Said heretofore mentioned grantee, its successors or assigns, shall have
the right, without prior notice or proceeding at law, at such times as may be
necessary to enter upon said above described property for the purpose of construct-
ing, maintaining, repairing, altering or reconstructing said utilities, or making
any connections therewith, without incurring any legal obligations or liability
therefore, provided, that such construction, maintainingy, repairing, altering or
reconstruction of said utilities shall he accomplished to such a manner that the

The follo� .ng is a portion of Ordinance #3056, City of kenton, Washington,
which amends Chapter 2 of Title III (Departments) of Ordinance N1628 entitled
"Code of General Ordinances of the City of Renton" pertaining to the Water
Department, relating to charges, installations, fees and procedures.
Section 3-206, Subsection (F) as amended:
(F) whenever it is deemed prudent, in case of a new development
of subdivision, to install the service from the main to the
property line, hereinafter referred to as "stub service"
prior to completion of street construction, the City will
provide such service for sixty percent (60X) of the then
current installation cost for such service. At such time
that meter installation is requested, the remaining balance
of the then current rate shall be coZZected and paid for by
such developer or sub-divider.

STUB SLRVICL AGREEMENT
(DEVELOPER INSTALLED STUBS)
A developer will be granted a credit of 60% of the current 3/4" water service cost
for installing the stub portion of the water service when he makes a meter applica-
tion. This credit is based on a portion of Ordinance #3056, City of Renton,
Washington, which amends Chapter 2 of Title III (Departments) of Ordinance 81628
entitled "Code of General Ordinances of the City of Renton" pertaining to the Water
Department, relating to charges, Installations, fees and procedures. '

Dear Mr. Wood:
In an effort to address your December 6, 1988, letter of concern regarding the
usage of City of Renton Utility Easement 8808190375, 1 respectfully offer the
following comments.
The subject casement was granted for public utilities, including water and sewer,
not exclusively for water and sewer.
The telephone company, U.S. West Communications, and T.C.I. Cable Co., Tnc. (T.V.
cable), although privately held, are by definition of law public utilities.
The City Attorney has directed that quasi public utility companies, following
permit approval by the City, have the right to occupy City easements granted for
public utilities.
As a condition of the easement, the City requires that construction, maintenance,
repairing, altering or reconstruction of the utilities shall be accomplished in such a
manner that the private improvements existing in the easement shall not be
disturbed or damaged and that private improvements will be replaced in as good a
condition as they were immediately before the property was entered upon. This
does not mean there is not inconvenience during construction.
The telephone company is the only public utility permitted to use said subject
easement at this time. I will make every effort to see they accomplish their work
in a manner satisfactory io you.

We wish to file a protest against the telephone company, U.S.
West Communications and T.C.I. Cable Co. , Inc. , T.V. Cable, for
proposing to dig up our yard which was just recently leveled and
prepared for seeding after installation of a water main
approximately 1 1/2 months ago. U.S. West Communications said
they had contacted the City of Renton and was granted a permit for
installation of a phone cable under a public utility easement for
water and sewer lines granted by the land owner prior to our
construction of a new residence.
The telephone company drove a truck through our yard today
and was not even within the easement, leaving ruts in our newly
leveled yard.
we believe the Cable T.V. and Telephone Companies are private
companies and therefore should not be using an easement granted
for water and sewer lines. We also believe they could access the
property being developed form one of the other entrances to their
property.
If they must come through our property we believe they should
be negotiating with us to gain access not using an existing water
and sewer easement. We are enclosing a copy of our easement as
filed by your department.
We wculd appreciate hearing from you at your earliest
convenier-c as the telephone company appears to be ready to start
digging up our yard soon.
