Dear Bob,
I noticed in the utility engineering comments on the staff report to the Hearing
Examiner for the grading permit on the Black River property that the sewer
and water system development charges are based on 40 per square foot and
have been charged against the entire site. I am writing to request that we
establish a phase-by-phase basis on which these fees would he charged so that
MY costs associated with the building of each phase will be paid only as 1
develop each phase.
Specifically, on my grading permit for Black River, Ron Olson indicated 40
per square foot water charges based on 50 acres (entire site), coming to
$87,120. An identical fee is charged for the sewer charges on the entire
property. 7 he first phase of development on the Black River property is to
accommodate a lease with ADMAC. 1 have attached legal descriptions of
areas for the ADMAC site, including the area for Naches to the cul-de-sac
and two landscape buffer areas. The site area being segregated for their
parcel is 277,674 s.f. At 40 per square foot, the ADMAC water fee would
be $11,106.96 and the sewer fee would be $11,106.96.
Bob, if we could work out an agreement whereby FCDC pays on a
phase-by-phase basis calculated on land area, it would he a great help to me.
Please consider my request and get back to me with your recommendation.

SUBJECTI BLACK RIVER UTILITY EASEMENT
Dear Barbara:
Thank you for yuur letter of September 22 regarding the proposed easement
for your ADMAC water utility easement. We have reviewed your propose) . nd
have some problems with the language, which precludes us from accepting Its
form.
I. Our easement rights must be permanent, not a temporary easement. I was
hoping you would come up with some language to modify the location
rather than our present policy of vacation of old easements, and
granting of new easement rights, at the time of a utility relocation.
2. The FCE hold-harmless clauses probably will not be acceptable by the
City Attorney. So paragraph'. 2, 3, 40 5 and 6, will be a problem.
Thank you for the opportunity to revlr. the proposal, however, unless there
Is considerable change, our Department will not be able to recommend
approval.
I have attached a copy of our standard form for your use.

Temporary Easement
BLACKRIVER CORPORATE PARK
Dear Bob:
As we have discussed, the ADMAC building will require an onsite
8" water line to serve Phase I of their building. Eventually,
they may wish to expand their facil4ties into a Phase II
building whici. would fall over the proposed 8" water line
presently being designed for the Phase I facility. At that time
we would have to abandon the 8" line and replace it with a 10"
line to accomodate the expansion area.
In order to avoid creating a permanent easement for the 8" line
which is likely to be vacated in the future, First City Equities
is pr.1posing we enter into an easement agreement with the City
of Renton which would automatically allow for the termination of
the 8" line easement when it is replaced with a 10" line. (See
paragraph 8 of attached form of agreement. )
Bob, I aovld appreciate your reviewing the enclosed agreement
for its application to the ADMAC property. If your city
attorney approves the use of the agreement or some revised form,
it would save us the future problem of having to go through a
lengthy vacation procedure to eliminate the 8" line.

TEMPORARY UTILITY LINE EASEMENT AGREEMENT
THIS AGREEMENT, made and entered into this day
of , 1986 by and between FIRST CITY EQUITIES, a
Washington general partnership ("FCE") , and CITY OF RENTON,
WASHINGTON, a municipal corporation ("Renton") .
1. FCE hereby grants to Renton, its successors and
assigns, an eight (8) foot wide non-exclusive temporary easement
for the installation, operation, maintenance, repair and
replacement of a waterline under the surface of the real
property described in Exhibit 1 hereto (the "Easement Area") ,
together with the right of access from the surface of such real
property and the right of ingress and egress over FCE's adjacent
land for the purpose of exercising the rights granted herein.
2. Any installation, operation, maintenance, repair
or replacement performed hereunder shall be at no cost to FCE
unless agreed to in writing by FCF, and shall be so performed as
to interfere as little as reasonably possible with the use and
enjoyment of the Easement Area and FCE's adjacent land by
persons occupying the same or lawfully present thereon. To
effectuate this intent, Renton shall keep the Easement Area and
FCE's adjacent areas free of equipment and materials at all
times, except when workmen are actively working in the Easement
Area unless FCE gives its prior written consent to do
otherwise.
3 . If the surface of the Easement Area and/or surface
of FCE's adjacent real property and/or any improvements thereon
shn . be disturbed by installation, operation, maintenance,
repair or replacement, said surface and/or improvements shall be
promptly restored by Renton to their condition Just prior to
such disturbance.
4 . FCE shall not be liable for any claim for damages
for normal and reasonable use of, or vehicular or pedestrian
traffic over, the Easement Area.
5. Renton agrees that it will permit no mechanics' ,
materialmen's or other liens to be filed against the Easement
Area or FCE's adjacent property for work or materials furnished
Renton in connection with the easement granted heroin, and
Renton agrees to indemnify and hold FCE harmless from the same.

6. Renton agrees to indemnify FCE against and hold
FCE harmless from all demands, claims, causes of action or
judgments, and all reasonable expenses, including attorneys'
fees, incurred in connection therewith, for injury to person,
loss of life or damage to property occurring on or about the
Easement Area and arising out of Renton's use or occupancy of
said area.
7. FCE agrees no buildi:ig structure shall be erected
or permitted on the Easement Area; provided, however, FCE
reserves the right to require, at FCE's expense, the relocation
of all or part of the utilities installed by Renton hereunder to
the extent from time to time as it is necessary to permit
further development of FCE's property.
a. The easement granted hereby shall terminate at
such time as Renton, its successors and assigns, permanently
discontinue use therefor or at such time as a new water line is
installed to serve the improvements on the subject property.
Renton and FCE shall execute an instrument in recordable form to
reflect of record the termination of this temporary easement.

Gentlemen/Ladies:
The following items found in our plan review must be corrected and approved before a
permit may be issued:
1. Fire Department
,A. 2000 GPM fire flow required.
One additional hydrant required at northwest corner.
—C. Provide turning radius at northeast corner by Building D.
-D. Naches Avenue S.W. to be paved prior to building above foundation.
2. Utility Engineering Division
-A. Approved water main plan required.
B. Approved sewer main plan required.
3. Design Engineering Division
A. Revise storm drainage, road and sanitary plans per comments on plans.
B� Move sidewalk to be common and adjacent with curb.
C. Provide geotechnical basis for roadway fill and pavement design. Provide
design calculations on thickness and type.
— D. Provide geotechnical basis for storm drainage - 60" storm design - foundation
rock? Pile supported?
4. Traffic Engineering Division
A. Requires that street light plans be provided to City standard.

5. Building and Zoning Department
y A. Perimeter rigid insulation to extend to top of slap (Typ).
B. Take framing members into account - including rouf trusses, uninsuiated
Glu-Lam beams, etc.
C. Provide lighting - power budget.
D. Provide L�—calcs. - Buildings C and D.
Various other notes may appear in red on your plans. These items will have to be
corrected during construction but revised plans are not required prior to building permit
issuance.
