UTILITY EASEMENT
PACCAR Inc ("GRANTOR") in consideration of the sum of One
Dollar ($1 .00) and other valuable consideration, receipt of which
is hereby acknowledged, hereby conveys and quit-claims unto the -
City of Renton, a Washington municipal corporation ("GRANTEE") , a �
nonexclusive easement to construct, operate, maintain,
reconstruct, inspect and remove a public water main and
appurtenant valves and vault upon GRANTOR's land, situated in
King County, State of Washington, described as follows:
That portion of the south half of Section 8, Township
23 North, Range 5 East, W.M. , in the City of Renton,
King County, Washington, and of Renton Fart tcreage, as
recorued in Volume 12 of plats, page 37, rt,�ords of
said county described as follows: Commencing at the
east quarter corner of said Section 8, from which point
the northeast corner of said section bears
CO N01'02 '09"E' • thence N89'27125"W, along the north line
V of said south half, 2647.56 feet to an existing center
of section monument; thence S01°0214011W, along the k.
north-south center of section line of said Section S, a
(V distance of 60.00 feet to the southerly margin of North
8th Street, said point being on the suuth line of the
U. north 30 feet of Block 1 of said Renton Farm Acreage;
thence N89°27125"W, along the south line of the north
30 feet of said Block 2 and its westerly prolongation,
986. 13 _eet to a point on the west line of Block 2 of
said plat; thence S01°0513411W, along said west line and
its southerly prolongation, 312.01 feet, to the true
point of beginning; thence S01.05134"W along said west
line and its southerly prolongation, 30.03 ft; thence
S89°27 '25"E, 15.00 feet; thence NO1°05134"E, 30 feet;
thence N89'27 '25"W, 15.00 feet to the true point of
beginning,
as such parcel is more particularly shown, cross-hatched on
map attached hereto as Exhibit A and by this reference
incorporated herein. Said parcel is herein referred to as
the "Easement Area. ,,
TO HAVE AND TO HOLD said easement unto GRANTEE and its successors
and assigns forever, subject to the covenants and conditions
hereof, which GRANTEE by its acceptance of this easement agrees
to fully perform.
1. Subject only to the rights expressly granted in this
easement, GRANTOR reserves all rights with respect to the
Easement Area including, without limitation, the right to grant
additional easements, licenses and permits therein to others, the
right to install utilities and other fixtures or improvements
over, upon. across and under the Easement Area; and the right to
locate structures with permanent foundations within the Easement

Areas; PROVIDED HOWEVER, that no surface structures shall be
located within 5 feet horizontally of GRANTEE's utilities
installed under this easement without GRANTEE's prior written
consent (which consent GRANTEE agrees not to withhold
unreasonably) . GRANTOR shall not be liable to GRANTEE, or to
GRANTEE's employees, agents, contractors or users of GRANTEE's
property, for loss or injury resulting from any damage or
destruction of GRANTEE's facilities directly or indirectly caused
by GRANTOR's use of the Easement Area or GRANTOR's facilities on
the Easement Area, excepting only loss or injury which results
solely from GRANTOR's failure to exercise reasonable care not to
damage or destroy GRANTEE's facilities installed within the
Easement Area.
2. GRANTEE does hereby release, indemnify and promise: to defend
and save harmless GRANTOR from and against any and all liability,
loss, damage, expense, actions and claims, including costs and
reasonable attorneys' fees incurred by GRANTOR in defense
thereof, asserted or arising directly or indirectly on account of
or out of acts or omission-.; of GRANTEE and GRANTrE's servants,
agents, employees and contractors in the exercise of the rights
granted herein; PROVIDED, HOWEVER, th!.s paragraph does not
purport to indemnify GRANTOR against liability for damages
arising out of bodily injury to pPrsons or damage to property
caused by or resulting from the sole negligence of GRANTOR or
GRANTOR's igents or employees

3• GRANTEE shall at all times maintain the Easement Area in
p good and safe condition and repair.
N 4. If the Easement Area ceases to be used by GRANTEE to provide

O water service to the building to be served thereby (being the
ICE Kenworth Truck Company R&D Center near the SW corner of N 8th St.
r and Garden Ave. N. in Renton) , then the easement herein granted
shall terminate, and all rights, interests and privileges granted
hereunder shall revert to the GRANTOR, its successors and
assigns. Upon an}- termination of this easement, GRANTEE shall
promptly remove from the terminated Easement Area any facilities
installed by GRANTEE, and shall restore the Easement Area to its
condition prior to such removal .

