lf, 1955, and erection was started on January 24, 1955. The weather since has been unusually favorable with not more than four or five days lost since on th• , sormmt.. The extension of time, th-sfora, need not, be grained on the basis as requested nor on the bas.a that site preparation caused any delay. Regarding the question. as to the availa- bility of water for testing, it, of course, is available at any time. Anotner consideration is the fact that the fence Stem on Malaspina's contract and the 15% hold back are being delayed until the tank is completed.
