Following-up from a chat we had earlier this month regarding the conditions of approval for the civil permit, this one being for condition #10. KCM will be the ones who are maintaining
the storm drain along Lake Ave since they are the “tenant” of the WSDOT owned property and have their own O&M agreement with WSDOT for maintenance responsibilities of the site. I have
attached the email thread between myself and KCM (Talon Swanson) that notes KCM’s acceptance of maintenance of this storm drain.
Will this email suffice to satisfy this condition, or do you need KCM to write a letter stating their maintenance responsibilities here? Note that this storm drain will be covered under
KCM/WSDOT’s updated O&M agreement as well, as KCM/WSDOT have to update their O&M agreement to include new items on Lake Ave that ST’s Renton Transit Center project is building.

4. All temporary project entitlements (construction easements and/or property permissions) shall be in place and copies provided to the City prior to construction activities occurring
within those temporary project entitlements. any properties, easements or right-of-ways within the project which benefit any other parties such as public agencies, private property
owners, or easement beneficiaries.
Just trying to make it clearer that this pertains to temporary project entitlements and that ST will not perform any work on locations where we don’t have temporary project entitlements,
which is something we as an agency already would not let our contractor do.

I wanted to follow-up from our phone conversations on 12/9 and today in regards to the conditions of approval for Sound Transit’s Civil Construction Permit (C24002123). Per our conversations,
here are the notes and concurrence on what we discussed.
* ST takes issue with the City's use of the verbiage "Notice To Proceed" within these conditions. Thank you for agreeing to revise this verbiage to something else such as [prior to]
Notice To Proceed “initial ground disturbance” or “mobilization” or whatever phrasing you come up with. If you wouldn’t mind sharing that with me prior to revising the conditions of
approval, that’d be much appreciated. Also noting that the physical process from the City to grant ST the permission to start ground disturbance, mobilization, work, etc., would be
either via email, or in-person after the City pre-con meeting.

1. Issuance of Civil Construction Permit C24002123 is for the purposes of final project final contractor procurement. Construction shall not commence until written or verbal approval
for construction activities is provided by City Project Manager or Inspector upon satisfaction of Conditions 2-6. Additional information such as contractor and subcontractor business
licenses and insurance naming the City as additionally insured shall be approved by City risk management and legal staff and in place prior to construction.
a. We have provided Shimmick's business license and can provide subcontractor business licenses after our NTP issuance to Shimmick. We have Shimmick's COI and will have it revised

