SUMMARY OF ACTION: Building and Zoning Department Recommendation: •Approval Hearing Examiner Decision: Approved, with conditions. BUILDING & ZONING The Building & Zoning Department Report was received DEPARTMENT REPORT: by the Examiner on May 12, 1987 PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application, and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on May 19, 1987 at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow File containing application, proof of posting and publication and other documentation pertinent to this request. Exhibit #2 - Site Plan. Jeanette Samek-McKague, Senior Planner, opened the hearing presenting a staff report review to the Examiner containing:.such information as the applicant wishes to finish grading on the site; the site is shown on the Comprehensive Plan as greenbelt and medium density multi-family. She stated 2/3 of the site is commercial and 1/3 is zoned R-2; this proposal is to complete work applied for under a previous application for 185,000 cu. yds., which has since expired. The applicant must still remove 66,200 cu. yds. from the site and complete the final grade. The ERC reviewed the project and a review was given of the mitigating measures such as Saturday work hours having been set, haul routes are to be worked out with Public Works and the Police Department; a bond will be posted for street cleaning, revegetation and hydroseeding is to be completed on the site by_October 1, 1987; no grading will occur during the wet season beginning in October; and a hard surface exit road and wheel wash will be located on the site. Mrs. Samek-McKague continued with a review of the 7 criteria to be considered for a Special Permit noting the property is 7.5 acres with slopes up to 40%; the previous application was for 6.7 acres but since the last application the applicant has obtained additional property in King County which has been added to the project; there are projected to be about 6 to 7 truck trips per hour during weekday hours; and referring to landscaping and screening it is felt given the length of time the project will be continuing, and due to the location of the site, it would not be possible to screen the complete site so staff is only requiring setbacks from the steep slope areas and protection for the natural vegetation buffer. Mitigating measures have been taken for noise and dirt concerns; the applicant will be providing detention ponds on the site to control storm drainage on the site and prevent erosion; box culverts and ditches will be kept clean; and the applicant at this time does not have any specific proposals for the site although there has been some consideration given to the development of an office complex. In conclusion, Mrs. Samek-McKague stated staff does not feel this proposal will have a detrimental effect on surrounding 'properties and recommended approval subject to the applicant meeting the mitigating measures of the ERC; the project is to be worked on between May 15 and October 1st for the duration of the permit, hydroseeding and revegetation activities are to only occur after October 1st, and the Special Permit be approved for a 2 year period. The Examiner called for testimony in support of this proposal from the applicant or their representative. Responding for the applicant was John Baima, 1505 N.W. Gilman Blvd., Suite #7, Issaquah, Wa. 98027. Mr. Baima stated the applicant has no problem with any of the conditions set out. by staff in the report.. The Examiner questioned if the steep slopes to the north and'west-of the site 7 \ KOHL EXCAVATING, INC. SP-004-87 June 4, 1987 Page 2 are going to pose a problem and Mr. Baima stated there would be none, there had been a slight problem in the southeast corner of the site and the property to the south which they have tried to stabilize as much as possible staying within the confines of their own site. He said due to the fact they can not encroach onto the adjacent property it is not possible to clean up the problem in its entirety. There is no problem with the city's box culvert at the airport; they hope to finish work on the site by October 1st if a suitable receiving site can be found; only asked for a 2 year permit as they are not sure where the receiving site will be; and concluded stated annexation proceedings are currently in the works for property to the north of the site as well as portions of the northeast corner and northwest corners of this site. He had no further comments. Wishing to respond to this application was Morgan Bradley, Muckelshoot Tribal Council, 39015 172nd Avenue S.E., Auburn, Wa. 98002. He stated the concern was the intent of the applicant and if they were going to put the excavated material into the Springbrook Creek area, and stated if the applicant ' intends to do so his organization wishes to be kept informed. The Examiner pointed out there is no requirement as to where the applicant could move the fill material as the permit is issued for the excavation of the site and the material could be moved anywhere fill material is necessary. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 9:30 A.M. FINDINGS, CONCLUSIONS & DECISION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Kohl Excavating Inc., filed a request for approval of a Special Permit to excavate and grade an approximately 7.5 acre site by removing approximately 66,000 cubic yards of material. 2. The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation and other pertinent materials was entered into the record as Exhibit #1. 3. The Environmental Review Committee (ERC), the City's responsible official, issued a Declaration of Non-Significance (DNS) for the subject proposal. 4. The subject proposal was reviewed by all departments with an interest in the matter. 5. There was no opposition from the public regarding the subject proposal. 6. The subject site is located on Rainier Avenue North at the extreme north end of the City. The lot forms the current north and west boundary with King County in this location. An annexation of the next property north is under review. In fact a portion of the subject site is part of the annexation request. The permit would not be valid for those King County portions of the subject site until the annexation is perfected. 