Hi again Rachel, Wanted to let you know that my folks finished their review of the agreement and I have attached it here. If your folks would like to discuss any of these comments and proposed revisions, please let me know and I’d be happy to get my folks in touch with yours. Getting this completed and off our plates in the very near future is imperative as we are about to issue NTP and start construction early next year. Per our phone conversation back on June 6th, you had confirmed that if this agreement is not in place in time for construction that it would not prohibit ST from performing construction work, since PSE has already done their review of the project plans and had approved them. I’d like for you to reconfirm this understanding as we’re planning to finalize this agreement concurrently with construction activities on our property site for the new Renton Transit Center, and our construction and project will not impede or interfere with PSE’s easement. Additionally, can you please respond to my questions #1-4 below that I’ve had in your queue since August? If there is someone else that I should be reaching out to within PSE real property/real estate at this point to get this agreement (and the relinquishment of the old “Parcel C easement”) completed, please let me know as I am happy to connect with them. While I know you had said the lack of a fully executed consent agreement will not prohibit construction from taking place on our property, I would like to make sure that we get this agreement fully executed and completed so that it’s one less thing we are trying to coordinate mid-construction. I put everything here in this email again for easy reference. 1. Does item #7 “landscaping/planting plans” also include the irrigation we’ll have within the easement? Or should that be added to #7 or added as a separate item? 2. We met with Stan Haralson from PSE vegetation management in 2023/2024 to review the planting plans within the PSE easement and he had given us the approval on allowing some vine maples to be within the easement area, but spaced so that even at the 15ft-25ft high maturity they can sometimes get to, they would not get in the way of the transmission lines nor violate any required clearances. I want to make sure that this will not be an issue – since PSE veg management reviewed this and had no issues with it – given term and condition #6 “All shrubs and trees……fifteen (15) feet in height at maturity”. 3. Can we confirm whether or not term and condition #3 “All persons…..from all power lines” is for horizontal or vertical clearances or both? My team is confirming whether or not the bioswale grading work would be 20ft away from all the power lines. But, I take the fact that PSE is OK with the design, including the bioswales, as approval of any grading work required to construct the bioswales given our contractor will abide by all RCWs and WACs regarding construction around and near your facilities and will not impact the poles or lines? Would that be correct to say? 4. Similar to #3, regarding grading, is PSE accepting all of the grading we have shown in our plans or do you expect the contractor to ask for permission on a location-by-location basis for any grading work before it begins? I want to assume that PSE understands there will be grading work required to build the scope of work that is being approved as part of this consent agreement and that the contractor will not need to get an approval from PSE every time there’s grading work happening within the easement, as long as we are following all laws, codes, and protecting the power lines and poles.