2. A pre-construction meeting shall be held with the Applicant, Project Contractor, City Representatives and Inspection Staff prior to City's Notice to Proceed.
a. This is tentatively scheduled for 12/17 Noted.
3. All project construction and inspection fees shall be paid prior to scheduling of pre-construction meeting and issuance of the City's Notice to Proceed.
a. These have already been paid Noted.
4. All temporary project entitlements (construction easements and/or property permissions) shall be in place and copies provided to the City prior to construction activities occurring
within any properties, easements or right-of-ways within the project which benefit any other parties such as public agencies, private property owners, or easement beneficiaries.
a. All temporary project entitlements such as easements and property permissions are in place. We confirmed that this would just be temporary construction easements (which we have
with Airlocker and CarPros) and that there are no other temporary project entitlements, and that permanent easements would not fall under this condition. Correct.
5. Project Public Agency Service Agreement shall be in place and executed prior to City's Notice to Proceed.
a. This has been executed and is in place Correct.
6. All outside agency permits or approvals such as Department of Ecology or Washington State Department of Transportation shall be in place and provided to the City prior to Notice to
Proceed. Limited work based on relevant scopes may be granted on portions of the project at the discretion of the City’s Project Manager in the event additional outside agency permits
or approvals are required or delayed.
a. ST has obtained the DOE NPDES permit. Regarding WSDOT, as we discussed on our 12/9 call, we do not have WSDOT approval yet to perform work on scopes of the project that are in WSDOT
ROW (Lake Ave/South Renton Park & ride, and SR-167) or WSDOT conformed agreement areas (i.e. Rainier Ave). ST will constrain our contractor from doing work within these 3 WSDOT areas
(lake Ave/South Renton Park & ride, Rainier Ave, and SR-167) to prevent Shimmick from performing this work until we have our approved WSDOT PDA and WSDOT construction agreement, both
of which are expected in ~January 2026. As we discussed, the City would not hold up our ability to perform work on our own ST property/site because of this, and the City would issue
us the ability to start work on our own site with the condition that we need to get WSDOT approvals finalized before working on WSDOT properties/ROW. Ok, hopefully the above verbiage
looks good.
b. As discussed regarding the pending PSE consent for easement use agreement, and SCL consent for easement use agreement, the City will not prohibit ST from performing work on our own
property without these agreements fully executed because of 1) ST has confirmation from both PSE and SCL that they have approved the plans for the project, 2) PSE has provided confirmation
that this agreement would not prohibit ST from performing construction work, 3) ST’s project would not impede or interfere with any of PSE and SCL’s easement rights on ST’s property,
and 4) the City views these overhead power lines as lines on private property, and they are not in the City ROW. Thanks for sending the email, that’s really all I need.
7. Sheet BT120-CHP101 (Page 42): Detailed haul route submittal requirement.
a. We/Shimmick will provide this after we issue NTP to Shimmick Thank you
8. Sheet BT120-CDP100 (Page 163): Pipe and easement ownership exhibit requirement.
a. We can put together the exhibit that delineates public and private stormwater pipes, structures and facilities, but we can't provide all final easements and revised and/or relinquished
easements because these are closeout items and we won't have finalized easements until near project completion. Note that we confirmed draft easements can be provided. Thank you.
Ya, just one big roll plot showing even the draft easement locations and labeling the public/private will be super helpful for our Public Works folks to see and think it will pay off
really big dividends if we have something now instead of scrambling at the end of the project when it’s no longer fresh in their minds how everything is working.
9. Sheet BT120-CDP105 (Page 166): Remove existing upstream pipe.
a. We will make the requested revision Thank you
10. Sheet BT120-CDP105 (Page 166): Provide letter from WSDOT accepting maintenance responsibility of storm drainage structure and pipe.
a. We can provide a letter of maintenance responsibilities being accepted, but by KCM, not WSDOT. While WSDOT is the property owner, KCM would be the ones maintaining it and the letter
would come from them. Additionally, we have email confirmation from KCM already that confirms their maintenance responsibilities (I can share that as well if needed). I will revise
the condition to state KCM. Yes, please provide and I will let stormwater, GIS and maintenance staff know.
11. Sheet BT120-UWP201 (Page 216): 2" RPBA required.
a. We can make this change, however, per the email I sent you on 12/9 we think the City may have missed the fact that we do already have a reduced pressure backflow preventer already
installed on the private line (we wouldn't install the backflow preventer on the water main, which your arrow points to). Once we hear from City water folks, let me know if the City
concurs with this and if this condition can be removed, or just noted as met/completed. I have added Abdoul and our backflow prevention specialist to the Core building permit review
to take a look. I think they got overwhelmed by the plan set and volume 2 and never found a good look at it. My gut is telling me it should be ok as designed, looks like a full RPBA
that serves full premise isolation and not a “plumbing” backflow preventer which is more of a building code requirement but they’ll let us know.
12. Sheet BT120-TSD101 (Page 239): Per Std. plan 140.

Thank you, Mike! I know I’ve told you this before, but we really do appreciate the work you have done to get this permit reviewed and approved. You’ve been a great partner throughout
this entire process and we truly value that and are looking forward to continue that partnership in to construction.
As for the remaining 2 items you noted that are needed to issue the permit:
1. Tree invoice – that check should hopefully be arriving to City hall any day now. It was mailed on 11/25, so I’d imagine if it hasn’t already been delivered to City hall, it would
be tomorrow or early next week.
2. Shimmick’s UBI and City of Renton Business license – See the info below. On the City of Renton business license however, Shimmick used a Renton address to apply for it on 11/13 and
Soyeon said it is still in approval process and waiting for another department to complete their review, and also due to in-state applications taking 2 weeks vs out of state taking
2 days. I had though Shimmick would’ve used their Irvine, CA address (where they’re based out of) for this application, but I’m guessing they used the project site address. I asked
Soyeon if we should just leave the application as is, with the Renton address, since it’s been over 2 weeks since Shimmick submitted the application. In the meantime, can we still
issue the civil permit with the #63076 license number that’s still in the approval process?

Please find the link below to the approved plans for the C24002123 SRTC. The conditions are located on page 7 of Book 1. At this point I cannot “issue” the permit because the computer
system requires the tree invoice to be paid but the plans and permit are in “approved” status. The system will also likely require that I have the prime contactors state UBI and City
of Renton license # so please get that to me as possible. If you need the permit issued early next week to finalize the contract (egg-chicken scenario), we may be able to find a way
to overwrite the system, I do understand with public contracts it’s a bit different than a regular private development project. Please let us know if you have any questions. Thank