7. The area contains a mix of uses. North, again, in King County, is commercial and residential. West of the site are single family homes located across a stream course and considerably above the subject site on a bluff in King County. The Renton Municipal Airport is located east of the site across Rainier. Residential and undeveloped property is located south of the site. 8. The site was annexed into the City with the adoption of Ordinance 2019, enacted in April, 1963. Two separate rezones account for the two zoning districts found on the subject site. The first rezone was enacted in May, 1963, Ordinance 2030, which reclassified the eastern half of the site from G-6000 (Single family residential) to B-1 (Business/Commercial). The second rezone occurred in April, 1976 with the adoption of Ordinance 2926. This second rezone zoned approximately the western half of the site from G-6000 to R-2 (Duplex Residential). 9. A special permit which permitted the applicant to excavate the site was issued in June, 1986 (Special Permit-023-86). The permit was limited to work during the 1986 'dry' season due to the extremely steep slopes involved. The permit expired by its terms on October 31, 1986. The applicant succeeded in removing approximately 120,000 cubic yards of material leaving approximately 66,200 cubic yards of materials to be removed. Therefore, the applicant has requested the new permit to continue and finish the grading of the subject site. 10. Since no market has been established for the materials, no haul route has been specified. The ERC has required Public Works and Police approval of any haul route. 11. The original application was for approximately 6.7 acres. The current application covers 7.5 acres. The difference is based upon the applicant's acquisition of property north of the subject site. That property is the subject of the previously identified annexation, but currently still within King County. KOHL EXCAVATING, INC. SP-004-87 • June 4, 1987 Page 3 12. The estimates are that the site will generate approximately 6 to 7 truck trips per hour based upon hours of operation limited to 7:30 AM to 3:30 PM, weekdays only. The ERC has recommended Saturday hours to lessen the weekday impacts. 13. The previous operation apparently did not adversely affect the stream course located westerly of the site. Nor was there any adverse affect on the city box culvert located at the Renton Airport east of the site. Sedimentation was a potential problem. The residential neighbors initially interested in the project did not object to the new permit. 14. Natural vegetation will be retained on the site to insure slope stability along the west, south and east slopes of the site. Enhancement by hydroseeding and reforestation will occur, again, to ensure or restore slope stability. (See plans). 15. During the hours of operation there will be an increase in noise as excavation occurs. The limitation requiring daylight operation should minimize the impacts on the surrounding community. 16. Staff has recommended that the permit be issued for a two year period but again be limited to the so-called dry season. The window recommended was May 15 to October 1 of each of the next two years. CONCLUSIONS' 1. The subject proposal appears to serve the public use and interest. It will eventually create a useable building pad and accommodate new development on the north boundary of the City. 2. The safety concerns raised during the initial permit review appear to have been satisfied. The applicant was aware of the steep slopes and the City imposed conditions to protect the slope, creek and residential community. Similar conditions have been recommended this time to assure the continued safety of the project and again to protect the surrounding community. 3. In order to minimize the disruptions along the streets and for the adjacent neighbors the permit shall be issued for two years. Excavation may be permitted from May 15 to October 1 in 1987 and 1988. Additional limitations may be imposed depending upon weather conditions, and such limitations shall be solely within the discretion of the appropriate City official. 4. At the end of each grading season the applicant shall revegetate the site and hydroseed the site as approved by the Building and Zoning Department and the Public Works Department. Areas of natural vegetation designated for preservation in the plans shall not be disturbed. DECISION The Special Permit to excavate and grade the site is approved subject to the following conditions: 1. The permit shall be issued for not more than two years. 2. Excavation may be permitted from May 15 to October 1 in 1987 and 1988. 3. Additional limitations may be imposed depending upon weather conditions, and such limitations shall be solely within the discretion of the appropriate City official. 4. At the end of each grading season the applicant shall revegetate the site and hydroseed the site as approved by the Building and Zoning Department and the Public Works Department. Any aggrieved person feeling that the decision of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which could not be reasonably available at the prior hearing may make a written request far a review by the Examiner within fourteen (14) days from the date of the Examiner's decision. This request shall set forth the specific errors relied upon by such appellant, and the Examiner may, after review of the record, take further action as he deems proper. An appeal to the City Council is governed by Title IV, Section 3016, which requires that such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting other specified requirements. Copies of this ordinance are available for inspection or purchase in the Finance Department, first floor of City Hall. The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur concerning pending land use decisions. This means that parties to a land use decision may not communicate in private with any decision-maker concerning the proposal. Decision-makers in the land use process include both the Hearing Examiner and members of the City Council. All communications concerning the proposal must be made in public. