There shall be an annual accounting of all connections in the agreement area. The report shall be pre- pared by RENTON and conveyed to THE DISTRICT each year on or before January 31st. 7. Transfer of Easement and Right-of-Way Documents. THE DISTRICT shall officially transfer the right-of-way documents for the facilities herein sold to RENTON, and RENTON agrees to accept responsibility for all maintenance or other actions required by said documents. THE DISTRICT shall, not have any liability for disputes arising over said rights-of-way or easements so transferred, except that any disputes arising due to the acticns of THE DISTRICr prior to said transfer shall not be affected by this section. 8. Discldimer From Third Party Liability. THE DISTRICT shall not be liable for any claims by third parties arising from acts or damages by RENTON or its customers in using the facilities sold to RENTON pursuant to this Agreement. 9. Sewer Service Area Bouidary Between ",INTDN and THE DISTRICT. with the above trans er sa e, of existing face sties and service area, and reasonable service area limits corresponding to this action, the attached Exhibit "E" shows the line separating the RENTON ser- vice area from THE DISTRICT servire area for sanitary severs, said line is described in Exhibit "E-1". RENTON shall provide �jltlmate service for the area north and west of the line shown. THE Di.TRICT shall provide ultimate service for the area south and east of the line shown. 10. Maintenance of the Springbrook Interceptor. THE DISTRICT will pro- vide maintenance for the Springbrook Interceptor, and will bill RENTON on a proportional basis, determined from the ratio of RENTON customers, or customer equivalents, compared to the total number of equivalents, including customers of RENTON, THE DISTRICT, or the City of KENT (KENT) . If there are any serious problems due to a discharge which can be identified, and for which the source can b� identified, the individu;1, or company, responsible will be held liable for dame-e. If a lack of maintenance, or if the type of maintenance, by either RENTON, KENT, or THE DISTRICT is identified as the source of said problem, then the party creating, or allowing, the situation shall be responsible and shall pay the costs of repair, -6- 11, Cornection of THE DISTRICT to RrVTON Facilities, or RENTON to THE DISTRICT Facilities. Connection of facilities of either RENTON or TH DI RSfifacilities of the other, or to facilities tribu- tary to facilities of the other, shall be coordinated by both parties to asSure: a) Payment of appropriate charges, b) up-to-date accounting of connections, c) potential sources of debris, or construction damage, are identified, and d) inspection of connection construction can be scheduled. RENTON and THE DISTRICT shall each be responsible for maintenance of their own facilities, except as described in Section 10 above. Should damage of the facilities of one be traceable to a source within the jurisdiction of the other, RENTON and THE DISTRICT agree to assist each other in whatever action is necessary to identify, prosecute, fine, collect from, ^r otherwise deal with the responsi- ble party. 12. Future Annexations to RENTON. The service areas listed in sections of this GREEMENT are the only areas of cross service agreed to at this time. RENTON shall serve all other areas within RENTON without challenge by THE DISTRICT, based upon the City limits at the date of the agreement. THE DISTRICT shall serve all areas within THE "STRICT's limits at the time of this agreement, except as previously detailed. Future annexation to RENTON shall not limit THE DISTRICT providing water or sewer service to those areas within THE DISTRICT limits to the standards of THE DISTRICT, even If there is conflict with RENTON standards, unless this is altered by future agreements. 13. DISTRICT Comprehensive Water and Sewer Planninn. THE DISTRICT will SMb t the current and a17 future Comprehensive Water and/or Se%:erage Plans and amendments to eto involving area and/or improvements within RENTON City Limits. The Comprehensive Water and/or Sewerage Plans and amendments shall be in compliance with RENTON requirements for service within RENTON, except whe,e existing facilitie_ may differ from RENTON requirements. No re lacement or augmenting of the system shall be required at thi . tii,A. As new facilities are planned and constructed within RENTON, they shall comply with RENTON technical standards then in effect. 14. Extensions of Utilities Across Properties. RENTON and THE DISTRICT agree tat t ey w require property owners who must extend facili- ties to serve their property to extend said 'acilities to the far side of the property to provide a connection point for the future (or existing) facilities of the next property. -7- 15. Recording of Agreement with King County. THE DISTRICT is hereby authorized to record a copy of a resolution in which a copy of this Agreement is incorporated with the office of the Auditor of King County, Washington, for the purposes of giving notice to all present and future owners of the real property shown in Exhibit "0" that their properties are subject to the connectic charges specified herein. 16. lanctit of Agreement. This agreement constitutes the entire agree- ment o t e parties, and there are no representations or oral agree- ments, other than those listed herein, which vary the terms of this agreement. 17. Obli ationsations Intact. Nothing herein s'iall be construed to alter the rights, responsibilities, liabilities, or obligations of either THE DISTRICT or RENTON regarding provisions of water or sewer services to the properties described herein, or other properties, except as specifically set forth herein. The proposed ordinance requires the appeal to be filed within fourteen (14) days of the administrative decision implementing a land use decision of the City Council or Hearing Examiner or, if no date of that administrative decision can be determined, then within fourteen. (14) days of the issuance of any permit, license, or other city permission to proceed. The proposed ordinance seeks to strike a balance by permitting such administrative appeals but requiring them before extensive work could be done on a project. The Committee recommended that notice of the proposed ordinance be given to the Master Builders Association, the North Renton Citizens Advisory Committee, the Victoria Hills Homeowners Association, Kathleen and Alan Jett, and the Chamber of Commerce. First, it ap ealed the SEPA determination. Second, pursuant to the State statute that gives it such authority, Renton objected to the adoption of the Comprehensive Plan. It was Soos Creek's understanding that all challenges of the Comprehensive Plan, environmental or otherwise, would be withdrawn by the City as a part of the agreement to release jurisdiction of the Liberty View area, and to negotiate remaining matters between the City and the Distric� in the future. Perhaps this was just an oversight on the part of Mr. Springer, but the District considers it important that the clarification be made. I have been contacted by Paul Sikora , who represents the developer of the Liberty View project. As you are aware, he is most anxious to t ve this matter resolved so that he can proceed on his plat. Therefore, to avoid any further misunderstandings and prevent additional delay, enc'.osed 1-=rewith is a very brief Memorandum of Agreement as tc the major items between the City and the District. I have signed it, and woul,11 request that an authorized representative of the City sign it. Upon receipt of it , the formal documentation to accomplish the release of jurisdiction and withdrawal of rejection of the Comprehensive Plan could be accomplished pursuant to the Agreement.
