The bid opening for this capital impressment project was held September 3, 1996. The bid was based on
Schedule B & C with Schedule A as an alternate schedule. All bidders were ministered to fill out the Non.
Collusion Adctiom form,Bid fond,Signed Bud Protr sal and Sub-Contractor list pnor to submitting their bid.

SUBJECT: Change Order to CAO-WI06(Project Extension)
Tb=arc two valuable advantages why this ch nge order was made. Me first is that the coraraeor is
available row and can star) work on January lath and has given us a good price. The second reason
is we will not have to waste time and money rebidding this project with the possibility of receiving a
higher bid.
This construction contract document for tide President Park Steel Main project was based on bid
^� schedules B and C. Schedule A was an additive bid schedule. Me City Counted awarded the contract
J tir schedules B and C only. The Water Utility did no have sufficient funding in 1996 to carver the
expense of schedule A in addition to B and C. }'
Now that the 1997 Budget has been approved and the contractor is near completion of the current r:
project.Larry Warren was asked what procedure would need to be accomplished in order to allow the
contractor can be awarded schedule A. He explained that this transaction can be accomplished
through a change order in the amount agreed upon both parties. Since the contractor agreed to honor
his original hid of S 103,152.41 we wrote a change order m advised by Lamy.

Now that the council will hear the budget proposal tonight.I ram to ask you if I can request my contractor to
extend the project fusing his initial bid price of$103,152.47 tax included)? I have paid him this month so no pay
estimate would be due until January. I asked Larry Warren if we could legally proceed with such a change order.
We have his blessing.should we chose to extend the scope of work.
What I don't know is how much money will be cloned tw next year. Either way.the money to do this extra work
would be cost effective. Please let me know so I can either prepair to close out this project or extend it.

MAIN REPLACEMENT PROJECT -
The bid opening for the subject project was held by the Deputy City Clerk on September 3, 1996 at
2.30 PM. Since the project was based on schedules B&C,with Schedule A as an alternate schedule,
two kids accompanied each contractor's bid. The City received six responsive bids for the project.
The low bid for all schedules was submitted by Kar-Vel Construction,Co.in the amount of
$335,459.98, `

The mgincer's estimate was$335,837.13.
There were no irregularities in the low bid. (see issue paper) However,the Water Utility is exercisingr
its option to void Schedule A from the contract. Therefore,the recognized low bid submitted by Kar•
VO Construction,Co.is$228,297.41. The total bid is within the Water Utility's budget for this
project.
The PlanningBuilding/Public Works Department raommends that the low bid submitted by Kar-Vel
Construction,Co.be accepted and the contract be awarded to Kar-Ve1 Construction,Co.in the trial '

The award of a capital improvement project(W-fR-2237)to Kar-Vcl Construction,Inc.,who failed to fill out a
JNon-Collusion Affidavit form as instructed in the bid document prior to the opening of the bids.
RECOMMENDATION:
The Utility Systems Division of the Planning/Buildingftblic Works Department recommends that Council
waive the irregularity of not signing the Non-Collusion Affidavit form and award Schedule B and C of the �f ,
contract for the President's Park Stecl Water Main Replacement to the low bidder,Km-Vel Construction,Inc.in
the amount of S228,307.41- i '7
BACKGROUND SUMMARY:
The bid opening for this capital improvement project was held September 3, 1996, The bid was based on
Schedule B d: C with Schedule A as an alternate schedule All bidders were instructed to fill out the Non-
Collusion Affidavit form.Bid Bond,Signed Bid Proposal and Sub-Contractor list prior to submitting their bid.
Sir bids were received. TM apparent low bidder was Ku-Vel Construction,Inc. The low bidder and the fourth
lowest bidder failed to fill out the Non-Collusion Affidavit form provided in the bid document The second low
bidder officially protested the bid presented by Kar-Val Construction, Inc., citing the low bidder's failir,to
provide the Non-Colluson Affidavit at the time of bid opening constituted a non-responsive bid.
CONCLUSION:
This issue was presented to the City Attorney. In Ns opinion,failure by the low bidder to sign the Non-Collusion
Affidavit form does not merit a non-ruponsive bid as long as this form is signed prior to the execution of the
contract.

SUMMARY Of PROPOSED CHANGE.
The contract specifies the installation of premium grade netted sod consisting of 501/6 Rye,306/6 Blue Grass,
and 20% Syscue. Because of the seasonal climate change at the time of restoration, the contractor has
requested a change order to use a hydroseed mix equaling the premium grade sod. The contractor agrees to re-
seed between April I Sth and June I, 1997. All other preparaviso prior to hydroseeding will apply to the town
restoration as identified in the specifications. The contractor agrees to tape,or rope off the affected seeded arw
for a minimum of two weeks upon completion of the initial hydroseed application.

SUBJECT: $250 Reimbursement to Homeowner for Plumbing Costs
Richard Haugen,a resident at 620 Tacoma .Ave. NE, filed a claim against the City for the cost he
incurred to replace a section of his private service line to his meter. He claims (as does his
plumber) that the damage at the connection point was directly related to the City's contractor
reconnecting his old service to the new meter service.
Unfomwtely, Mr. Haugen had a break in his service line over a weekend and did not know to
all 911 in order to contact our on-call personnel Nor could he contact the contractor. This left
him to contact a plumber,(Onis Plumbing). -

The bill he incurred was$250. He claims it would have been much more if he didn't expose the
existing service pipe prior to the plumbers arri•al. Also, he claims that the cost to him would
1 have been the same if the plumber would have simply reconnected the old service line at the point
of its break to the new copper line coming out from his house as if he replaced the connection to
the house all the way to the meter. (He opted the later)
Mr. Haugen's claim was denied by the City's claims authority because the City is self insured and
is under contract with Kar-Vel Construction who is covered for such damage. Since then,he has 1t
contacted me. I referred him to the contractor who is denying payment because they did not get
notified in order to make the repairs themselves.
