SUMMARY OF REQUEST:_ Approval of a Waiver for curbs, gutters and sidewalks which were part of the off-site improvements required for an approved Short Plat (file SP-050-84) approved for subject property. SUMMARY OF ACTION: Building and Zoning Department Recommendation: Recommend denial. Hearing Examiner Decision: Waivec it denied. BUILOING 3 ZONING The Building 6 Zoning Department Report was DLOARTMENT REPORT: received by the Examiner nn September 3. 1985. PUBLIC HEARING: After reviewing the Building and Zoning Departmei It Report, examining available information on file with the application, and field checking the property ano surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on September 10, 1985, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit Y 1 - Yellow file containing application, proof of posting, and other documents pertaining to this request r , Exhibit Y2 - 'ihOlt Plat Map SP-050-84. The hearing opened with the presentation of the staff report by Roger Blaylock, Zoning I Administrator. After entering the above exhibits, he continued advising a Waiver is requested for curbs, gutters and sidewalks for the approved Short Plat 050-84. The site is .04 of an acre and water and sewer will be extended ti the subject property. The request to not for any public safety improvements but is a request for a modified Waiver with the filing of restrictive covenants so an LID can be formed in Ile future to put In the improvements. The Fire Prevention Bureau requested that the Fire hydrant and water main be installed and other off-tits Improvements could be deferred, but not waived,until the building permit is issued on the first piece of property or until a LID is formed. Design Engineerirg and Utilities Engineering did not recommend approval of the applicant's proposal as they believe the Improvements should be installed at this time. Mr. Blaylock continued stating the aria is gradually developing with some curbs, gutters and sidewalks in the area south of the site on N.F. 17th Street. Deferral of the improvements would necessitate the posting of a bond as required by the Board of Public j Works. The policy granting Waivers is unclear at the present time. The Board does not prefer to accept Restrictive Coven-nts for LID's as they have In the past due to previous agreements left incomplete. He stated staff feels s'nce there are other improvements In c the area, this request should be denied. Mr. Van Parys advised the Examiner he was upset and confused with the staff report and comments from staff. He stated he requested only a Waiver Of curbs, gutters and sidewalks, but was told he did not want a Waiver, he wanted a deferral. He stated he applied for the Waiver because he can not afford the bond required by the Board of Public Works for a deferral. He said staff wants him to do all of the improvemonts to the complete site before the final mylar is accepted and the Short Plat completed. He reiterated several times that he wanted to place the improvements on the property as each lot was sold. He stated in the original application he was not required to put In a fire hydrant, but now he is. He is protesting this requirement as there is a hydrant within 120 ft. of lot one and going east on 19th there is a hydrant within 200 feet of the comer of lot one, which he feels is sufficient to serve the needs of the Fire Department. When referring to a separate recent Waiver request decision, the Hearing Examiner explained the procedure available to the applicant in requesting a reconsideration of any decision with which he did not agree. Mr. Van Parys questioned why a condition could not be placed on the Waiver requests stating no Occupancy will be permitted until the Improvements have been completed. The Examiner replied the City has had a problem with that procedure in the past. Mr. Van Parys advised the Examiner that the first building his Short Plat has already been issued, and questioned again why there could not be a condition restricting occupancy, on a lot-by-lot basis, will Improvements are completed. Mr. Van Parvs also questioned the requirement by the Design Engineering Department that he remove a hump in the street, located on the south side of lot 02,repair and repave the whole street which Is approximately 170 ft.. He stated the hump in front of his property would only require him to repair and repave approximately 30 ft.. and feels the condition that he do the complete street, both sides, (170 ft.) is unjust. He was advised by Mr. Blaylock the street issue is a separate administrative issue and can be appealed. The Hearing Examiner stated he would Incorporate Into the record, by reference, the previous recent Short Plat application, file SP-049-85. The Hearing Examiner called for further testimony in support of, in opposition to, or comments from staff for this application. I here was no one else wishing to speak. The 1 hearing was closed at 9:30 A.M. FiNDINCS CONCLUSIONS S DECISION: i 9 Having reviewed the record in this matter, the Examiner now makes and enters the ! following: I a FINDINGS: _ I. The applicant, Don Van Parys, has requested approval of a Waiver for curbs, gutters, and sidewalks required adjacent to an approved Short Plat. 2. The application file containing the application, the State Environmental Policy Act (SEPo, documentation, the Building and Zoning Department Report, and other Pertinent documents was entered in the record as Exhibit al. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA(RCW 43.21C, 1971. as amended), the subject proposal has been determined exempt from environmental review by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at the southeast corner of N.E. 19th Street and Shelton ! Avenue N.E. 6. The subject site was anr.,xed into the City by the adoption of Ordinancc 2472 in March, 1969. The zoning was modified to R-1 (Single Family Residential; Minimum lot size - 7,200 sq ft)by a consolidation of residential zones in 1982. 7. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of single family uses but does not mandate such development without consideration of other Policies of the plan. 8. The applicant has an approved but unfiled 2 lot short plat. The property wants .,n both Shelton and N.E. 19th. j fi v r DON VAN PARVS W-065-85 September 12, 1985 Page 5 i 9. The applicant actually does not want a permanent Waiver of the requirement to install curbs, gutter and sidewalks. Rather, the applicant wants to install these items on a lot by lot basis,as each of the lots is developed. III. the applicant Indicated that the bonding requirements of the provisions under which a deferral is permitted are too expensive and will not permit the applicant to develop the lots. The requirements for bonding are State mandated. 