For your review attached please rind a utility easement that PWwr has submitted to the City. This
easement is for the City to read and maintain a water meter inside a rite protection sprinkler vault mid
also for the maintenance and repair,if needed,of a small portion of the waterlbw from the front of the
private vault to the City,right-of-way.

I have reviewed the document as forwarded to me. I find it to be
in generally acceptable legal form. You raised the point that the
document appears to allow a structure over the easement. However,
the document states that no structure can be built within five
E feet of the easement, and therefore I don't think that this is ai
major problem.
III You note that the city is going to take title to the PACCAR
improvements by means of a separate Bill of Sale. This easement
appears to contain a Bill of Sale that would be adequate to
transfer title to the City of Renton. Does your department wish
to have a separate Bill of Sale document? If so, vhy?
I would like one minor change to the easement document. On the
second page in paragraph 2, line 6, I would like the word
I "negligent" inserted before the words "acts or omissions."

UTILITY EASEMENT
PACCAR Inc ("GRANTOR") , in consideration of the sum of One
Dollar ($1) and other valuable consideration, receipt of which is
hereby acknowledged, hereby conveys and Quitclaims unto the City of
Renton, a Washington municipal corporation ("GRANTEE") , a
nonexclusive easement to construct, opsra�e, maintain, reconstruct,
inspect and replace the water service, associated pipe, fittings,
valves, meters and appurtenances upon GRANTOR's land, situated in
the City of Renton, King County, State of Washington, described on
Exhibit A attached hereto and by this reference incorporated
herein.
Such parcel is also shown on the map attached hereto as Exhibit B
and by this reference incorporated herein. Said parcel is herein
referred to as the "Easement Area."
TO HAVE AND TO HOLD said easement unto GRANTEE and its successors
and assigns forever, subject to the covenants and conditions
hereof, which GRANTEE by its acceptance of this easement agrees to -
perform fully.
1. Subject only to the rights expressly granted in this easement,
GRANTOR reserves all rights with respect to the Easement Area
including, without limitation, the right to grant additional
easements, licenses and permits therein to others; the right to
install utilities and other fixtures or improvements over, upon,
across and under the Easement Area. GRANTOR shall exercise these
rights which GRANTOR has retained so as not to interfere with
GRANTEE's use of its easement. GRANTOR, in connection with any
future change in use or redevelopment of its property further
reserves the right to relocate the Easement Area and utilities
installed therein to other locations selected by GRANTOR; provided,
that the expense of any such relocation shall be burned by GRANTOR
and that such relocation shall not impair the maintenance and
operating capability of such relocated utilities.
GRANTOR shall not be liable to GRANTEE, or to GRANTEE's employees,
agents, contractors or users of GRANTEE's property, for loss or
injury resulting from any damage or destruction of GRANTEE's
facilities directly or indirectly caused by GRANTOR's use of the
Easement Area or GRANTOR's facilities in the Easement Area,
excepting only loss or injury which results from GRANTOR's failure
to exercise reasonable care not to damage or destroy GRANTEE's
facilities installed within the Easement Area.

7. GRANTEE does hereby release, indemnify and promise to defend
and save harmless GRANTOR from and against any and all liability,
loss, damage, expense, actions and claims, including costs and
reasonable attorneys' fees incurred by GRANTOR in defense thereof,
aaserted or arising directly or indirectly on account of or out of
act■ or omissions of GRANTEE and GRANTSE'■ servants, agents,
employees and contractors in the exercise of the rights granted
herein: PROVIDED, HOWEVER, this paragraph does not purport to
indemnify GRANTOR against liability for damages arising out of
bodily injury to persons or damage to property caused by or
resulting from the negligence of GRANTOR or GRANTOR's agents or
employees.
1. GRANTEE shall At. all times maintain the utilities installed in
the Easement Area in good and safe condition and repair, and
restore the Easement Area to its prior condition after any repairs
or other GRANTEE disturbance of the Easement Area.
<. If the Easement Area ceases to be used by GRANTEE to provide
water service to the building then the easement herein granted
shall terminate, and all rights, interests and privileges granted
hereunder shall revert to the GRANTOR, its successors and assigns.
Upon any termination of this easement, GRANTEE shall promptly
remove from the terminated Easement Area any facilities installed
by or for GRANTEE (except subsurface installations which can be
left in place without limiting or endangering GRANTOR's use of the
Easement Area) , and shall restore the Easement Area to its
condition prior to such removal.
5. Notices given under this easement shall be given as follows:

