For the purpose of constructing,reconstructing,installing,repairing,replacing,enlarging.operating and
maintaining utilities and utility pipelines,including,but not limited to,water,sewer and storm drainage !
lines,together with the right of ingress and egress thereto without prior institution of any suit or
proceedings of law and without incurring any legal obligation or liability therefore Following the initial 1
construction of its facilities,Grantee may from time to time construct such additional facilities as it may !
require. This easement is granted subject to the following terms and conditions
I. The Grantee shall,upon completion of any work within the property covered by the easement,
restore the surface of tilt easement,and any private improvements disturbed or destroyed during
execution of the work,as nearly as practicable to the condition they were in immediately heforc
commencement of the work or entry by the Grantee.
2. Grantor shag retain the right to use the surface of the easement as lung as such use does not
interfere with the easement rights granted to the Grantee. Grantor shall not,however,have the right to
a. Erect or maintain any buildings or structures within the easemenC or
b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or
interfere with the utilities to be placed within the easement by the Grantee;or
C. Develop,landscape,or beautify the casement area in any way which would unreasonably
increase the costs to the Grantee of restoring the easement area and any private improvements therein
d. No digging,tunneling,or other form of construction activities shall be done on the property
which would disturb the compaction or unearth Gnrttee'a facilities on the righto4way,or endanger file
lateral support facilities. -
e. No blasting shall be done within Sheen(IS)feet of the right-of-way.

This project will be approved by this department subject to the following conditions:
Life Safety Items None
Non-Life Safety Items:
Submit the backflow prevention test reports for the DDCVA for the fire sprinkler system
and for the DCVA for the landscape irrigation. The tests and repoits shall be done by a
Certified Backfiow Tester on the approved list of testers issued by the Department of
Health.
Submit the"as-built"civil plans on mylars for the water main improvements. The"as-built"
plans shall be certified and have a seal-stamp and signature by a Professional Engineer
or a Land Surveyor registered in the State of Washington. -
A new easement With a revised legal description shall be required it the water main
Improvements were constructed outside of the boundary described in the original
easement given to the City( King County Recording No. 9205280698). This stem can
only be verified after the submittal of the as-built drawings.
Provide a"Bill of Sale"and"Cost-Data Inventory Sheet"for the water main improvements
that will be conveyed to the City for maintenance and operation. Also provide a
"Maintenance Bond" in the amount of 10% of the water main improvements and others
utilities that Will be conveyed to the City Blank forms and completed sample-forms can s
be obtained at the Customer Service counter located on the fourth floor of City Hall (235-
2631)
The new building was constructed on an existing easement to the City. The applicant
shall apply for a"partial release of easement"from the City Council for the portion of the
easement covered by the building footprint.
Upon submittal of all of the above documents, please allow 10 waking days for the ;
verification of the documents for accuracy.
