CONSTRUCTION REPORT FOR PUBLIC WATER SYSTEM PROJECTS
Effective September 9, 1983 the following Regulation applies: WAC 246-290-040(3)-A construction report
shall be submitted to and accepted by the department within sixty days of completion and prior to use of any
project for which plans and specifications have been approved by the department for projects designed by a
professional engineer. The construction report must be signed by a professional engineer. The report shall
state in the opinion of the sign"whether the project has been constructed in accordance with approved plans
and specifications and the installation,testing and disinfection of the system were carried out in accordance
with department regulations.
a) If a project is being completed in staged construction,attach a map and description of portion of project
being certified as completed as approved on date given below.
b) As future portions of staged construction projects are completed,each must be certified as required by
WAC 246-:,W04t(3).
c) Additional certification forms are available upon request from DOH offices listed below. 4

I have reviewed the easement and Quit claim deed that you have submitted,along with the plan for
the new water main and hydrant submitted by your engineer Shupe Holmberg, and I have the
following comments:
The legal description as shown on the Quit claim deed is incomplete. It does not describe the one-
foot strip between the end of the platted road and the 45 foot wide strip to the north. I suo-;est that
you obtain a revised deed with the correct legal description. You then need to Convey a 20 foot
wide utility easement across that strip to the Cily of Renton.
The easement that you have obtained from Anona Gale Gray does not give a wide enough access
to your lot. It appears that there is only about two-feet of frontage adjoining the existing paved
street. An additional easement for private access is needed from the property owner of tax lot 151,
A separate 20 fool utility easement from Anona Gray to the Chy,is required for the new water line
and fire hydrant
The connection between the new water main and the existing water main is outside of the
easement A separate utility easement to the City from the owner of tax lot 151 is required.
I am also sending my plan review comments to Shupe Holmberg per the attached letter
I recommend a meeting between you, Shupe, Neil Watts(Plan Review Supervisor)and myself to
further discuss this matter and answer any questions that you may have.

' - Any street or easement improvements necessary for providing access are the applicant's responsibility to desin
and construct. Any design for awess must be approved by the City prior to issuance of building permits for the
f property.
This particular location if not typical. I agree entirely with Jad. Crumley's observations and recommendations
of this situation. With the information available, I recommend that we advise the applicant that access is not
currently available to his property from NE 27th Street, and no Improvements are going to be provided by the _
City to provided such access. Any design for access by the applicant's Civil Engineer using this right-of-way
must be evaluated by a geotechnical engineer for stability, as well as po,ential impacts on the existing sewer
main, Additionally, the applicant would be responsible for paying the review costs for a second geotechnica!
I engineer selected by the City to review the accrss design and the first geotechnical report and recommendation.
It is most likely that such an access design would be deemed infeasible due to the high cost involved with
stabilizing the slide areas.
Access could be provided by an easement across private property to the site. Such an easement may slur be
required to extend water service to the site.
Sewer is not available to this site. "rhe site is located within APA Zone 2, whroh prohibits septic systems
without special approval through the Waste Water Utility. Water service is also not readily available for this
properly. The applicant must demur trate water service will be extended to the site for both domestic
service and fire protection. A drainage control plan and report will be required for development on this sensitive

.j In conclusion, the applicant should be required to eq present conceptual plans for access, utility service and
drainage for review
by the Cit}". A geotechnical report will probably be needed for this project, and certainly
will if any action if proposed for the NE 27N St righbof-way. The applicant should be advised that we do not
believe that access from NE 27th St will be feasible• and that helshe should work at obtaining an easement to I
provk!e accrss to the property.

SUBJECT: Single Family Residence Application at 2733 NE 27th Street
I An application has been received to build a new house at 2733 NE 27th Street
(please see attached map). This house is east of the road closure on Devil's
Slide. After the slide a couple of years ago the decision was made
administratively to close;he road. That decision leaves this property landlocked
without any legal access. We now have tc decide if this decision will stand up to a
lawsuit We need all comments from all concerned parties regarding the
problems the,:would be associated with issuing a permit. The neighboring -
property owner was required to get an easement from his neighbors to the west
for access to his property and that is what this applicant may also need to do.
The owner of the property would like an answer ASAP as to whether he will be

I Installation of a new 8 inch ductile iron water main and a fire hydrant within 300 feet of
the proposed structure, at the applicant's cost. The location of the new water main and
hydrant will be determined based upon the Citys requirements for the proposer' access
road to the site. A civil plan prepared by a professional engineer registered in the State of