Either party may change the address to which notices may be given

6. GRANTOR at its expense in initially installing the water
service consisting of pipe, valves, meters and other facilities to
be used by GRANTEE in the Easement Area. Effective upon completion
of such installation and acceptance for use by GRANTEE (as
evidenced by GRANTEE's issuance of a final certificate of occupancy
for GRANTOR's PACCAR Parts Office to be served by the facilities
installed in the Easement Area, or as evidenced by other written
GRANTEE acceptance of this easement) , GRANTOR sells and delivers

unto GRANTEE all piping, valves, meters, appurtenances, and other
water facilities installed in the Easement Area, as described on
Exhibit C attached hereto and by this reference incorporated
herein, TO HAVE AND TO HOLD the same to the GRANTEE and its
successors and assigns forever. The foregoing sale and delivery
are intended to transfer to GRANTEE all of GRANTOR's interest in
the foregoing described property when installed in the Easement
Area, whether such property is correctly characterized a■ realty or
personalty.

construction o.its facilities,Gran;may from time to time construct such additional facilities as it may
require. Ibis casement is granted subject to the following terns and conditions:
1. The Grantee shag,upon completion of any work within the property covered by the casement,
restore the surface of the easement,and any private Improvements disturbed or destroyed during _
execution of the work,as neatly as practicable to the candition they were in immediately before
commencement of the work or entry by the Grantee.
2. Grantor shag retain the right to use the surface of the easement as long as such use does not

Dollar (81.00) and other valuable consideration, receipt of which
is hereby acknowledged, hereby conveys and quit-claims unto the
City of Renton, a washingto., municipal corporation ("GRANTEE") , a
nonexclusive easement to construct, operate, maintain,

Areas; PROVIDED HOWEVER, that no surface structures shall be
located within 5 feet horizontally of GRANTEE's utilities

consent (which consent GRANTEE agrees not to withhold
unreasonably) . GRANTOR shall not be liable to GRANTEE, or to
GRANTEE's employees, agents, contractors or users of GRANTEE's
property, for loss or injury resulting from any damage or
destruction of GRANTEE's facilities directly or indirectly caused
by GRANTOR's use of the Easement Area or GRANTOR's facilities on
the Easement Area, excepting only loss or injury which results
solely for GRANTOR': failure to exorcise reasonable care not to
damage or destroy GRANTEE's facilities installed within the
Easement Area. '
2. GRANTEE does hereby release, indemnify and Promise to defend
and save harmless GRANTOR from and against any and all liability,
loss, damage, expense, actions and claims, including costs ad
reasonable attorneys' fees incurred by GRANTOR In defence
thereof, asserted or arising directly or indirectly on account of
or out of acts or omissions of GRANTEE and GRANTEE's servants,
agents, employees and contractors in the exercise of the rights
granted herein; PROVIDED, HOWEVER, this pparagraph does not
purport to indemnify GRANTOR against liability for damages
&rising out of bodily injury to persons or damage to property
caused by or resulting from the sole negligence of GRANTOR or
GRANTOR's agents or employees.
3. GRANTEE shall at all times maintain the Easement Area in '.
good and safe condition and repair. '
4. If the Easement Area ceases to be used by GRANTEE to provide
water service to the building to be served thereby (being the
PACCAR Parts Division office located at North Houser Way and
North Sth Street) than the easement herein granted shall
terminate, and all rights, interests and privileges granted
hereunder shall revert to the GRANTOR, its successors and I �,
assigns. Upon any termination of this easement, GRANTEE shall fl
promptly remove from the terminate. cement Area any facilities
installed by GRANTEE, and shall re:. a the Easement Area to its
conditioi: prior to such removal.

6. GRANTOR at its expense is initially installing the water I

the Easement Area. Effective upon completion of such
installation and acceptance by GRANTEE (as evidenced by its

sells and delivers unto GRANTEE all piping, valves, meters,
appurtenances, vaults and other water facilities installed in the
Easement Area, TO HAVE AND TO HOLD the same to the GRANTEE and �t
its successors and assigns forever. The foregoing sale and
delivery are Intended to transfer to GRANTEE all of GRANTOR's +
inter at in the foregoing described property when installed in
the Easement Area, whether such property in correctly
characterized as realty or personalty.

