Each time a Kigg County inspector inspects the street opening to see if it is restored to like condition, an inspection fee is charged. Both of these King County fees are deducted out of the additional $100.00 meter fee, and the balance (if any) is refunded to the applicant. Conner Development, the developer of Winsper 1, signed a letter of special billing authorizing the City to back charge them for any fees accrued from King County as a result of their developing outside the City. The developers took out a master King County permit to develop Winsper I and entered into a stub service agreement with the City for water meters to each lot. Under the terms of their stub service agreement, Conner Development's Contractor set the stub service (pipe from water main to property line) before the streets were paved. Therefore, since no street opening will occur when the Water Shop returns to set the individual meters, the additional $100.00 fee was not required. Box 58039 Renton, ,✓ashington 98058 Subject: Proposed Service Area and Facility Transfer Agreement Liberty View Subdivision Dear Mr. Lyon: The City of Renton received the District's April 8, 1988 correspondence outlining Sees Creek Sewer and Water District's perceptions of an earlier meeting between the District and the City regarding the above referenced topics. In the District's letter, the District stated that, "The District staff and committee agreed that the City should transmit a letter to the District with the following information: a. Indicating agreement by the City of the establishment of service boundaries... b. Notify the District if the City foresaw any major problems with the methodology or the calculations in the proposed Transfer of Facilities Agreement... C. A release of jurisdiction form for the Liberty View/Conner Development proper:✓." A second meeting between the two jurisdictions was held on April 25, 1988 to review the above three issues. The purpose of this correspondence is to memorialize the understandings made at the April 25th meeting. At the April 25th meeting, Renton's Engineering Supervisor Bob Bergstrom reviewed recommended revisions to the proposed service area boundaries between the two jurisdictions. District Manger Lyon indicated his general approval of the revisions and James Craig from Hedges and Roth Engineers offered to prepare the legal description of the service area boundaries. A second issue discussed was the City's wholesaling of District utilities. District Manager Lyon questioned the legality of this type of arrangement, and the jurisdictions agreed that their attorneys need to work out this issue. With your express authority, Gary Upper of Conner Development, Paul Sikora and I will deal directly with Renton staff on all of the issues we have discussed in our meetings, correspondence and telephone conversations over the last few weeks. We will prepare a draft of a pre-annexation agreement for your review. That draft will include all of the agreements we have reached together with additional details we can resolve with the City staff. You have agreed that we need not attempt to get the signatures of all of the various property owners and trustees on the annexation petitions and letters but can wait the estimated 60 to 90 days until the Conners are the fee owners of the property. Subject to preliminary plat approval and approval of the pre- annexation agreement, the Conners will execute the annexation documents as soon as they are in fee. I want to confirm the compromise on the setback issue. Conner Development will revise the plan so that all of the lots adjoining the existing Victoria Plat, on the existing City ooundary, will have 25 foot rear yard setbacks. On the other lots, the plat will conform to King County standards and the City will accept those lots as vested, nonconforming lots. The houses or those nonconforming lots will be built to King County setback standards; however, as I have indicated previously, we believe that the set backs on those lots will be somewhere between the King County and Renton standards. Lawrence J. Warren January 8, 1988 Page 2 On the storm water detention issue, Conner Development has p_eviously agreed to pay a fee to the City in lieu of on site detention. However, as I have explained, site work must proceed this summer; therefore; Conner Development must be able to proceed with on site detention if the City has not acquired all of the necessary land or easements for the wetlands into which the storm water would be discharged. Another important issue with respect to timing is the provision of sewer service. Both the City and Conner Development would prefer to have City sewer serve the plat. This issue needs to be resolved promptly because the site development timetable will not allow for any contest between the City and the Cascade Sewer District on this point. We will proceed as you and I have discussed. We should be able to produce a draft pre-annexation agreement for your review sometime within the next one to two weeks, depending nn our ability to discuss some of the remaining issues with City staff. During the meeting we discus^ed a number of issues and arrived at certain agreements. It was understood, as part of the meeting, that your client had certain vested rights for its plat by State law which took effective July 26, 1987. Your client's plat application was filed in August, 1987. On the other hand, your client has signed a covenant to annex to the City of Renton in exchange for water service to this plat. Questions concerning application of City standards