Their review comments arc as follows: STREET IMPROVEMENTS (Gregg Zimmerman/Plan Review) Mr. Zimmerman states: "1 hold to my original opinion that the 11 x 80 asphalt pad should not he included in the latecomer assessment base. The pad in question was built as a turn out for fire truck in case of a fire in one of the two proposed houses. This mitigation was requested because the slope of the driveway will not permit fire truck access, and was installed in Seu of a turnaround at the base of the drlvew.:y. A driveway turnaround would not have been included, and neither should this be. This feature is a site-specific mitigation and was not required or expected to be of benefit to others." WATER IMPROVEMENTS(Abdoul Gafour/Water) Mr.Gafour states: A. Roadway improvements costs of $2,631.20 8.2%sates tax 215.76 Total 52,846.96 "The street improvements costs cannot be included in the water main improvements. Only the restoration cost of the water main trench can be included." B. Water system improvements. 1. 500 ft of 8"water pipe $ 8,500.00 2. 1 hydrant 1,800.00 3. A map showing the proposed boundary of the latecomer is attached c-Method of assessment 1 recommend that the assessment be based on Front-Foot for both sides of Lind Ave NW d-Special consideration No special consideration will be given to this project.The water main is installed to provide the required ° fire protection for the new residences owned by Storybook Homes. 2-Street Improvemeuts All street improvements are private improvements to provide access to said new residences. The property owners may request a hearing before the Renton City Council within twenty days of the mailing. The City Council, by ordinance or voice Vote, may delegate the hearing examiner or other hearing officer to hold the requisite public hearing and establish a record, together with a recommendation for the Renton Citv Council. The City Council's ruling is determinative and final. The Campbell/Storybook Homes latecomer agreement for water improvementsin Lind Avenue NW b6tween NW 3rd Place and NW 3rd Street was approved by the Council on September 21, 1992. Registered letters were mailed to parties listed on the assessment roll on September 28, 1992. Three appeals were filed with the City Clerk, two on October 16 from Matthew R. Dear Ms, or Sir: As you know a legal lean with King County will be filed against my Property as a result of this proposed latecomers agreement. This lean will cloud the title to the property for 10 to 15 years and adversely effect my ability to refinance or sell the property in the future. (I'm on a variable rate loan now and had planted to refinance). 1 do not believe the remote chance that the Lind Ave. water line will be tapped by myself or a future owner warrants the negative impact to the property caused by the lean, (clouded title) implicit in the agreement. Mr. Campbell has a right to his reasonable effort to reclaim a portion of the public improvement costs he needed to make to allow him to develop and appreciate his property assets, but 1 do not believe that that right extends to degrading the property titles of his neighbors. Particularly when the chance of triggering the agreement is extremely unlikely. Below I have listed additional concerns and brief arguments relevant to the proposed latecomer's agreement. There is an approx. 13% down hill grade between Stevens Ave. and Lind Ave. I have a superior water supply available for my current structure and any reasonable future structure from the line that runs along Stevens Avenue. It's an 8" line, (per .Abdoul Gafour). That's all I would need for any future use under current zoning requirements. 2. There is a very small chance given the zoning of the property that the City of Renton would allow me to subdivide the property in any way that would make it likely that the best way to get water would be from the Lind Ave. line. The current structure is centrally located on the lot. I've put about 220,000 into the house in the past d years. It would have to be bulldozed before the property could be subdivided 'u a way that would make a connection to Lind Ave. feasible. 3. The fire department has stated to Matthew Larson my neighbor to the South, (Parcel 3 in the agreement), that the fire hydrant. installed on Lind Ave. adjacent to his property is useless to both our properties due to the 13% grade and distance to the existing structures or any reasonably placement of future structures. Given the grade and the U.P.C. this limitation would reasonably extended to a residential water line. r 4. In the unlikely event that the property was subdivided during the term of the agreement there is no provision in the ordinance for the release of the lean against the named property. 5. Neither the language in ordinance No. 4189 or the Preliminary Proposed Assessment notification letter spells out in specific detail ' the conditions under which the agreement would be triggered in a case where an alternate water supply is available for either a new structure or upgrade of service to an existing structure. 6. Reading the text of ordinance No. 4189 it is clear that the intent was for: Application (9-1702) Preliminary approval (9-1703) Notice of latecomer's agreement (9-1704) to transpire prior to the proposed improvement being started, allowing the effected parties an adequate voice in the appropriateness of the proposed latecomer's agreement and the development of the proposed improvements. 7. 1 was not notified of the proposed improvements or my potential liability for these improvements in a timely manner. Mr. Campbell/Storybook Homes must have been aware of the need for the water lii.o and the implications of it's construction months prior to the application for the latecomer's agreement The City of Renton was aware of the application for a latecomers agreement on 7-11-91. 8. The City of Renton refrained from releasing the "Preliminary Proposed Assessment" notification until a detailed accounting of the "revised detailed account", of the costs of the proposed improvements was accepted by Abdoul Gafour. This was done on July 29, 1992. This delay may have been due to a misinterpretation of the terms "Preliminary determination of the latecomers area boundaries and assessment", See ( Notice of latecomer's agreement 9-1704) and the term "Final costs", See (Final latecomer's agreement 9-1705). 9. The Method used to determine the percentage of distributed liability may by inequitable. 10. The Prorated cost for the improvements may be undocumented. 