Persuent to our telephone conversation of today I'd like to confirm
that it is necessary for PACCAR, Inc. Renton site to work this
coming Saturday, October 5, 1991.
The City of Renton North-South 12" water main will be tapped at
three locations to facilitate the installation of three East-West
fire suppression lines at the nom PACCAR Parts Division parking
lot. The work will be done as p, rmitted under the construction
1 permit #P7832. _
The water main will be shut off for approximately six hours during
which the PACCAR Parts building remains without domestic water and
fire protection water. Mr's. M. Weth-I,rbee and A. Gafour gave their
concurrence.

We have now reached agreement with the City of Renton on the
definition of the Lire protection issues in the EIS process.

These agreements are based on meetings with the City on 7 i 19
December 1989, the attached letter of 18 December 1989 from R. J.
Anderson, and a final telephone conversation with R. J. Anderson
on 20 December 1989, and can be summarised as follows:

4) Technical Ootions
The system defined in the DEIS does not meet the
requirements of the City ordinance - if it requires a public
fire hydrant system on our site. Therefore, the following
technical options, for providing separation of the public
hydrants and the private sprinkler systems, are required
only if this issue is resolved in accordance with the City-s
position. This will result in added costs to our project as
will as property easements along the path of the public
l lna on our property. However, they will all meet the
requirements of the City and our project.

Zone on conversion in 1990. Therefore, our loop will not be

Thank you for meeting with Larry Springer and me on December 71h to recap the 'Fire
Protection Issues' retail" to your proposed development. 1 want to take this opportunity
to provide additional information on backflow prevention/cron connection concerns we
discussed at that time. For ease of reference and clarity 1 will recap and respond to the
issues in the order outlined in the paper you presented.
I It was agreed that the fire flow analysis and now drawing prnvid+d earlier by
the City satisfies PACCAR's insurance underwriters needs.
2) PACCAR has not agreed with the City% position that City Ordinance requires a
public fire hydrant system on the PACCAR site. The Fin Minhal will not
approve for fire protection, any hydrants not on the public supply system.
3) It is agreed that code requires separation of a public water supply (hydrant)
system and a private sprinkler system.
e) This item presented an outline of four technical options for pre'iding separation
of the public hydrant&and the private sprinkler systems You indicated the
itsausance underwriter will allow no more than 2 risers per water feed line (i.t.
backflow prevention device),
5) There is no requirement for PAC(AR to provide hydrants on the backup(i.e.
tank supplied)system,
6) The private sprinkler system needs a flushing/testing connection (valve outlet) '
Can the cross connection risk be solved through design and type of hardware
used? It is possible to design the flushing connection to preclude the possibility
of a cross connection between the private and public systems, and the City would
have to review the specific design proposal. For further clarification see
response to item rs7.

7) The insurance underwriter requires hose stations on the private sprinkler system,
which introduces cross connection risk, Can the cross connection risk be solved
through design and type of hardware used? The City will review any specific
design proposal by PACCAR as an alternative to placing backflow prevention
devices on the City hydrants located in close proximay to the PACCAR facilities.
As a minimum the City would require the private sprinkler system hose
connections to include the following:
a) Hose connections shall be wall mounted rims 1 how teals;
b) no standpipes located away from the buildings;
e) connections shall be for hoses 1-1/2 inch diameter or smader; and
} _ d) all sprinkler risers and hose con".1;ons shall be equiped with flow
detectors.
This is a brief summary of requirements to assure prevention of cross connection
between the two systems. It is not necesssrr.y a comprehensive list, since a
review of your proposed final design may -eal the need for other specific
facilities or hardware. r
8) Will the public hydrant line on site replace the existing water main located in
Garden Avenae7 The Garden Avenue line is a 12'asbestos cement pipe
constructed in 1957. It is in good condition and will become a part of the 320
high pressure zone on conversion in 1990. The City will not abandon this line, 1
1 but will likely replace it with a new ductile iron main at a future date. The I
proposed new public main for fire hydrant service to be built as part of the
PACCAR development will be part of an integrated supply system with this line
addinf to the overall strength and reliability of the grid serving PACCAR and
the imle.triai area. The main in Garden Ave is an integral part of the City's
future high pressure zone for the industrial area. I{
I hope this further clarifies our discussions and requirements to protect the City's public
water supply system. If you have any questions or need Witional information, please

1. Puget Power still requires complete application for electric service. No
application is in to Puget Power yet.
2. PACCAR explained that building is already fed from existing 1247 substation. �.
No now service is squired, in the customary sense. I ,
3. Puget Power needs to relocate existing power pole to the north. The other
existing power pole is currently under review . It must be moved from front of
j building doorway.
4. Temporary power is installed to site.