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. Any violation of this doctrine would result in the invalidation of the request by the Court. The applicant, Kohl Excavating, Inc. , is requesting approval of a fill and grade permit to allow the excavation of approximately 66,200 cubic yards of material. This application has been submitted to enable the applicant to complete excavation work originally applied for and approved under File SP-023-86. The original permit was for removal of 185,000 cubic yards of material with the condition that the permit would expire October 31, 1986. The applicant was not able to complete the excavation project before the permit expiration date. 2. The Environmental Review Committee issued a Determination of Non-Significance - Mitigated for the project on April 22, 1987, with the following mitigating conditions: a. That a $5,000.00 revolving cash bond for street sweeping or cleaning be posted. b. That the hours of operation be limited to 7:30 a.m. to 3:30 p.m. weekdays and, if necessary, 8:00 to 4:00 p.m. on Saturday. c. That the site be revegetated upon completion of the grading operation including reforestation and hydroseeding. This shall be completed by October 1, 1987. d. That a hard surface exit road and wheel wash be provided on-site. e. That the applicant provide a $10,000 bond to assure maintenance of the box culvert at the airport. f. That no grading shall be allowed within the native growth protection area and steep slopes on the western and southern portions of the site as shown on plans. g. That the grading operation shall not occur during the wet season beginning in October. h. That the applicant work with the Police Department and the Public Works Department in establishing appropriate haul routes through the City. BUILDING AND ZONING DEPARTMENT PRELIMINARY REPORT TO THE HEARING EXAMINER PUBLIC HEARING KOHL EXCAVATING INC. MAY 19, 1987 PAGE 3 3. Under Section 4-2303(2)B of the Minining, Excavation, and Grading Ordinance, a series of seven criteria are established to determine whether or not the excavating operation is not unreasonably detrimental to the surrounding area. This, together with a discussion of the applicant's compliance follow: a. Size and Location of the Activity: The project site area is 7.5 acres. The previous application for project site was 6.7 acres. This difference is explained by the fact that the applicant is currently in the process of annexing two parcels of property along the northwest parcel of property not previously owned by the applicant when the original permit was submitted. The site is located on the west side of Rainier Avenue North at approximately the 800 block. b. Traffic Volume and Patterns: The applicant proposes to operate during the hours of 7:30 a.m. to 4:00 p.m. These hours as one mitigating condition have been changed to 7:30 a.m. to 3:30 p.m. on weekdays with the possibility of extra hours from 8:00 to 4:00 p.m. on Saturdays. The revised hours will allow the applicant to make approximately 6-7 truck trips per hour using only the weekday hours. The exact haul routes have not been determined since the applicant is not sure where the excavated material will be delivered. Under the previous permit, the applicant intended to deposit the material at the Black River Corporate Park. The possibility exists that the Black River site could again be a destination site for the material. Due to this uncertainty, a mitigating measure was imposed requiring the applicant to work with the Police and Public Works Department on appropriate haul routes through the City. c. Screening, Landscaping, Fencing and Setbacks: Special screening or fencing will not be required for this project. The only setbacks imposed on the applicant are the Native Growth Protection Area designated on the grading plans. These are areas not to be disturbed by the excavation activity. The applicant's landscape plan shows the natural area together with the proposed reforestation. d. Unsightliness, Noise, and Dirt: The applicant has proposed measures to reduce the impacts of the project with respect to unsightliness, noise and dirt. (Note: These are also mitigating measures for the project.) The measures include a hard surface exit road with a wheel wash system, the posting of a bond for street cleaning, and revegetation of the site. Construction noise activity will increase due to the project. However, since the applicant is limited to operating during daylight hours, this should reduce any adverse impacts on the surrounding area. e. Surface Drainage: Storm water drainage is a concern with this site. The applicant will be cleaning accumulated dirt and debris from the detention ponds, ditches and central structures. MAY 19, 1987 PAGE 4 permanent storm drainage system will be installed in stages as the property is excavated. Erosion control devices will be used to minimize erosion and silt laden runoff. Further, the applicant will provide a bond to the City for proper clean-up and restoration of the box culvert at the Renton Airport. These measures are appropriate for minimizing drainage due to surface drainage. f. Length of the Application of the Existing Operation has to Comply with Non-Safety Provision of this Ordinance. The proposal does comply with the safety provisions, and this specific requirement is not applicable to this request. g. Use of the Site: Future use of the site is not known at this time. The applicant has indicated that future use would be of a commercial nature. Some consideration has been given to an office/warehouse development similar to the complex immediately north of the property, but no plans have been prepared to date. 4. Various City departments commented on the project. These are attached for review. 