For the purpose of constructing,reconstructing,installing,repairing,replacing,enlarging,operating and
maintaining utilities and utility pipelines,including,but not limited to,water,sewer and storm drainage
^ lines,together with the right of ingress and egress thereto without prior Institution of any suit or
proceedings of law and without incurring any legal obligation or liability therefore. Following the initial "
construction of its facilities,Granite may from time to time construct such additional facilities as it may
i require. This easement is granted subject to the following terms and conditions: I
1. The Grantee shall,upon completion of any work within the property covered by the easement,
j rcatorc the surface of the easement,and any private improvements disturbed or destroyed during
execution of the work,as nearly as practicable to the condition they were in immediately before
! commencement of the work or entry by the Grantee.
2. Grantor shall retain the right to use the surface of the casement as long as such use does not
interfere with the easement rights granted to the Grantee. Grantor shag not,however,have the right to:
a. Erect or maintain any buildings or structures within the easement or
' b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or
interfere with the utilities to be placed within the easement by the Grantee:or
c. Develop,landscape,or beautify the easement area in any way which would unreasonably
increase the costs to the Grantee of restoring the easement area and any prtwtr improvements therein.
d. Dig,tunnel or perform other forms of construction activities shall be done an the property which
would disturb the compaction or unearth Grantee's facilities on the rightof-way,or endanger the lateral
support facilities.
c. Blast within fifteen(15)feet of the right-of-way.
This easement shag run with the land described herein,and shall be binding upon the parties,their heirs,
successors in interest and assigns. Grantors covenant that they arc the lawful owners of the above

Willamette Meridian, and also being a portion of Lot 12, Block 2 as shown on the Plat of
Sartorisville, recorded in Volume 8 of Plats, Page 7, records of King County Washington, said
easement being more particularly described as follows:
BEGINNING at a point on the south line of said lot 12,distant along said south line Na9.57'00•E
37.00 feet from the southwest corner of said Lot 12; thence from said POINT OF BEGINNING,
leaving said south line N00.06'10'E 9.00 feel; thence N89.53'50'W 13.49 feet; thence +
a N00.06'10•E 15.00 feet;thence S89.53'50•E 28.49 feet-,thence S00.06'10•W 23.%feet to return
to the south line of said Lot 12;thence along said south line S89.57'00•W 15.00 feet to the POINT

ISSUE:
The Renton School District is seeking exemption from the water SUCC fee for project 09371-anew
modular office building located at the Renton School District Facilities and Operations Center at
1220 North 4th Street.

There is in fact an exemption from the City sewer and water SUCC fees for "Municipal
Corporations", as spelled out in City Code Sections 8-4-41.B.3.1 (water) and 8-5-17.8.3.i (sewer).
This provision was added to the code by means of Ordinance No. 4321. and was adopted to
establish guidelines for assessing these fees against school properties in padicular(atlddions a the
7' Tiffany and Talbot Hill Elementary Schools led to the ado rop of this provision). Section 8-4-
41d.8.3.i is attached for reference.
This provision of the code allows limited exemptions from SUCC fee assessment for portions of

This provision of the code provided significant exemption from the SUCC fee assessment for the (.Tiffany and Talbot Hill Schools. In those cases,the entire playground areas were exempted from
fee assessment by means of recorded segregation. i

the sewer SUCC fee is being triggered because of the need for an upsrzed side sewer(Section b-5-
17.B.3.f(6)). The applicant has requested an exemption from the code requirement for a separate
water service meter for the proposed new building. Neil Welts'attached letter of October 14. 1992
J denies this request. The sewer and water SUCC fees are triggered for this project due to utility
{ connection criteria.
' I believe that this pmiect cannot be exempted from the SUCC lees by any provisions of the curtent
code. The site is almost entirely paved and fenced in,and serves as a bus parking lot in addition to
a facility and operation center. This site is not"available and maintained at all times for public use',
and It is covered with'parking lots, driveways' and"similar areas which"shall not be pan of the 1
exempt area'. The portion of the code providing limited exemption from the fees for Municipal
Corporations sta,us that"the Administrator of the Planning/Building/Public Works Department shall
make the final decision on the interpretation of this limited exemption and the achievement of
substantial equity'. This project therefore could be considered exempt from fee assessment on an
administrative staff level, but in my opinion such a delermmation would not be in keeping with the
intent of the code.
Other options would be to initiate another code revision For instance,all school property could be
exempted from SUCC fees. This in effect would be to relieve school properties from the obligation
of paying their fair share portion of the utility infrastructure. This is an equity issue that would have
to be addressed by the City Council.
1 RECOMMENDATION:
(
If there is a strong will among the Mayor and/or the City Council members to exempt school
property from SUCC fee assessment, we can fairly readily change the code to accomplish this.
Otherwise, this project clearly triggers the Cnn.•nt sewer and water SUCC fees, and we shout'
assess these fees

I have received you d plans and cover letter dated October 7, 1992. The submittal
provides the necess matior. net revisions for the earlier drainage and sanitary side
sewer concerns. The water utility related issues still have not been satisfactorily addressed on
the pian submittal. Yon must submit plans for the required water meta for the new building
and provide engineered plans for the required on-site fire hydrant. You must comply with
thaw requirements before we can approve the building permit for,your proposal.
You have requested an exemption from the Code requirement for a separate water service
meta for the proposed new building. Yo, base this request on'the guidelines of Ordinance 8-
4-4 B.' The portion of this section you then quose must be evaluated in terms of the wording
for the entire section, not ss a separate statement as you have presented in your leer. The
suction you cite begins as; follows. 'A separate service connection with the City water main
must be installed by every residence and commercial building supplied with City water in front
of which there is a main, and the buildings so supplied will not he allowed to supply water to
other buildings, except temporarily what there are no mains located in the streets;provided—
." The section then goes on to explain joint service options when this initial condition is met.
Your proposed development does not meet this initial requirement for joint service since there
is a water main located in the street adjacent to your site. Therefore, you must provide a
separate domestic water service meta fur this new building as specifically required in the
Ordinance which you have referenced.