I have reviewed the subject application and have the following comments/
requirements.
• The subject property ties adjacent to that portion of NE 27th Street that is
closed to the public.
• In addition, a major slide occurred in 1991 along a portion of the closed section
of NE 27th Street directly adjacent to this site. The City has made such repairs
to allow our maintenance crews access to the Devil's Elbow Lift Station and
gravity line in Honey Creek. This repair is not of sufficient design to allow the
public to utilize this roadway. and therefore, it is not my recommendation that
this portion of NE 27th Street be opened for access to the subject property.
• Sanitary sewer is currently not available to this site, nor is ,t anticipated to be
available in the near future.
! • The Wastewater Utility has no objections to allowing an on-site system for this
I site, pending Seattle-King County Health Department approval. In addition, an
analysis needs to be performed that demonstrates that flows introduced to the
1 groundwater from the on-site system, will not have any additional impacts to
the slopes for NE 27th Street.
• In addition, because the site is located in Zone 2 of the Aquifer Protection Area,
a variance is required to allow an on-site system within Zone 2. Wastewater's
only requirement for this variance is that a temporary service agreement be
issued requiring connection to the sanitary sewer upon its availability to this
property. The variance request is being handled by Carolyn Boatsmen (X-"l 11.

BACKGROUND.
1. In the late 19g0's the former NE 271h Street.Commonly called Devil's Elbow,showed signs of
subsidence in three places west of Honcy Creek and in one Platt cast of the creek. The mad was closed
while a decision was made on what actions should,or should not be taken.
2. The City had a gemechnical Consulting firm investigate both the problem and the possible repairs.
Their findings were that the areas of subsidence were in fact moving and were within an arm of greater
j unit movement. The mtmrive measures that were recommended were heroi4 in 0alum and well out of
the main of Tali for the City to undertake The road remained closed while Rentmts officials graDoled
with the problem
� 7. During that period of tit.,the cress of subsndetxe move again,further emphasizing the unstable nature "
of the region. After reviewing citizen input(the people Cast of Honey Creek felt veq inconvenienced by
the closure of Devil's Elbow),and a honest review of emergency response patterns,a decision was made to
eliminate Devil's Elbow from the City's list of streets. As if to punctuate that decision,one subsidence
area west of the creek slid away leaving a large chasm where the street had once been. Thus slide was h j
approximately 910 cast of the inmrsectioo with Edmonds Avenue NF.. A second lesser side on the west —
side and a single slide on tlw cast side of the creek Occurred at the same time.
i a, Renton decided to repair the major slide ody because a regmnnl sanitary sewer line was carried away
when the nghbOf-vvaY gave way. That sewer had to be put back into use to maintain sewer acrvlce to
much of northeast Rena in doing the repairs three decisions were made, to only make the repairs on
the west side of the creek to abnndon the water Jinx in Devil's Elbow approximately 420 feet cast of
Edmonds Avenue NE and to allow that pan of the water line east of that point to be Covered into a
replacement sanitary sewer, and to make the repairs in slide zone of former roadway only good enough to
insure the sewer would slay in place(and to Allow access to maintenance personnel to the sewer lift station
which ads near the creek). Lastly,barriers and later a gate Caere Con9mded to Prevent the public from
inadvertently using the old rlghtof-way of still Questionable stability

OBSERVATIONS ON THE APPLICATION.
1 Tile apparent point of driveway access to the proposed house Is east of the major slide area noted
above. Therefore,people would have to cross the slide mile to reach the driveway. As the rcpanrs node to
the slide were only done to stabilize the sanitar)sever,the first question that the engineer or gCotcehnncal
consultant should answer is whether thos repairs an done well enough to risk allowing the public to use
them. In lieu of such a judgment 1 would mcaumerld that the right of way should not be opened to the
public.
2. It appears that with the cooperation of the ownu of the 1.94 acres south of the applicants property that
e abandon rrightan easement could be obtained to Ferndoic Place NE This route would avoid the use of th
j' of way,and may even be less espcusnc ro comtnut than the proposed drivcwa)'to Devil's Eblow.
Perhaps the City staff Could offer to do the work to secure the ueemml as a Inde-off on the"landlocked"
issue. (Since there Is no water available fronting the applicants site they will have to exaxed R from some
existing source and the logic,pla,—would be to bring the water in from Ferndale Place NE,which is the
Came route as the access easmem just suggested.)

eq,,al footage could be made to off-set any lost value to the owner giving the cuanrent),and that the issue
of how waltr,sewer.and on-site dninag•could be handled should be addressed as well.
Should t'•ar not be axeptablt to the applicant then the gectechmcal analysis discussed abo,o should be
made,and the issue of public use of that pan of the Devil's Elbow be once again mvicastd by legal staff