5. The above analysis of the excavation project as mitigated shows that the proposed project will not be unreasonably detrimental to the surrounding area, and therefore, should be approved. H. January 16 , 1987 TEXT TO DESCRIBE THE PROPOSED RAINIER AVE. EXCAVATION FOR KOHL EXCAVATING INC. The proposal is to reactivate a special grading and fill permit which was originally issued for the subject site under City of Renton file SP-023-86. The original permit was to excavate and remove 185 ,000 cu. yds. of material . Because of the start late in the year, we were unable to complete the project before the cutoff date and the arrival of the winter season. The site was cleared the temporary storm water improvements installed and approximately 60% of the material was removed under the prior application. The present application is to complete the excavation as was originally planned in 1986. This will first involve the cleaning of accumulated dirt and debris from the storm water ponds , ditches and control structures. The excavation will then begin near the center of the site, at the toe of the existing back slope, along the south property line. The excavation will proceed down and northerly, exposing new slope as the excavation progresses. Installation of the permanent storm water system, in the slope will be done in stages as the slope is exposed. Some filling in of the canyon will be done, but the steep slope along the West property line will remain undisturbed. Following completion of the excavation the site will be hydroseeded and the landscaping installed. Maintenance of the temporary storm drainage system and controls will continue until the danger of site erosion has passed. It is expected that the ponds may, be graded and/or filled in the fall of 1987 depending on the growth of the grass and trees used to reseed the site. Every effort will be undertaken to insure that no sediment laden runoff leaves the site. This will be accomplished by the extensive storm water control system and by limiting the excavation activities to the dry weather season. Hours of operation are expected to be 7 : 30 A.M. to 4:00 P.M. weekdays for about 4 months. This works out to about 7 truck loads per hour. Estimated completion date is September 1st 1987 with the hydroseeding and landscaping complete by October 1 , 1987. This will insure the project will be complete before the wet season and give the planting material time to root. A hard surface exit road will be used with a system to wash the undercarriage and wheels of the truck before it enters Rainier Girt'OF RENT®N N 5V1 � �: 6: rg I. JAN 201987 BUILDING/ZONING DEPT. Avenue. The exact route the trucks will take is uncertain at this time, because we don't know where the material will be delivered. We will post a $5000 cash bond to pay for any street sweeping or cleaning that might be required because of the hauling operations. Every effort will be made to insure that no silt laden runoff leaves the site. The City of Renton will evaluate the box culvert at the Renton Airport and if required we will post a bond to insure proper cleanup and restoration of that facility. Future development of the property will be of a commercial nature, but the owner is unsure as to exactly what type or what the layout will be. There has been some discussion of an office- warehouse type complex similar in nature the project adjacent to the North, but no plans have been developed. There will be no development of the steep slopes along the southerly or Westerly boundary lines , these areas will remain as a natural buffer between the site and the adjacent residential areas to the west. Rezone of portions of the site from RM to CG and portions of the site are in King County (None of the excavated area) and an anexation to the City is under way. 10. Removal and regrading of 66,200 cu. yds of material and reseed and landscape the site. This is the second application for this site. The first application was SP-023-86 filed in 1986. We were unable to complete the excavation during the fall of 1986 and this application is a renewal of the original application for the summer of 1' 1987. 12. Location of the proposal. A 7.5 acre site on the West side of Rainier Ave. North in the 800 Block. The site is a vacant tract with steep slopes and was partialy excavated in 1986 under permit application SP-023-86. The property lies in the SE 1/4 of the NW 1/4 of Section 7, Township 23 North, Range 5 East. Included with this-application are existing topography, proposed grading, X-sections, Land scaping and storm drainage plans. B. ENVIRONMENTAL ELEMENTS 1. EARTH a. Yes There is evidence of a continual slide problem in the SE corner of the property along Rainier Ave. (see original ground topography map and .so;i.ls report.) - 2 - . e. The intention is to remove the existing slide hazard area and .regrade the site to provide a future commercial building area. f. Could erosion occur as a result of clearing, construction, or use? Yes We intend to mitigate the erosion hazard by grading from the top down, seeding the slope as we go, installing a system of ditches and ponds to trap all runoff from the site and to confine grading to the dry (summer) season. With these controls it is expected that erosion will be very small and confined to the project site. g. About what percent of the site will be covered with impervious surfaces after project construction (for example, asphalt or buildings)? Unknown at this time. h. A local drainage channel runs from near the SW corner of the property to near the NE corner of the site. This channel was partialy filled and a 36" pipe installed several years ago. This pipe eventually empties into Lake Washington about 1500 feet ' NEly of the site. 2) Will the project require any work over, in, or adjacent to (within 200 feet) the described waters? If yes, please describe and attach available plans. The old stream channel will be further filled but no work will be 'within 200 feet of any open drainage or water. 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected.
