The "Developer" hereby agrees and covenants to convey, transfers and assign CC) unto City all right, interest and title in and to said improvements and all appurten- ances and accessories thereto, free from any claim and encumbrance of any party whomsoever; City agrees to accept and maintain said improvement as part of its present Utilities Systems upon approval thereof by the City Engineer and after inspection of said construction. The "Developer" further agrees and covenants to execute and to deliver unto the City any and ail documents including Quit Claim Deeds and Bills of Sales that may -easonably be necessary to fully vest title in the City and to effectuate this conveyance and transfer. The "Developer" further agrees and covenants to pay unto the City such service or other charges as may be imposed by the Ordinance of the. City of Renton from time to time applicable to like users of the same class. 5. City reserves the right , without affecting the validity or terms of this Agreement to make or cause to be made extensions to or additions of the above improve- ment and to allow service connections to be made to said extensions or additions, without liability on the part of the City. 6. No person, firm or corporation shall be granted a permit or be authorized to tap into the facility for water or sewer service during the period of ten (10)iyears from date hereof, without first paying unto the City, in addition to any and all other costs, fees and charges made or assessed for each tap, or for the main facilities constructed in connection therewith, the amount required by the provisions of this contract except such charges shall not apply to any extension of the main facility. All amounts so received by the City shall be paid out by it unto the "Develcper" under the terms of this agreement within sixty (60 days after receipt thereof. Further- more, in case any tap, hookup or connection is made into any such contracted facility without such payment having been first made, the legislative body of the City may cause to have removed such unauthorized tap, hookup or connection, and all connecting (title or pipe) or related accessories located in the facility of right-of-way, and dispose of such unauthorized material so removed, without any liability on the part of the City whatever. It is further agreed and covenanted that upon e -oiration of the term of this Agreement; town: ten 10 years from date hereof, City shall be 2 of 5 under no further obligation to collect or n: any further sums unto the "Developer". The decision of the City Engineer or his authorized representative in determining or computing the amount due from any benefited owner who wishes to hook up to such improvement, shall be final and conclusive in all respects. 7. It is further agreed and understood that the aforedescribed improvements to be undertaken and paid for by Developer have been or are about to be connected with the Utilities Systems of the City, and upon such connection and acceptance by the City through its legislative body, said extension and/or improvement shall be and become a part of the municipal utilities systems. The grade and ground cover on the Existing pipe in the street area and the N.E. corner of the property line are adequate. The area in between has to be lowered in a uniform depth of three feet of cover. This will be accomplished by our engineers grades, prior to any excavation and clearinc within the premises of the property . Purposed methods to Lccomplish this in order of preference: 1. Put in the nevo system according to plans and specifications making it completely operable. This will allow us to shut down existing system through the property by turning the existing valves •,ff which will allow continued use of the water. 2. Lower existing system with the •vater turned off once drained. (cold) Pressure test prior to turning water on. 3. Dismandle and relay existing pipe to new purposed grade. Pressure test and purify prior to turning water on. 4. Lower existing main while pressure is on. (Hot) This will be accomplished by the following procedures: 1. Excavating both sides of main down to purposed grade. 2. Place timber cross trench at every joint banding joint to timber to maintain one stabilize existing position of main. 3. An analysis of the City of Renton' s Water System has been performed for the purpose of determining the available water supply for fighting a fire at the site of the proposed development located on N.E. 44th Street, just east of Interstate 405. This letter summarizes the fireflow capability of the City' s Water System based on results of the computer analysis simulating a fire at this location. Results of this analysis indicate ;hat the available fireflow at the site of the proposed developmert is approximately 3,050 gallons per minute (gpm) , at a residual pressure of 64 pounds per square inch (psi) in the main adjacent to the development, while maintaining a residual pressure along Linclon Avenue Northeast in excess of 20 psi (the highest service elevation in the Kennydale pressure zone) . The fireflow capability for this analysis was based on the Insurance services Office' s (ISO) criteria, which is used by the Washington Survey and Rating Bureau , the local rating company . In accordance with ISO criteria, the Water System was simulated experiencing a maximum day demand, with the single largest source of supply, the Mt. Olivet Booster Pimp Station, out of service (e.g., due to failure, maintenance, etc.) . A summary of the operational conditions used in the analysi3 follows: ° Minimum service pressure of 30 Dsi in the service area during normal demand, and 20 psi during fire demand ° The Windsor Hill Booster Pump Station is in operation while the Mt. RE: 44 Renton, Business Park Northwest Dear Mr. Olson: This letter is to verify the outcome of our meeting this afternoon, concerning fire flow requirements for the proposed site on N.E. 44th near the 4(5 Interchange. Tt is my understanding that we may reduce fire flow requirements by increasing separation on one side of the proposed building. If the building is moved so that it is 30' from the north property line we uan gain 5% reduction. We are also allowed an additional 5% reduction at the street due to an error in the original calculation. It is my understanding that the street side separation should be measured to the opposite side of the street and was measured to the center of the street by mistake. With these reductions and the i;,provements as shown on the Civil engineering drawings, we should meet the City requirements for fire protection.
