� oceeding at law, at such times as may be necessary, to enter i:_:on the easement, for
t 'e pprpose of constructing, repairing, altering or reconstructing said sewer Pain,
Csor making any connections herewith ,without incurring any,,iegal obligation or liability
herefor, provided that such constructing, repairing, altering or reconstructing of
said sewer main shall be accomplished in such a manner that the private improvements
existing in this easement shall not be disturbed or destroyed, or in the evert that
they are disturbed or destroyed, -they will be replaced in as good a condition as they
were immeaiately before the property was entered upon by the said Grantee.
The Grantor shall retain the right to use the surface of the easement if such use
does not interfere with installation of the sewer main. However, the Grantor shall
not erect buildings or structures on the easement during the existence of said easement.
The easement, during its existence, shall be a covenant running with the land and
shall be binding on the successors, heirs, and assigns of both of the parties hereto.
