A THIS INSTRUMENT, made this �'fi day of May, 19R5, by and
between THE FRANCK-THOMAS PARTN ERSHgP, a Washington general
partnership consisting of James Franck and Donald Thomas herein-
rl after called "Grantor,* and the CITY OF RENTON, a municipal
corporation of Kinq County, Washington, hereinafter called
"Grant.en."
W I T N F. S S E T H:
That said Grantor, for and an consideration of the sum of
$1 00 paid by Grantee, and other valuable consideration, do by
these presents grant, bargain, sell, convey, and warrant unto the
said Grantee, its successors and assigns, an easement for public
utilities consisting of water and sewer with necessary apourte-
nances over, through, across and upon the following described
,)roperty in King County, Washington, more particularly described
as follows:
The Westerly 127 feet of the Southerly 15 feet of
Lot 5, Earlington Industrial Park No. 1, as recorded
September 22, 1967, in Volume 83, page 10, Subdivision
Records of King County, Washington.
Said heretofore mentioned Grantee, its successors or as-
signs, shall have the right, upon reasonable notice (unless an
emergency exists in which case notice may be dispensed with) or
proceeding at law, at such times as may be necessary to enter
upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said
utilities, or making any connections therewith, without incurring
any legal obligations or liability therefor, provided, that such
construction, maintaining, repairing, altering or reconstruction
Of said utilities shall be accomplished in such a manner that the
private improvements existing in the right(s)-of-way shall not be
disturbed or damaged, and if disturbed or damaged, they will be
replaced in as good a condition as they were immediately before
the property was entered upon by the Grantee and Grantee will
indemnify and hold Grantor harmless from and against all damages,
claims and liabilities that arise from Grantee's exercise of its
rights hereur,der.
The Grantor shall fully use and enjoy the Aforedescribed
premises, including the right to ret,�+n the right to use the
surface of said right-of-way if such use does not interfere with
installation and maintenance of the utilities. However, the
Grantor shall not erect buildings and structures over, under or
across the right-of-way during the existence of such utilities.
This easement *hail be a covenant running with the land and
shall be binding on the Grantor, his successors, heirs and
assigns. Grantor covenants that it is the lawful owner of the

Dear Mi. Rodin:
In response to your letter of April 19. 1995, enclosed please find a copy
of the City of Renton Standards, together with Section 3-243 of the Penton
Munici Pal Code, governing the granting of utility easements to the City.
If any I,ortron of the utility line is to he maintained by the City on pri-
vate property, A 15-foot minimum width wasement shall be deeded to the City.
All legal matters in connection with this conveyance shall he the responsi-
bility of the owner, the Developer, the Contractor, or the agency Appointed
by them.
Every Major utility extension (both water end sewer) must be properly trans-
ferred to the City of Renton for operation and maintenance. Followinq the
tecording of the instruments of transfer, the pipe and hydrants become a
Part of the City's mAjOr looped water system. This transaction occurs with-
out payment of any consideration.