11. The ordinance allowing latecomer's agreements needs to be amended to detail timely notification of effected Parties. With the grade,gravity alone could carry water to the second story of my home. In July 1992, 1 was required to increase my supply line from a 3/4" to a V. In order to avoid the$2000+meter change cost,I installed a 1 1/4" supply on a 3/4" meter at 150',which according to the UPC allows me 30+fixtures. Even with a 3/4" meter, I was required to install a PRV(pressure reducer valve)to the line because the grade allowed such great pressure(120psi wl 80psi max. allowed). In the future,we plan to add a green house,garage water and additional sprinklers which may require a meter change. I would like it the be clearly stated in the agreement that under no circumstances will the latecomers agreement be triggered if water line improvements are made on Stevens, or any source other than the specific improvements made by Mr. Campbell, 2. The fire department has made it clear to me(address change required)that the newly installed fire hydrant on Lind Avenue-- 75'in front of my house--is useless for my home due to the 14%uphill grade. Given the grade and the UDC regarding pressure, distance, size of line etc,please give me a frontal lobotomy if 1 should ever access the Lind water line, even for the lower portion of my lot. 3. Two points regarding possible subdivision: A It is extremely unlikely! The current structures re centrally located on my lot. We have invested about$30,000 in home improvements during the past 4 years. According to current zoning,I believe we would have to bulldoze our house before the p-operty could be subdivided in a way that would require a connection to the Lind Water Main for the lower lot. B. In the unlikely event that the Lind frontage property was subdivided during the term of the agreement,there is no provision in the ordinance for the release of the lien against the remaining Stevens Avenue property. Cable service should be included in street crossing. 3. Site work is expected to be to final grade before power comes in. 4. No natural gas line in Lind Avenue N.W., according to applicant FIRE PREVENTION 1. All existing fire hydrants must remain in service. All new hydrants should be wrapped with burlap until accepted by the City. 2. Permits will be required for all on-site fuel storage tanks. 3. 24-hour advance notice should be given to Fire Prevention in preparation for witnessing sprinkler system hydro test. 4. All closures of existing City water valves must be coordinated with the City of Renton construction inspector in advance. A double check valve assembly will be required on fire hydrant for construction water use. This may be obtained from the City by contacting the 4th floor Customer Service counter and posting an $900 deposit. 5. Hydrant (new) should be in service before house construction. 6. Submit separate plans to Fire Prevention for sprinkler system. 1-1/2" meter is the r^.intmum water meter size allowed for sprinkler systems. 7. Provide 20' access for fire vehicles to site at all times. 8. Contractor feels it will take 4 days to get water main in. 9. Only Lot 3 needs to have sprinkler system. 10. There is an outdoor burning ban through October. WATER i. Bailey Construction is the utility contractor. 2. The City went through the required procedure for testing, flushing, and chlorinating the water lines prior to connection to the City mains. Items discussed include: a) Vertical crosses are required at ends of water lines - these serve as pig launches and sediment traps. b) Water lines must be pigged out using polypig. Pre-con Storybook Homes Page 3 c) Water lines must be pressure tested at 150 psi plus static head, which usually works out to 200-220 psi. d) Water lines must be chlorinated. No dry chlorine is allowed. Applicant rents a pump and obtains chlorine from the City. e) Water purity tests are required. City lab picks up purity samples on Wednesdays. Applicant will need to use courier service to submit samples on other days. 3. Water line flushing water should be drained into sanitary sewer only. 4. Thrust blocks must be formed. Concrete used must be delivered to the job (no on-site mixes). At discretion of inspector, contractor may try to transport concrete for thrust blocks by pickup truck. 5. Applicant must sign authorization of special billing and water service application forms. 6. Connections to City mains are made by the City. Contractor performs excavations and supplies materials and the City crew makes the connection. 7. Crushed rock backfill to grade is required in City right-of-way. At discretion of inspector, alternate fill material may be considered for use in City right-of-way. 8. The City asked who will be submitting as-built drawings. This was not yet determined. All changes must be shown on as-builts. 9. 24-hour in advance inspection request is required. Inspection number is 277- 5570. All work must be inspected by City prior to hackfill. 10. Major changes should be submitted to the City engineers from the applicant's project engineer. 11. Requirements for petitioning for a latecomer's agreement were discussed regarding the water main. STORMW ATER 1. Final adjustments to grade must be made on inlets and catch basins prior to paving. Backfilling requirements are the same as for water mains; 95% compaction under pavement, and crushed rock to grade in City right-of-way. 3. Applicant must use temporary erosion control plans as depicted on plan drawings. 4. Contractor was advised to check diameter of control manhole orifice before installation. The existing line in easement is either vitrified clay or concrete, and is sensitive to disturbance, contractor was advised to use care when connecting side sewers, If existing line is damaged during construction activities, applicant must repair it. 2. Side sewers should be plumbed out to connection point prior to connection. 3. When excavating for sewer stubs, the City inspector should be on site. Contractor advised to install and connect sewers prior to driveway construction. 4. The City cannot guarantee the existence or condition of sewer stubs shown on drawings. 5. Condition of existing sewer is City's responsibility unless it is damaged during construction activities. Campbell, President of Storybook Homes, as developer, is asking for reimbursement toward the cost of water and street improvements proposed for installation in Lind Avenue NW at NW 3rd Street. Mr. Campbell has submitted a list of properties, by tax account 8, name of owner and address that he suggests would benefit in the future from his project. He has also submitted estimated cost data for the installation of the above mentioned improvements. In order to act upon Mr. Campbell's request, we need a response from your section specifically addressing your facility, as it relates to and/or answers the following questions: ✓ I.