11. The Fire Department and the Public Works Department recommended that the ,A Waiver be denied. They Indicated that the curbs, gutters and sidewalks were necessary in this area. The absence or presence of similar improvements in the area was not an issue. 12. Issues outside of the province of this hearing and the published notice were raised at the hearing regarding street grade and fire hydrants. CONCLUSIONS , I. The Waiver request is not supported by the record which indicates that the applicant does not want a Waiver. but a means to defer the required Installation of ;f necessary improvments. The applicant has Indicated that tie is willing to Install the improvements as each lot is developed. Unfortunately, that is not the purpose of a Waiver. 2. A Waiver, as opposed to a deferral, is granted because the improvements are unncecessary in the area and not because the applicant wishes to phase in the improvements. Both the Fire Department and the Public Works Department 4 indicated that the Waiver should be denied and that the improvements be installed as required. 5. The applicant intends to use the Waiver as a means of temporarily delaying the installation. The applicant desires to install the improvments as each lot is developed. The stated reason is that the applicant cannot afford the wholesale installation of the required improvements or the necessary bonds, even if the Board of Public Works were to grant a deferral. q. This office cannot ignore the requirements of the Ordinance. There is er support in the Ordinances for a temporary Waiver; there are provisions for deferrals, and that appears to be the appropriate remedy. Further, this Office would be violating and short-cutting deferral policy and establishing an unwarranted precedent if a temporary Waiver were granted and the same bond provisions required of a deferral were not required. Without similar bonding there can be no assurance that the improvements would be installed. .. - 5. This Office must also ask a hard question of the applicant. Should the City place itself in the position of advancing credit to an undercapitalized business endeavor? That really is the nature of the applicant's request. The applicant has already indicated that a bank will not provide the necessary funds to allow the installation of required improvements. The requested Waiver is unwarranted. 6. It the bonding raquirments of the deferral provisions are inequitable or unworkable, the applicant can request that the City Council modify those conditions, if possible. The conditions though, appear to be imposed as a requiremec' of State law, and this office cannot offer a backdoor method of avoiding those provisions. This is especially so when the applicant can provloe no assurance that the improvements will be installed. The applicant's request that the occupancy permit f could be withheld only complicates the matter since innocent purchasers or renters could be involved by that stage of the procendings. 6. It is obvious that there :s a distinct purpose in having two similar and somewhat overlapping procedures, namely, a Waiver and a deferral. The Waiver is, or should be unconditional since, if the improvments are not necessary, there would be no need to assure by some condition that the,. be installed: while if they are •necessary, but subject to reasonable de:ay, a deferral with the required assurances of bonding Is the perferred methodology. .� i, DON VAN PARVS ell W-063-85 September 12, 1985 Page 4 .1 DECISION The waiver is denied. The Appearance of Fa:mess Doctrine provides that no ex parts (private one-on-one) communications may occur concerning land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include botn the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. The applicant, Don Van Parys, is requesting approval of a waiver of off-site Improvements consisting only of curbs, gutters and sidewalks. Until such time that street grades are established and an L.I.D. formed, such improvements were required as part of the approval of a short plat on the subject property (File Short Plat-050-84). 2. The proposal is exempt from environmental review under the State Environmental Policy Act of 1976. 3. Various City departments have reviewed the subject proposal. The Policy Development Department, the Building Department, the Police Department. and the Parks and Recreation Department have approved the applicant's request. The Fire Prevention Bureau approved the proposal with the following conditions: a. Water main along N.E. 19th required, along with fire hydrant installation. r b. Other off-site improvements may be deferred, not waived, until building permit issued on first property or until L.I.O. formed. This requirement should be convenanted against all properties. Design Engineering and Utilities Engineering did not approve the applicant's proposal. 4. Section 9-1105(6)(B)provides the means for an applicant to seek a waiver of i off-site Improvements. The applicant in this case Is not requesting a true waiver in which the applicant would never have to Install the improvements. Rather, the applicant tequests, "a waiver of off-site improvements be granted until such time that street grades can be established and an L.I.D. formed." The applicant's request is limited to curbs, gutters, and sidewalks. An on-site visit to the site confirmed the applicant's statement that these improvements are lacking in the area. The area consists of all off-site Improvements along Shelton Avenue South immediately south of the subject site, and along N.E. 19th Street and Union Avenue N.E. the improvements have rot been installed. A discussion with the Design Engineering staff revealed that the City will be installing the off-site improvements along Union Avenue N.E. during the coming year. r, era G PRELIMINARY REPORT TO THE HEARING EXAMINER DAN VAN PARYS, APPLICATION FOR WAIVER, FILE W-063-85 SEPTEMBER 10. 1985 PACE 3 5. The applicant had recently submitted a short plat and waiver application to the City (Files Short Plat-044-85 and W-060-85). On August 30. 1985. the Hearing Examiner approved the short plat but denied the waiver. The Examiner determined that the delay of off-site improvements should be handled by the Board of Public Works. The Hearing Examiner In the past has commented that 'the policy on waivers 1 is rnrrently unclear, haphazard and inconsistent." (See Short Plat-071-84, t page 3.) We agree that the City has not been consistent in allowing waivers of off-site Improvements. In addition, the policy for granting deferrals and i providing a means for installing the Improvements in the future through bonding must be reviewed since financial institutions are making It more ' difficult to obtain bonds. Until these policies are reviewed, it seems appropriate to continue with a conservative interpretation of the intent of the code section and deny the waiver request. H. DEPARTMENTAL RECOMMENDATION: i Based upon the above analysis, it Is recommended that the modified waiver request.