1. City's on-site inspector will be Cory Thomas,
2. Applicant has permit for on-site fuel storage tank.
3. Fire water line will be subject to a 200 psi hydrostatic test, After testing, fire
water line shall receive a full volume flush.
4. All existing fire hydrants must remain in service. All new hydrants should be
wrapped with burlap until accepted by the City,
5. 24-hour advance notice should be given to Fire Prevention in preparation for
wilnessin�sprinkler system hydro lost. If completed sprinkler system design
indicates esser Ore water requirement, smaller fire water line and lap will br
iallowable. ,
t 6. All closures of existing City water valves must be coordinated with the City of
Renton construction inspectot in advance. A double check valve assembly will
be required on fire hydrant for construction water use, This may be obtained
from the City by contacting the 4th floor Customer Service counter and posting
an$800 deposit.
7. Emergency vehicle access throughout the site must be maintained at all times.
Do not block access to any existing building to the south.

I. Sound Utilities(859.9000) is the utility contractor. A foreman has not yet been
designated,
2. Water lines may he swabbed with chlorine, Since this site is on the Murder of
superfund cleanup site, City crew will 0RI be performing any of the water line "
installation. Instead,contractor will supply materials and perform insWlation
under supervision of City crew.
3. Water lines must be PPrcssure tested al 150 psi Pius static head, which usually
works out to 200- 220 psi.
4. Water punly tests are required. Oty lab picks up purity samples on
Wednesdays. Applicant will need to use courier service to submit sample&on
t other days.

6. Water lines and fittings am to be polywrapped.
7. Thrust blocks must be tvwied. Concrete used must be delivered to the job(no
on-site mixes). '-
- 1 8. All water line shut downs must be coordinated through City inspector. 24-hour
notice is required.
9. Fire water line ups is by wet lap. Two private contractors am authorized to do
{ this work- Speer and Pacific Water.
10. It was disclosed after meeting that superfund site boundary is west right-of-way
line of Houser Way. Therefore, water line is not itself within superfund site,
although portions r`.`,e trench could conceivably be.
1 11. Alter contractor, hydrant run,connection M valve can be made, and
pressure test can be conducted against valve.
12. John Weed pointed out that there may exist a utility conflict between the
existing 12" water main in Houser Way and the proposed 12" SD line(see
drawing 7 of 12). May have to lower existing{main at this point to avoid
conflict, Existing line is 12" Cl line- it would have to be replaced with 12" DI
line. Contractor would need to apply to the City for change order.
13. Construction staking is required for casements. Staking shall be marked so as to
he understandable to the inspector.
14. Applicant must sign authorization of special billing and water service
application forms.
15. The City asked who will be submitting as-built dmwin;s. The contractor will
keep as-built drawings on site, then the engineer will finalize them.
16. 24-hour in advance inspection request is required. Inspection number is 277-
5570. All work must be inspected by City prior to back011.
17. Major olianges should be submitted to the City engineers from the applicant's
project engineer.

1. Final adjustments to grade must be made on inlets and catch basins prior to
paving.

4. It was recommended to the contractor to verify that there is no interference ,�..
problems at SD/water line crossings by pot holing existing water main prior to
construction,
S. The grassy areas among the west side parking lot are desipnod water quality
filter strips, and must be installed carefully to comply with plan requirements.
6. Stormwater lines shall be cleaned, flushed, and debris removed from catch (
basins prior to acceptance.

into the construction permit, These conditions may only be lifted by the City.

line until the City receives verification from DOE that these plans have
been approved,
b) No work shall be performed west of the Houser Way west right-of-way
line until the assigned City inslwctut(s)have received superfund site
cleanup lraininQ,which satisfies the criteria established by the
Department of Abor and Industries.
2. As-built drawings: survey records are very important, The City requires
ccrtitled,approval as-bmlts, All bends on waterlines should he shot,and
horizontal and vertical control for all bends established. Rackfill should not he
placed prior to survey of waterline. The sewer and storm lines can be surveyed
after backfill because manholes give access to the lines,