and requirements could present problems to your client or its successors when they sought to build t.n the lots after the area was annexed to the City. We .herefore attempted to resolve as many of these issues as possible. The following is a list of the issues and our resolution of them: 1. Traffic. As part of the platting process, your client has agreed to contribute to traffic mitigation, both in front of its property and off-s 'te. 2. Walkway to School. The City has suggested a walkway from your property all the way to the nearby grade school. You tell me the distance is approximately 1400 feet and would require cutting into a steep bank or building over at least two waterways. The City will require only that you provide a walkway on your frontage and not go off-site. We would strongly urge your client to give consideration to providing some method of safe walking for school age children, hopefully through a cooperative effort with the adjoining plat to north. The street widths are too narrow to accommodate much, if any, guest parking. However, your developer anticipates each residence having a two car garage with a full driveway. That should permit adequate guest parking except in extraordinary circumstances. 4. Street Widths. The right of way is too narrow for City standards. Widening the streets to City standards would destroy the plat and so the City will make no demands beyond the County standards. 5. Curbs. The County permits rolled curbs. The City does not permit rolled curbs. Your client has agreed to abide by City standards. 6. Storm Water Retention. As part of the platting process or otherwise, your client has agreed to provide on-site water retention or , alternatively, if agreement can be reached with the City of Renton, to make a contribution of the amount equivalent to the amount of expense for the on- site retention system to the City to acquire property in the Panther Creek wetlands to serve as a retention area. 7. narks and Recreation. As part of the platting process, your client was going to be contributing to the King County Park System. The City of Renton will make whatever agreement it can with the County about those funds. It was our understanding that there was discussion, if not commitment by the County, to expend part of th, ^ funds on parks within the City limits of the City of Renton. 8. Lot Size. Some of the lots are too small to meet City standards. However, the method of arranging the lots hF�: them bordering greenbelts or at least not abutting another lct back to back. Increase in the size of the lots would destroy the plat. Therefore, the City of Renton, agrees to abide by County standards. The City has previously considered experimenting with small lot development and perhaps this will serve as a test area. In any evEnt, the City has not agreed to waive its setback r<quirements when houses are actually constructed on these small lots. 9. Emergency Access. The Fire Department wants two means of access to any development. Your plat provides one current method of access and a stub street to the south which eventually will serve as a second means of access. It 's hoped that soon after your plat is developed ...gat adjoining properties will develop and second method of access will be available. Your client will explore the possibility of gaining a second means of access through property to the east so that emergency access only can be had off SR 111, Mr . The City of Fenton will agree that your client' s plat, once developed pursuant to this understanding, will contain lots that have a right to build, once the plat is annexed into the City of Renton, subject, however, to the properties meeting the City' s setback requirements and other Codes not discussed herein. By w-y of example, individual lots will be accepted by the City a3 legal building lots but the setbacks will not be waived, nor would such things as fence heights or the applicable bu"ding codes. I am sure that there are things we have not thought of. However, this is a good faith attempt by both parties to permit the development in the County as authorizecl by law while providing the City with certain assurances that City codes will be met as much as possible. I think that you have served your client well at approaching the City in this manner. Not only can your client develop as it desires but it has assurances its lots can be built upon. In order to obtain that Health Department approval, I need a letter from the appropriate sewer and water 4istrict to the Health Department. I have drafted a letter from the City of Renton to the Health Department based upon letters that have sufficed in the past frou, other district, for other plats. That draft is included here as Exhib:.t B. As far as the annexation of the sewer and water franchise area goes. I do not believe that issue comes into ` play here. Since acr.ieving that annexation through the boundary review board is a specific condition of our plat approval, King County Building and Land Develcpment will be reviewing our submission as to cur satisfaction of that condition. That happens at a later stage of their review process and we will not be allowed to record until that annexation has been completed. The Health letter is more of a routine initial submission requirement that must be submitted before the county will begin to review the final plat submission. That review typically takes two to three months. We are trying to get the review started now so by the time the franchise area annexation is completed we will be in a position to record shortly thereafter.