Either party may change the address to which notices may be given
by giving notice as above provided.
6. GRANTOR at its expense is initially installing the water
main pipes, valves and other facilities to be used by GRANTEE in
the Easement Area. Effective upon completion of such
installation and acceptance by GRANTEE (as evidenced by its
commencing supply of water through the Easement Area) , GRANTOR
sells and delivers unto GRANTEE, all piping, valves, meters,
appurtenances, vaults and other water facilities installed in the
Easement Area, TO HAVE AND TO HOLD the same to the GRANTEE and
its successors and assigns forever. The foregoing sale and
delivery are intended to transfer to GRANTEE all of GRANTOR's
interest in the foregoing described property when installed in
the Easement Area, whether such property is correctly
characterized as realty or personalty.
This easement has been executed as of this 4th day cf
December, 1989.

(a) Approximately 60 lineal feet of 8 inch ductile iron pipe, 10
lineal feet of 3 inch galvanized pipe, two 8 inch and two 3
inch gate valves, 1 inch by 1 inch detector check valve, one 3
inch compound water meter, two 4 foot 8 inch by 7 foot 0 inch
by 7 foot 0 inch concrete vaults, and all appurtenances
pertaining to said water service, as now installed in
Parcel B: and
(b) Approximately 30 lineal feet of 6 inch ductile iron pipe, one
5 inch MFD fire hydrant assembly, one 6 inch self tapping gate
valve and all appurtenances pertaining to said fire water
main, as now installed in Parcel A,
TO HAVE AND TO HOLD the same to the GRANTEE and its successors
and assigns forever. The foregoing sale and delivery are
intended to transfer to GRANTEE all of GRANTOR's interest in

UTILITY EASEMENT
PACCAR Inc ("GRANTOR") , in consideration of the sum of One
Dollar ($1.00) ..nd other valuable consideration, receipt of which
is hereby acknowledged, hereby conveys and quit-claims unto, the
City of Renton, a Washington municipal corporation ("GRANTEE") , a
nonexclusive easement to construct, operate, maintain,
reconstruct, inspect and remove a public water main and
appurtenant valves and vault upon GRANTOR's land, situated in
King County, State of Washington, described as follows:

incorporated herein. Said parcel is herein referred to as
the "Easement Area."
To HAVE AND TO HOLD said easement unto GRANTEE and its successors
and assigns forever, subject to the covenants and conditions
hereof, which GRANTEE by its acceptance of this easement agrees
to fully perform.
1. Subject only to the rights expressly granted in this
easement, GRANTOR reserves all rights with respect to the
Easement Area including, without limitation, the right to grant
additional easements, licenses and permits therein to others, the
right to install utilities and other fixtures or improvements
over, upon, across and under the Easement Area; and the right to
locate structures with permanent foundations within the Easement
Areas; PROVIDED HOWEVER, that no surface structures shall be
locateu within 5 feet horizontally of GRANTEE's utilities
installed under this easement without GRANTEE's prior written
consent (which consent GRANTEE agrees not to withhold
unreasonably) . GRANTOR shall not be liable to GRANTEE, or to ,
GRANTEE's employees, agents, contractors or users of GRANTEE's
property, for loss or injury resulting from any damage or
destruction of GRANTEE's facilities directly or indirectly caused
by GRANTOR's use of the Easement Area or GRANTOR's facilities on
the Easement Area, excepting only loss or injury which results
solely from GRANTOR's failure to exercise reasonable care not to
damage or destroy GRANTEE's facilities installed within the
Easement Area.
2. GRANTEE does hereby release, indemnify and promise to defend
and save harmless GRANTOR from and against any and all liability,
loss, damage, expense, actions and claims, including costs and
seasonable attorneys' fees incurred by GRANTOR in defense
thereof, asserted or arising directly or indirectly on account of
or out of acts or omissions of GRANTEE and GRANTEE's servants,
agents, employees and contractors in the exercise of the rights
granted herein; PROVIDED, HOWEVER, this paragraph does not
purport to indemnify GRANTOR against liability for damages
arising out of bodily injury to persons ui dc,.mage to property
caused by or resulting from the sole negligence of GRANTOR or
GRANTOR's agents or employees.
3. GRANTEE shall at all times maintain the Easement Area in
good and safe condition and repair.
A. If the Easement Area ceases to be used by GRANTEE to provide
,ter service to the building to be served thereby (being the
Kenworth Truck Company R&D Center near the SW corner of N 8th St.
and Garden Ave. N. in Renton) , then the easement herein granted
shall terminate, and all rights, interests and privileges granted
hereunder shall revert to the GRANTOR, its successors and
assigns. Upon any termination of this easement, GRANTEE shall
promptly remove from the terminated Easement Area any facilities
installed by GRANTEE, and shall restore the Easement Area to its
condition prior to such removal.

