A111.1987 T I ADDENDUM "A" CONTINUED certified or registered mail, and addressed to the recipient at the address set forth on page 1 hereof or such other address as either party changes by written notice to the other. 14.7 Contractor represents and warrants that it has visited the site, familiarized itself with the local conditions, including the soil and water conditions on the site; that it has correlated its observations with requirements of the Contract Documents, that its bid takes into consideration all aspects of the site, including such situations and conditions that are discoverable by reasonably prudent inspection. 14.8 All warranties and representations made by Contractor herein shall survive Final Payment and acceptance r_f the Work. 14.9 In addition to all other warranties and representations contained in the Contract Documents, Contractor represents and warrants to the Owner as follows: 14.9.1 Contractor will exercise due care and diligence in the construction of the Work to the end that the Work shall be performed in accordance with the Contract Documents, including particularly the plans specifications. All construction methods utilized by Contractor in executing the Work shall be methods that are standard for the construction industry in general or that produce a better quality of constructions that the standard methods used in the construction industry. 14.9.2 In addition to all other warranties provided herein or by operation of law, Contractor fully, completely and unconditionally warrants and guaranties: (i) the Work against all defects for a period of one year from the date of final completion (the "Guarantee Period") , (ii) that the Work as installed, is in accordance with and fulfills the requirements of the Contract Documents, and (iii) agrees to execute and deliver to Owner a Special Warranty in form and content as set forth in Exhibit 3 hereto. In the event any of the Work proves to be non-conforming or defective during the Guarantee Period, Contractor shall replace it together with any other adjacent Work which may be displaced or damaged by so doing, without any expense whatsoever to Owner. If any such defect is observed within the Guarantee Period, Owner shall give Contractor written notice of such defects, and contractor shall within ten (10) days of receipt of said notice commence and diligently make or cause to be made all necessary repairs and replacements. Warren, City Attorney RE: Victoria Bills PUD (N-881) - Bill of Sale Dear Lynn: I have t:eviewed the amended Bill of Sale and compared it to our standard form Bill of gale. I note that the only material change is that the Bill of Sale warrants the system for a set number of years from the date of execution from this Bill of Sale, while our standard Bill of Sale contains no such langur. •,. As long as we obtain a reasonable number of years in the warranty, I can see no harm to the city. The city would not try and enforce the warranty years after the Bill of Sale was delivered to the city. However, a shorter period of time is only reasonable. I would suggest we try and pick a time within which the great majority of installation difficulties would be discovered. The warranty is aimed mainly at workmanship and not at materials unless the grantor was using knowingly substandard materials. It appears to me that we need to bargain with the grantor to establish a reasonable number of years for the warranty, and then the Bill of Sale is acceptable. Lawrence J. Olympic requires a 12" minimum clearance foe all facilities which cross our pipeline, and 4 feet of cover from the top of pipe to ground elevation. These restrictions are for limiting the amount of stress applied to the pipe and also allowing ample room for excavation should access be needed ac any time. Fur more details, please refer to the enclosed copy of our general right-of-way stipulations. We also require a minimum of 48 hours prior notice before any type of excavation near our pipeline is to begin. Upon notification, Olympic will locate and mark the pipeline through the project area before you begin con- struction.
