Section 3-206, Subsection (F) as amended: (F) Whenever it is deemed prudent, in case of a new development of subdivision, to install the service from the main to the property line, hereinafter referred to as "stub service" prior to completion of street constiaction, the City will provide such service for sixty percent (60%) of the then current installation cost for such service. At such time that meter instalZution is requested, the remaining balance of the then current rote shall be collected and paid for by such developer or sub-divider. It is agreed by Everett Ayers and Eugene Hofman 23404 - 98th Avenue South and, THE CITY OF REM" J, that at the time of water meter installation the difference between the stub service charge and the service charge then in effect when the meter is installed (as established by City Council) will have to be paid. SUMMARY OF REQUEST: Final Plat approval to allow the subdivision of approximately 7.7 acres of property into twenty-six (26) single family residential lots. SUMMARY OF ACTION Planning Division Recommendation: Approval, with conditions. PLANNING DIVISION REPORT: The Planning Division Report was received by the Examiner on April 10, 1989 FINDINGS AND RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicants, Everett Ayers and Eugene Hofmann, filed a request for approval of a 26-lot Final Plat. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit u1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. The subject site is located north of N.E. 24th Street, east and west of Anacortes Avenue N.E., and soutl. of 138th Avenue S.E. which changes to Duvall Avenue N.E. as it enters the city. 6. The subject site was annexed to the City with the adoption of Ordinence 4067, enacted in May, 1997. The site was simultaneously classified R-I (Single Family; Lot size - 7,200 sq ft) at that time. The Preliminary Plat was approved in December, 1987. 7. The applicant was required to demonstrate through professional analysis that proposed Lot 26 in particular, and the remainder of the parcel, were geologically stable and capable of supporting development. The applicant submitted a Geotechnical Report demonstrating that the site was suitable for single family development. 8. The applicant was required to provide a secondary means of esoergertcy access or install sprinklers in individual homes subject to the approval of the Fire Department. The applicant Jintends to have individual homes sprinklered. Staff recommends that the condition appear on the face of the plat to alert potential purchasers and home builders. 9. Staff recommended that there be no access to Duvall Avenue through the proposed plat, particularly Lot 26, the northernmost lot. IU. The applicant violated the condition requiring prior review and approval of tree and shrub removal. The applicant apparently has agreed to work with staff on mitigating landscape replacement. IL The applicant proposes access to proposed Lot 26 via an easement across proposed Lot 25. Everett Ayers and Eugene Hot.....nn FP-013-89 April 17, 1989 Page 2 12. Due to the topography of the site and the location of proposed Lot 26 (generally downslops from the remainder of the plat), a gravity sewer system will probably not serve the lot. The applicant will have to provide a private lift station. Any such installation shall be subject to review and approval of the Public Works Department. 13. The applicant has acquired and provided to the city access across a parcel west of the proposed intersection of N.E. 26th Court, with Anacorles to provide sufficient maneuvering room for both private vehicles and emergency vehicles. 14. The applicant has either installed improvements, bonded for their installation, or deferred improvements. 15. The applicant has renamed or renumbered the east/west streets. The southerly east/west street is N.E. 25th Court, while the northern street is N.E. 26th Court. 16. A ten (10) foot gap appears between segments of an easement and staff recommended that this be corrected since utilities crrss this gap. RECOMMENDATION 1. The review of the Final Plat by the Hearing Examiner and City Council is limited to assuring that the applicant has complied with the conditions imposed during Preliminary Plat review. The final plat appears to sat4y the conditions imposed by the preliminary plat process, with the exception of the removal of landscape materials without city review. 2. The final plat mylar will have to reflect the prohibition of access to Duvall, the requirement that all the future homes be sprinklered, and that proposed Lot 26 will require special methods of providing for both sanitary and storm sewer lines. The mylar will have to reflect that p,.,posed Lot 26 may require a lift station to handle sanitary sewer waste; all development requiring grading and erosion control work on proposed Lots 22, 23, 24, 25 and 26 shall be subject to the approval of the Public Works Department; and that trees shown on the tree retention plan shall not be removed without approval of the City. 3.