6. GRANTOR at its expense is initially installing the water
main pipes, valves and other facilities to be used by GRANTEE in
the Easement Area. Effective upon completion of such
installation and acceptance by GRANTEE (as evidenced by its
commencing supply of water through the Easement Area) , GRANTOR
sells and delivers unto GRANTEE all piping, valves, meters,
appurtenances, vaults and other water facilities installed in the
Easement Area, TO HAVE AND TO HOLD the same to the GRANTEE and
its successors and assigns forever. The foregoing sale and
delivery are intended to transfer to GRANTEE all of GRANIOR's
interest in the foregoing described property when installed in
the Easement Area, whether such property is correctly
characterized as realty or personalty.
This easement has been executed as of this 4th day of
December, 1989.

Re: Water Main Easement from PACCAR Inc to City of Renton,
Vicinity of Garden Ave. N. and N. eth St. , Renton, Washington
Gentlemen:
We refer to the attached easement to be granted by PACCAR Inc to
the City of Renton, as Grantee. Tnis property is located at
PACCAR's Renton, Washington manufacturing facility (former PACCAR
Defense Systems facility) ; the easement area referred to in the
easement is to be located in Lot 6, Block 2 of Renton Farm Acreage
according to said plat recorded in Volume 12 of Plats, page 37,
records of King County, Washington.
This letter is to advise the City that releases of a significant
quantity of hazardous substances on or about the property conveyed
by this easement may have occurred at various times in the past,
While PACCAR has not tested the easement area separately from the
remainder of PACCAR's surrounding property, the City is advised of
the soils and groundwater testing reports respecting the larger
PACCAR Renton property (thr+ "Site") in which this easement area
will be located, and which PACCAR has previously filed with the
Washington Department of Ecology. This is the PACCAR Remedial
Investigation Study dated September 1, 1989 for the Site. The City
has received copies of this study, or earlier drafts. The City is
also encouraged to confer with R. K. Butler, PACCAR's Corporate
Environmental Manager (this address, telephone 455-7435) respecting
any such matters, in connection with accepting the grant of this
easement.
PACCAR is currently finalizing the Remedial Investigation (RI) and
negotiating the Feasibility Study (FS) with Ecology. The Site was,
in June 1988, nominated for inclusion on the National Priorities
List by US Environmental Protection Agency pursuant to the federal
Comprehensive Response, Liability and Compensation Act, as amended.
In February 1989, PACCAR entered into a Consent Decree with Ecology
in Superior Court for the RI/FS Work Plan, which provided, in part,
as follows:

"No voluntary or involuntary conveyance or relinquishment
of title, easement, leasehold, or other interest in any
portion of the Site shall be consummated without
provision for continued operation and maintenance of any
containment system, treatment system, and monitoring
system installed or implemented pursuant to this Decree."
Pursuant to the RI/FS and in connection with any ultimate Remedial
Action Plan, PACCAR will hereafter enter into a consent Decree with
Ecology in Superior Court, which is expected to provide, in part,
substantially to the same effect as above quoted from the February
1989 Consent Decree.
Respecting all such matters and the condition of the easement area
to be covered by this easement, we advise you that such conveyances
are made subject to any rights and obligations of PACCAR in
connection with these Consent Decrees.
In connection with the particular water line utilities to be
installed in this easement, PACCAR is undertaking this construction
on behalf of the City. Among the precautions PACCAR will take to
eliminate risks associated with any soil contamination encountered
are the following:
• All excavation, movement of soils and placement of filter
fabric will be accomplished by certified workers who have
received 40 hours of training in accordance with OSHA
regulation 29 CiR 1910.120.
All excavated materials will be stockpiled on-site. A 6 mil
plastic sheet will be placed on the ground. Excavated soils
will be placed on the plastic and two layers of six mil
plastic sheet will be placed over the soils and held in place
with the bricks. Excavated materials will be handled as part
of the 1990 site remedial actions.
• All excavations will be lined with a minimum 6 oz.
polypropylene, non-woven, needle punched filter fabric with a
minimum 12" overlap at the seams.
• Lined excavations will be backfilled with clean importer.
