X'Avats Utilities Mel Wik with Puget Power stated that he had not seen approved pians and could not say if any conflicts exists. However, there is undergrounding as well as high voltage overhead on the site. Metro representatives Bill Mustered and Fred Tervet stated that contractor shall submit a dewatering plan for connection to their existing manhole 5 days prior to their anticipated construction date. bianhole shall be core drilled and core-N-seal boots used at the connections. Traffic Control Per Kim Gorman and Lee Haro of City of Renton Traffic Engineering, the contractor shall provide the following: - Plans for the existing street light to be relocated, to be approved by traffic engineering. - An approved traffic control plan for any lane closures adjacent to the site. Contractor was informed that: - Working hours shall be 8:30AM to 3:30PM. - Streets must be swept and flushed daily and as needed. - There is an existing interconnect cable running adjacent to the street lighting. Fire Prevent Jim Grey with Fire Preventiun stated: - Access to site to be passable by fire engines and other emergency vehicles and shall be maintained at all times. - New hydrants shall be covered with burlap bags until they are operational. - Hydrants shall be fully operational prior to any work on the building above the foundation. - They will perform a hydrotest of sprinkler system. - 24 to :8 hr. notice required for inspections. etormwater Kim Scattarelli with Storm Water Utility stated: - Temporarry erosion control including silt fences and detention ponds shall be installed Prior to any grading or utility work. - Contractor shall protect existing storm system from construction debris. - Connection to existing manhule shall be core drilled if knockout was not provided. Lidzbarski and Ann Lidzbarski hold a latecomer agreement for water improvements in S.W. Grady Way, west of Maple Ave. S.W. On July 13, 1989 a $5,452.42 latecomer fee was collected on behalf of the Lidzbarskis from Eugene Horbach when he developed Renton Honda and benefitted from the Lidzbarski I -'ne. 'fhe Lidzbarskis appointed Don E. Fitts as their agent in 1981, when the original agreement was executed. Fitts if the only contact person, with a mailing address, that we have in the latecomer file. Per our standard procedures, we mailed the $5,452.42 fee via Certified Mail, Return Receipt Requested, to Fitts, Lidzbarskis' agent. A copy of the s.gned receipt is attached hereto. The rest of this reads like a soap opera, so I'll be brief. Do,. Fitts called (mid-October, 1989) to say: Mr, and Mrs. Lidzbarski were about to be diNorced when Mr. Lidzbarski was killed in an auto accident. Mrs. Lidzbarski took this opportunity to remove herself from the closing affairs of her husband, remarried and left for parts unknown. Fitts does not know her new married name, let alone her whereabouts. Fitts deposited the $5,452.42 latecomer fee in his private escrow account. He said he wanted to try and locate relatives of Mrs. Lidzbarski, in hopes of finding her. We asked him, if he could not locate Mrs. Lidzbarski, to return the $5,452.42 to the City. We waited approximate'y one month and called Fitts on Nov. 14. 1989, to inquire if he had any succes eating Mrs. Lidzbarski or her relatives. He said "No". Larry Warren December 6, 1989 Page Two Fitts was told, per City of Renton Latecomer Ordinance No. 4199, that: "Should the City, after a good faith attempt to locate the holder of the latecomer's agreement, be unable to do so, the latecomer's fee shall be placed in the Special Deposit Fund held by the City of Renton for two years. At any time within the two year period the holder of the latecomer's agreement may receive the latecomer's fee. without interest. by applying to the City for that latecomer's fee. After the expiration of the two year period, all rights of the holder of the latecomer's agreement to that fee shall expire. and the Cl.y shall be deemed to be the owner of those funds.' On November 14, 1989, Fitts was asked a second time to return the $5.452.42 latecomer fee to :he City. Since we have not received the latecomer fee nor heard from Fitts is of this date, we would like your office to c3ntact him regarding the legality of the matter and to enforce the return of the money to the City's Special Deposit Fund. FiTTS/DRTAH:I( Attachments ORDINANCE NO. 4189 9-17W TITLE TO IMPROVEMENT AND ASSIGNMENT OF BENEFIT. Before the City will collect any latecomer's fee, the holder of the latecomer' : agreement will transfer title to all of the improvements under the latecomer's agreement to the City of Renton. The holder of the latecomer's agreement will also assign to the City the benefit avid right to the latecomer's fee should the City be unable to locate the holder of the latecomer's agreement to tender any latecomer's fee that the City has received. The holder of the latecomer's agreement shall be responsible for keeping the City informed of their correct mailing address. Should the City be unable to locate the holder of the latecomer's agreement in order to deliver a latecomer's fee, the City shall undertake an independent investigation to determine the location of the holder of the latecomer's agreement. Should the City, after a good faith attempt to locate the holder of the latecomer's agreement be unable to do so, the latecomer's fee shall be placed in the Special Deposit Fund held by the City of Renton for two years. At any time within the two year period the holder of the latecomer's agreement may receive the latecomer's fee, without interest, by applying to the City for that latecomer's fee.
